בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת ערבון בהליך שבכותרת.

ההליך נסוב על החלטה של בית המשפט המחוזי בירושלים בבקשה לביטול פסק בוררות שניתן על ידי בית דין ירושלים לדיני ממונות ולבירור יוחסין, בקשר להיקף זכויות בנייה בחצר בית דירות בירושלים. המבקשים ביקשו את ביטולה של החלטת בית הדין שכותרתה "הבהרה בעניין הבקשה להבהרת פסק דין". בית המשפט קבע כי אותה החלטה אינה "פסק ביניים" מאחר שלא מ דובר
בהחלטה בעלת ישות עצמאית אלא בדברי הסבר הקשורים קשר בל יינתק להחלטה אחרת, ולכן לא ניתן להיזקק לבקשה לביטולה.

בבקשה לפניי נטען כי למבקשים אין יכולת כלכלית לעמוד בהפקדת הערבון. מבקש 1 הצהיר כי הוא מתקיים מקצבת זקנה בלבד, מתגורר בגפו בדירה בת חדר אחד ומתנהלים נגדו הליכי הוצאה לפועל בגין חובות העולים על 180,000 ₪. על רקע זה הוכרז מבקש 1 כחייב מוגבל באמצעים. מבקש 1 הצהיר כי גם למבקשת 2 אין יכולת לשלם את הערובה, היא אינה עובדת ומתקיימת מכספים שמעביר לה מבקש 1. המשיב מתנגד לבקשה. התנגדותו מבוססת, בעיקרו של דבר, על סברתו כי סיכויי ההליך נמוכים ועל כך שיתקשה לגבות הוצאות מהמבקשים, ככל שייפסקו. המבקשים עמדו על זכותם להגיב לתשובת המשיב, מכוח תקנה 241(ג1) לתקנות סדר הדין האזרחי, התשמ"ד-1984. ואולם, תקנה 241(ג1) לתקנות אינה חלה על בקשות המוגשות בגדר ערעורים ובגדר בקשות רשות ערעור. התקנה הרלוונטית הינה תקנה 465 לתקנות (ראו, בש"א 1164/08 בן צבי נ' גלברג (לא פורסם, 13.2.2008). תקנה 465 אינה מקנה למבקש זכות להגיב לתשובת המשיב (בניגוד לאמור בתקנה 241(ג1)). יחד עם זאת, החלטתי להיעתר לבקשת המבקשים ולקבל לרישום את תגובתם, כך שזו הייתה מונחת לפניי בעת מתן ההחלטה.

עיון בבקשה ובאסמכתאות שצורפו לה מעלה כי מצבו הכלכלי של המבקש 1 אינו מן המשופרים. אשר למבקשת 2, הבקשה חסרה תצהיר מטעמה וכמו כן, מההחלטה נשוא הערעור עולה כי מבקשת 2 רשומה כבעלים של דירת המגורים הקשורה להליך הבוררות. לא הובהר מדוע לא ניתן להסתייע ברכוש זה לשם גיוס כספי הערבון. בנוסף, לשם היעתרות לבקשה לפטור מערבון אין די בדלות כלכלית ויש צורך לאמוד את סיכויי ההליך. מעיון בחומר שבתיק עולה כי על פניו סיכויי ההליך אינם גבוהים במידה הנדרשת לשם מתן הפטור המבוקש. כלל הוא כי בקשות רשות ערעור בענייני בוררות ניתנות אך בנסיבות מיוחדות, מקום בו עולה שאלה בעלת חשיבות משפטית או ציבורית מיוחדת (רע"א 235/89 כוכבי נ' ארמה בנין בע"מ (לא פורסם, 27.7.89); רע"א 3505/00 רם חברה לעבודות הנדסיות בנין ושוברי גלים בע"מ נ' אחים שורק בע"מ
(לא פורסם, 11.7.00); רע"א 11667/05 מימי מבואות ירושלים נ' כהן (לא פורסם, 17.10.2007)). מעיון בבקשה לרשות ערעור ובהחלטה של בית המשפט המחוזי נראה כי, על פניו, על פי אמת מידה זו, סיכויי ההליך להתקבל הינם נמוכים. יחד עם זאת, בשים לב לכך שהמשיב אינו חולק על הטענות לעניין דלות כלכלית של המבקשים ולאסמכתאות שהוצגו בעניין מצבו הכלכלי של מבקש 1, כמו גם להיקפו הצר יחסית של ההליך, יועמד הערבון על סך של 4,000 ₪. הערבון יופקד תוך 14 יום מעת המצאת החלטה זו, ולא- ירשם ההליך לדחייה ללא צורך במתן הודעה נוספת.
