בקשה להפקדת ערבות צד ג'
החלטה
אין מקום להיעתר לבקשה שבפניי להפקדת ערבות צד שלישי חלף עירבון. זאת שכן ערבות של צד שלישי אינה שוות ערך לעירבון מבחינת וודאותה ונזילותה, ועל כן המשמעות המעשית של הבקשה היא למתן פטור מהפקדת עירבון.
ואולם בטענות המבקשת בדבר הסכומים שהוציאה עד עתה בגין ההליכים וההלוואות שנטלה אין כדי להוכיח כי מצבה הכלכלי קשה, כטענתה, ואין בהן, באופן בו הוצגו כדי להרים את הנטל הנדרש להוכחת חוסר יכולת כלכלית להפקיד עירבון. כך נעדרת הבקשה כל פירוט, ולו מינימאלי, של נכסיה, הכנסותיה והוצאותיה של המבקשת; הבקשה אינה נתמכת באסמכתאות רלבנטיות (כגון תדפיסי חשבון בנק); ואין בה התייחסות לשאלה כיצד נושאת המבקשת בעלויות ייצוגה המשפטי וליכולת העומדת לה לגייס את העירבון בעזרת סביבתה הקרובה (כגון בעזרת אותו צד שלישי אשר ערבות מטעמו מבקשת היא להפקיד).
בהינתן האמור בטענות המבקשת לעניין סיכויי ההליך אין כדי לסייע בידה, ומשכך אין מקום לפטור אותה מהפקדת עירבון, ולאחר שעיינתי בחומר שבתיק ובשים לב להיקף ההליך, יועמד העירבון על סך של 6,000 ש"ח.
עירבון כאמור יופקד בתוך 15 ימים מעת המצאת החלטה זו, ולא - יירשם ההליך לדחיה, ללא הודעה נוספת.
