הבקשה הוגשה מלכתחילה באופן חסר. לאור העובדה שהמבקש הינו אסיר וכי אינו מיוצג, איפשרה כב' הרשמת ל' בנמלך למבקש, לפנים משורת הדין, להשלים את בקשתו. על רקע הבקשה וההשלמה שהוגשה, לרבות המסמכים שצורפו ומסמכים בהליכים נוספים אותם הגיש המבקש ואשר אליהם הפנה, מוכן אני להניח כי מצבו הכלכלי של המבקש אינו מן המשופרים. בהקשר זה אציין, כי אך לפני זמן קצר ראיתי ליתן למבקש פטור כמעט מלא מאגרה בגדר בקשת רשות ערעור על פסק דין של בית המשפט המחוזי בעתירת אסיר, תוך שציינתי כי החלטתי ניתנת בשים לב, בין היתר, למהות ההליך (רע"ב 4811/14). פטור חלקי (אך ממשי) ניתן למבקש אף בהחלטה נוספת שהתקבלה בעניינו לפני כשמונה חודשים (רע"ב 7442/13, החלטתה של כב' הרשמת ל' בנמלך מיום 12.11.2013), ואילו במקרה נוסף ניתן למבקש פטור מלא מתשלום אגרה, תוך שצוין כי אין לראות בכך אינדיקציה למקרים אחרים (רע"ב 1611/14, החלטתו של כב' הרשם ג' שני מיום 19.3.2014). אוסיף, כי המבקש צרף החלטה של רשם ההוצאה לפועל מיום 21.5.2012, בגדרה הוכרז כחייב מוגבל באמצעים. החלטה זו אמנם ניתנה לפני למעלה משנתיים, ומשכך אינה מהווה ראיה לכאורה להיעדר יכולת כלכלית (תקנה 14(ד)(2) לתקנות בתי המשפט (אגרות), התשס"ז-2007), אולם ברי כי יש בה כדי להוות אינדיקציה למצבו הכלכלי של המבקש. על אף האמור, לא התרשמתי כי המבקש אינו יכול לשלם או להפקיד סכום כלשהו . לעניין העירבון אוסיף, כי ספק אם ניתן לומר שסיכוייה של בקשת רשות הערעור דנן הינם טובים, וזאת בשים לב, בין היתר, למשוכה הגבוהה אשר ניצבת בפני מבקשים בהליכים כגון דא.
משאיזנתי בין כלל השיקולים הצריכים לעניין, ובכלל זה - לעניין העירבון - היקפו המצומצם עד מאד של ההליך וסכום ההוצאות המינימאלי שהושת על ידי בית המשפט לתביעות קטנות, ראיתי לנכון להעמיד את סכום האגרה על סך של 200 ₪ ואת סכום העירבון על סך מתון של 1000 ₪.
האגרה תשולם תוך 14 ימים מיום המצאת החלטה זו לידי המבקש (ימי הפגרה יבואו במניין), ואף העירבון יופקד תוך אותו מועד, שאם לא כן - יימחק ההליך או יירשם לדחייה, לפי העניין, ללא הודעה נוספת.
