החלטה
לפניי בקשה לפטור מאגרה ומהפקדת ערבון שבכותרת.

ברקע ההליכים עומדים קנסות בגין עבירות חניה שהוטלו על רעייתו של המבקש. משלא שילמה רעייתו של המבקש את הקנסות ולא נקטה בהליכים אחרים לביטול הדוחות והקנסות, פתחה נגדה המשיבה – עיריית פתח תקווה – בהליכי גבייה לפי פקודת המיסים (גבייה). פקיד מטעם המשיבה ביקש לעקל מטלטלין בבית המבקש ורעייתו. על מנת למנוע את הוצאת המטלטלין, מסר המבקש לידי המשיבה שיק בסכום הקנסות – 800 ₪. השיק לא כובד והוגש לביצוע ללשכת ההוצאה לפועל. למבקש ניתנה רשות להתגונן בשאלה האם מוסמכת המשיבה על פי החוק לגבות קנסות בגין עבירות חניה שנעשו בתחומה. בית משפט השלום בפתח תקווה (כב' השופט א' גולדס, סגן נשיא) השיב על השאלה בחיוב ומכאן מסקנתו כי אין למבקש כל הגנה בתביעה השטרית. בית המשפט המחוזי מרכז (כב' השופט ש' שילה) דחה את ערעורו של המבקש על פסק הדין. מכאן הבקשה לרשות ערעור.

בד בבד עם הבקשה לרשות ערעור הגיש המבקש בקשה לפטור מאגרה ומהפקדת ערבון. נטען בה כי בקשת רשות הערעור דנה בעניין פלילי של סמכות העירייה לפעול בביצוע עונשי קנס המהווים גזר דין פלילי. ההליך הוא למעשה הליך פלילי וככזה הוא פטור מאגרה וערבון. המשיבה מתנגדת לבקשה. לטענתה, מ דובר
בהליך בעל אופי אזרחי ואף אם להליך קיים פן פלילי, אין המ דובר
בהליך בעל אופי פלילי. עוד נטען כי המבקש לא הציג לפני בית המשפט כל תשתית לעניין אי יכולתו הכלכלית.

אומר מיד כי דין הבקשה להידחות. הבקשה לרשות ערעור נסבה על פסק-דין בתביעה שטרית שהגישה המשיבה נגד המבקש. אמנם, ברקע הדברים מצויים קנסות בגין עבירות חנייה. אולם בכך אין די כדי לסווג את ההליך כהליך פלילי הנשלט על ידי
סדרי הדין הפליליים. הליך של תביעה שטרית הוא הליך אזרחי, עליו חלות ההוראות הדיוניות הקבועות בחיקוקים השונים הדנים בהליכים אזרחיים, לרבות הוראות בעניין אגרה וערבון. ההיבט הפלילי המצוי ברקע ההליך אינו משליט עליו את סדרי הדין הפליליים. יוער בהקשר זה, כי אף כאשר עסקינן בהליכים בעלי אופי פלילי מובהק, אשר אך לצורך הערעור נקבע כי הדרך לערער היא בדרך שמערערים על פסק-דין אזרחי - כדוגמת ערעור על חילוט אזרחי במסגרת חוק איסור הלבנת הון, התש"ס-2000, או ערעור על חיוב בתשלום פיצויים לקורבן בעבירה במסגרת חוק העונשין, התשל"ז-1977 - חייב יוזם ההליך בתשלום אגרה ובהפקדת ערבון. ההיבטים הפליליים של ההליך משפיעים, לכל היותר, על קביעת גובה הערבון, נוכח העובדה שהפן הפלילי של ההליך מעצים את חשיבותה של זכות הערעור ומשליך על אומדן ההוצאות הצפויות במקרה של כשלון ההליך (השוו, ע"א 10319/06 נורדן נפטר (1998) בע"מ נ' מדינת ישראל (לא פורסם, 1.4.2007); רע"א 5942/06 בוטח נ' מדינת ישראל (לא פורסם, 5.12.2006); רע"א 982/08 פיכמן נ' כונס הנכסים הרשמי (לא פורסם, 3.3.2008)). אין הוא מביא, עם זאת, לפטור אוטומטי מאגרה וערבון. קל וחומר שאין עומד למבקש פטור מאגרה וערבון בהליך דנן, הנשלט כולו, מראשיתו ועד סופו, על-ידי סדרי הדין האזרחיים הנהוגים בתביעות שטריות. את הערבון במקרה דנן יש להעמיד על סך 7,500 ₪. סכום זה נקבע בהתחשב במהות ההליך, היקף ההתדיינות הצפויה ואומדן בדבר היקף ההוצאות. האגרה תשולם והערבון יופקד תוך 14 יום מעת המצאת החלטה זו, ולא- יימחק ההליך או יידחה, בהתאמה, ללא צורך במתן הודעה נוספת.
