החלטה
בקשת רשות ערעור על החלטת בית המשפט המחוזי בתל-אביב-יפו (כב' השופט א' שילה) בבש"א 16201/06 שנדונה במסגרת ע"א 3870/04, שלא לעיין מחדש בהחלטה לביטול פסק דין שניתן בעדר הפקדה.

המשיב הגיש תביעה בבית משפט השלום בתל-אביב (כב' השופטת נ' גרוסמן), על רקע סכסוך כספי, נגד המבקש ואביו. התביעה התבססה על מסמך הנחזה להיות הצהרה בחתימת אבי המבקש. מתחת לחתימת האב נכתב בכתב יד שמו של המבקש ומספר תעודת הזהות שלו. המבקש טען להגנתו כי לא מ דובר
בחתימתו. הוסכם בין הצדדים לקבל חוות דעתו של גרפולוג. חוות דעתו של הגרפולוג הייתה כי החתימה שבמחלוקת היא אכן חתימת המבקש. לפיכך, ביום 18.10.04 ניתן פסק דינו של בית משפט קמא נגד המבקש ואביו.
המבקש הגיש ערעור לבית המשפט המחוזי. רשם בית המשפט המחוזי קבע כי הערעור לא ישמע בטרם יופקד עירבון בסך 15,000 ₪ להבטחת הוצאותיו של המשיב והורה על הפקדתו תוך 30 יום. לאחר כשנה נעתר בית המשפט המחוזי (כב' השופט א' שילה) לבקשת המשיב והורה על מחיקת הערעור בשל אי הפקדת העירבון ואי התייצבותו של המבקש לדיון שנקבע.
המבקש הגיש בקשה לעיכוב ההליכים ולביטול פסק הדין. לדבריו, בית המשפט המחוזי קבע בהחלטתו מיום 6.3.06 כי בטרם ידון בבקשה על המבקש להפקיד 10,000 ₪ תוך 10 ימים. סכום זה הופקד, אולם אז הורה בית המשפט על הפקדת סך של 15,000 ₪ כעירבון להוצאות והבהיר כי הפקדת סך של 10,000 ₪ לא כוונה כפיקדון להוצאות. יצוין כי החלטות אלה לא צורפו לבקשה. מכל מקום, משלא הופקד סכום זה, ולאחר שניתנו למבקש הזדמנויות נוספות, אך הערבון לא הופקד, דחה בית המשפט את בקשתו לביטול פסק הדין. בקשה לעיון חוזר שהגיש המבקש נדחתה.

מכאן בקשת הערעור שבפני. המבקש טוען כי העירבון שנקבע על ידי בית משפט קמא גבוה וכי אין בידו להפקיד את סכום העירבון שנקבע. לטענתו, בית המשפט קמא לא דן בבקשותיו לשינוי גובה העירבון ואין סכום העירבון שנקבע משקף איזון נאות בין קיום מטרתה של הערובה להותרת דלתות בית המשפט פתוחות. הוא מציין כי הוא צעיר כבן 23 שאך זה השתחרר משירות צבאי ואין בידו לגייס את סכומי העירבון שנקבעו. בנוסף, טוען המבקש כי סיכויי ערעורו גבוהים הואיל ופסק דינו של בית המשפט בערכאה הדיונית הסתמך על חוות דעת מומחה מבלי להתייחס להבהרה שניתנה על ידי אותו מומחה.
המשיבה טוענת כי הבקשה למתן רשות ערעור הוגשה באיחור של שישה ימים ודינה להידחות על הסף. לחלופין, טוענת המשיבה כי צדק בית המשפט כשקבע כי יש לדחות את ערעורו של
המבקש בגין אי התייצבות ובגין אי הפקדת ערובה. המשיבה מבהירה כי הסך של 10,000 ₪ שבית המשפט הורה למבקש להפקיד מתייחס לבקשה נוספת, אחרת, שהגיש לעיכוב הליכי הוצאה לפועל. לדבריה, סיכויי הערעור קלושים בהינתן שהייתה הסכמה בין הצדדים למנות גרפולוג וכי גורל התביעה ייגזר לפי ממצאיו. לפיכך ולאור חוות דעתו של הגרפולוג הקובעת כי החתימה שבמחלוקת נכתבה על ידי המבקש, הסבירות כי הערעור התקבל נמוכה.

דין הערעור להידחות. הבקשה נסבה על החלטת בית משפט קמא לדחות את בקשת המבקש לעיון מחדש בהחלטה לביטול פסק דין שניתן בהעדר הפקדה. עיינתי בבקשה ובנספחיה וכן בהחלטות הערכאות דלמטה ולא שוכנעתי כי יש מקום ליתן רשות לערער על פסק הדין, שכן המקרה נשוא בקשה זו איננו מגלה עילה להתרת ערעור שני ברשות (ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור
(הדר חיפה ) בע"מ , פ"ד לו(3) 123 (1982)). כידוע, אי הפקדת עירבון במועד עלולה להביא למחיקת ערעור, שכן, "מערער שלא הפקיד את העירבון לא רק פגע בזכות המשיב לקבל ערובה להוצאותיו, אלא גם הימרה את פי בית המשפט" (יואל זוסמן, סדרי הדין האזרחי
(מהדורה שביעין בעריכת ד"ר ש' לוין), עמ' 829; בש"א 2005/97 יהושע נ' מגדל חברה לביטוח בע"מ תק-על 97(2), 148 (1997)). אכן, סכום העירבון צריך לשקף איזון בין הגנת האינטרס של המשיב בערעור לבין אינטרס השמירה על זכות הערעור כזכות אפקטיבית וממשית (ראו: רע"א 9630/06 א. ד.א. יזמות בע"מ נ' מולטיקו ניהול נכסים (1993) בע"מ (23.1.07)). יחד עם זאת, לא ניתן להתעלם מכך שהמבקש לא הפקיד כל סכום מאז ניתנה ההחלטה על הפקדת עירבון עוד בשנת 2004. ההתנהלות כולה – לרבות הבקשה לבית משפט זה מבלי שצורפו ההחלטות הרלוונטיות כולן – משקפת זלזול בהליך, ומשכך אני סבורה כי דין הבקשה להידחות.
כאמור, המבקש בחר שלא להפקיד את הערובה שנקבעה עבורו. לפיכך אין לו אלא להלין על עצמו שערעורו נדחה.

אשר על כן, בקשת רשות הערעור נדחית. המבקש ישלם למשיבה שכר טרחת עורך דין בסך 1,000 ₪ והוצאות משפט.
