החלטה
בקשת רשות ערעור על החלטתו של בית המשפט לעניינים מנהליים מרכז מיום 2.1.2012 בתיק עת"א 38525-06-11 (כב' השופט א' טל ), בגדרה נדחתה עתירתו של המבקש לשילובו בסבב חופשות מן הכלא.

המבקש הוא אסיר המרצה עונש של 80 חודשי מאסר בפועל בגין הרשעתו בעבירות רכוש וסמים. ביום 3.8.2011 נדונה עתירתו של המבקש להתיר לו לצאת לחופשות, ו בית המשפט קבע בהחלטתו (להלן: ההחלטה הראשונה ) כי יש בסיס לחשש לשלום המבקש ולשלומם של אחרים אם יצא לחופשות. עם זאת קבע בית המשפט כי לאור חלוף הזמן ממועד קבלת המידע אודות המבקש, תבחן משטרת ישראל את תקפו תוך ששה חודשים (קרי, עד לראשית חודש פברואר 2012).
על החלטה זו לא ערר המבקש, אולם ביום 13.9.2011 הגיש עתירה נוספת ל בית המשפט לעניינים מינהליים מרכז (כב' השופטת נ' אוהד ) בה עתר לחשיפת המידע המודיעיני הקיים בעניינם של שותפיו לעבירה (להלן: השותפים ), כדי שיוכל להוכיח כי אלו יצאו לחופשות ואף קוצר שליש ממאסרם, למרות שלגביהם קיים מידע מודיעיני לא פחות מגביל מאשר בעניינו. בקשה זו נמחקה על הסף ביום 2.10.2011 ואף בקשה לעיון חוזר שהוגשה ביום 3.11.2011 נדחתה ביום 9.11.2011.
המבקש לא אמר נואש וביום 26.12.2012 הגיש "בקשה דחופה לעיון חוזר" בהחלטה הראשונה בטענה כי ברשותו עובדות חדשות להצגה לפני בית המשפט והן
תצהירי השותפים כי אין להם סכסוך עמו. כן עתר המבקש כי בית משפט קמא יעיין במידע המודיעיני אודות השותפים. הבקשה נדחתה בהחלטה נשוא בקשת רשות ערעור זו (להלן: ההחלטה השנייה ), בה נאמר "אני דוחה את הבקשה לדיון חוזר. העותר זכאי להגיש עתירה חדשה".

מכאן בקשת רשות הערעור שלפניי, בה טוען המבקש כי החלטתו של בית משפט קמא ניתנה ללא נימוק, ודי בכך להצדיק מתן רשות ערעור בעניינו. עוד הוסיף המבקש וטען גם להחלטה הראשונה גופה.

דין הבקשה להידחות.
בקשת רשות הערעור נסבה במהותה על ההחלטה הראשונה ולא על ההחלטה השנייה, והיא לא מגלה דבר החורג מעניינו הפרטי והפרטני של המבקש, ( רע "ב 7/86 וייל נ' מדינת ישראל

בית משפט קמא אכן לא נימק החלטתו, אך ברי מההחלטה כי בית המשפט אימץ את הנמקתה של המשיבה. בקשתו של המבקש הוגשה כמעט חמישה חודשים לאחר ההחלטה הראשונה, המידע בעניינו כבר אינו עדכני, ובקשתו לשחרור נדונה כבר פעם נוספת ונדחתה, בהחלטה מינהלית אחרת. בנסיבות אלה, נראה כי המבקש מיצה את מסלול העתירה הנוכחית, וככל שהוא מבקש כי עניינו יידון שוב, עליו להגיש עתירה חדשה, ולא במסגרת בקשה לעיון חוזר.

אשר על כן, הבקשה נדחית.
