בקשת רשות ערעור על החלטתו של בית המשפט לעניינים מנהליים מרכז בעת"א 55716-01-10 מיום 26.1.11 (כב' השופטת ו' מרוז ) , בגדרה נדחתה עתירת המבקש להתיר לו לצאת לחופשות ממאסרו.
רקע והליכים

המבקש מרצה עונש מאסר של 10 שנים בגין עבירות של תקיפת בת זוג ; הדחה בחקירה; תקיפת קטין ותקיפת קטין בידי אחראי; איומים וכן עבירות מין במשפחה, לרבות עבירות אינוס ומעשה מגונה.
פרטי המעשים קשים הם לכתיבה ולקריאה, ועל כן נספר בתמצית שבתמצית כי ביום 20.7.2007 הורשע המבקש, בין היתר, בכך שבמועדים שונים בין השנים 1999-2006 תקף המבקש את אשתו ואת בנותיו וגרם להן חבלות של ממש, קרע את בגדיהן של בנותיו מעליהן באמתלה שהם אינם צנועים, נגע בבנותיו במקומות מוצנעים בגופן מעל ומתחת לבגדיהן ובאחד מן המועדים אף החדיר אצבעותיו לאיבר מינה של אחת מבנותיו. המבקש איים על אשתו כי אם תתלונן ירצח אותה, וכי גם אם ייעצר ימצא דרך להשתחרר ולנקום בה.

בהתאם לפרק ו' לפקודת נציבות שירות בתי הסוהר 04.40.00 (להלן: הפקודה ), בשל עבירות המין בהן הורשע, לא יתיר שירות בתי הסוהר (להלן: שב"ס ) יציאתו של המבקש לחופשות אלא לאחר קבלת חוות דעת מאת המרכז לבריאות הנפש (להלן: מב"ן ) ומאת הועדה המחוזית לטיפול בגילוי עריות (להלן: וג"ע
או הועדה ). בהתאם, נבדק המבקש על ידי מב"ן ובחודש ספטמבר 2009 המליץ מב"ן לאפשר יציאת המבקש לחופשות של 6 שעות בתנאים מגבילים, בשל הערכה כי מסוכנותו המינית לטווח הקצר בליווי צמוד של ערב היא נמוכה. המלצה זו אוששה בחוות דעת דומה מיום 18.1.2011.
וג"ע קיימה מספר דיונים בעניינו של המבקש, כאשר אחד מהם (מיום 27.7.2010) התקיים בהרכב מורחב, אולם במועד הדיון בהרכב המורחב לא הובאו טיעוני המבקש בפני הועדה, בשל תקלה. בתום דיון זה נתנה וג"ע חוות דעת בה ציינה כי במהלך ארבע השנים בהן שהה המבקש בכלא לא עבר תהליך טיפולי או רגשי כלשהו והוא אינו מביע אמפתיה לקרבנות. המבקש אמנם שולב זמן קצר עובר להתכנסות הועדה בטיפול במחלקה לעברייני מין בבית הסוהר, אולם נכתב כי וג"ע טרם יכולה היתה במועד זה להתרשם מאפקטיביות הטיפול. על כן, ולאור הערכת וג"ע אודות המסוכנות שעודה נשקפת מהמבקש, לא הומלץ על ידי הועדה להוציאו
לחופשות בשלב זה.
על החלטה זו עתר המבקש ל בית המשפט לעניינים מנהליים מרכז (עת"א 55716-10-10), אשר בהוראתו התכנסה וג"ע בשנית ביום 11.1.2011, הפעם בהרכב חסר ובהשתתפות יו"ר הוועדה ונציג שירות שב"ס בלבד. וג"ע דנה בבקשתו של המבקש פעם נוספת, כאשר הפעם היו מונחים לפניה גם טיעוני המבקש וגם חוות דעת מעודכנת של מב"ן, מחודש ספטמבר 2010, שחזרה על ההמלצה הקודמת. גם בתום דיון זה לא המליצה וג"ע על הוצאתו של המבקש לחופשות בשל סיבות דומות לאלו שנזכרו בהמלצתה מיום 27.7.2010 ובהתאם לחומר החסוי שהוגש בעניינו של המבקש.
לסופו של יום, דחה בית המשפט לעניינים מנהליים את עתירת המבקש ופסק כי אין בפגמים הפרוצדורליים שנפלו בהליך, בהם אי-הבאת טיעוני המבקש בפני וג"ע בדיון מיום 27.7.2010 והתכנסותה בהרכב חסר בדיון מיום 11.1.2011, כדי לפסול את ההליך, שכן בבחינת כלל ההליך, נראה שהתקיימה התייעצות אמיתית בעניינו של המבקש. עוד פסק, כי לאור החומר הסודי שהובא לעיונו, החלטת וג"ע היתה סבירה וכי טרם בשלה העת לשלב את המבקש בסבב חופשות.
מכאן בקשת רשות הערעור שבפניי.

כטענה כללית ומקדמית טוען המבקש כי למרות שעל פי הפקודה הסמכות לאישור חופשותיו של אסיר נתונה בידי שב"ס, הרי שבפועל, שב"ס לא יאשר הוצאתו לחופשה של אסיר שהוגשה בעניינו חוות דעת שלילית של מב"ן או של וג"ע. נוכח גישה גורפת זו, הפעלת ביקורת שיפוטית על החלטות שב"ס היא רצוייה, וחורגת מעניינו הפרטי של המבקש.
המבקש שב וטוען כי העובדה שוג"ע התכנסה בהרכב חסר ביום 11.1.2011, בניגוד לנדרש בתקנון עבודה סוציאלית (להלן: תע"ס ) , מהווה פגם ממשי בהליך קבלת ההחלטות בעניינו ומהווה בעייה עקרונית וכללית, עליה אין לעבור לסדר היום, במיוחד לאור הליקויים הנוספים שהתגלו בהתכנסות וג"ע ביום 27.7.2010; כי על פי תע"ס, במקרה של חילוקי דעות בין מב"ן לבין וג"ע על וג"ע לנסות ולהזמין את נציג מב"ן להשתתף בדיוניה או ליצור עמו קשר במהלך הדיון, אך דרישה זו לא מולאה; כי לא סביר לדרוש כי המבקש יסיים את הטיפול במחלקה לעברייני מין בבית הסוהר, אשר אורכו כשנה וחצי, בטרם תוכל וג"ע לשקול בחיוב את אפשרות יציאתו לחופשה; כי וג"ע בחוות דעתה מצביעה על אלמנטים שונים, בהם מסוכנות וחוסר לקיחת אחריות, בניגוד גמור להתרשמות מב"ן; וכי למרות ההלכה שנקבעה ב רע"ב 7/86 וייל נ' מדינת ישראל (לא פורסם, 26.6.1986) (להלן: עניין וייל ) לפיה רשות ערעור ב"גלגול שלישי" תינתן רק במקרים בהם מתעוררת שאלה משפטית או שאלה ציבורית החורגת מעניינו הפרטי של המבקש, התגבשה מגמה בפסיקה לפיה היחס לעתירות אסיר יהיה שונה, בשל העובדה כי הן זוכות לעבור רק ערכאה שיפוטית אחת בזכות, ובשל החולשה המובנית מעצם היות העותר אסיר.

דין הבקשה להידחות.
גם אם אניח, אך ורק לצורך הדיון בלבד, כי יש לנהוג במבחן מרחיב יותר מהמבחן שנקבע בעניין וייל (כדעתו של השופט דנציגר ברע"ב 6956/09 יונס נ' שירות בתי הסוהר סעיף 35 לפסק דינו (לא פורסם, 7.10.2010)), לא מצאתי בבקשה הנוכחית עניין עקרוני המצדיק מתן רשות ערעור, על אחת כמה וכמה על פי המבחן המצמצם בהלכת וייל.
גם לגופו של עניין, לא מצאתי מקום להתערב בהחלטתו של בית משפט
קמא. הלכה היא כי חופשותיו של אסיר אינן זכות קנויה לו (ראו: רע"ב 7018/10 עמר נ' מדינת ישראל
(לא פורסם, 18.10.2010); רע"ב 5745/10 סאלח נ' שירות בתי הסוהר , סעיפים י' ו-י"ד לפסק דינו של השופט רובינשטיין (לא פורסם, 21.9.2010);
רע"ב 3249/09 מדינת ישראל נ' הרשטיק והאסמכתאות שם (לא פורסם, 30.6.2009); רע"ב 8571/07 מדינת ישראל נ' גמליאל והאסמכתאות שם (לא פורסם, 21.2.2008)). החלטה בעניין זה מסורה לשב"ס, המבסס את החלטתו, על פי הוראות הפקודה, על המלצות וג"ע ומב"ן. אין חולק על כך שהחלטות אלה נתונות לביקורת שיפוטית, ו בית המשפט קמא אף הורה בענייננו על התכנסות נוספת של וג"ע, על מנת להבטיח קיומו של הליך תקין בעניינו של המבקש. בנוסף, עיינתי בחלקים החסויים בחוות דעתה של וג"ע, ונחה דעתי כי לקחה בשיקוליה את התמונה הכוללת בהתייחס למבקש ולבני משפחתו.

בעניין השוני בין המלצות וג"ע ומב"ן דנתי לא מכבר ברע"ב 10475/09 פלוני נ' שירות בתי הסוהר
בסעיף 3 לפסק דיני (לא פורסם, 26.1.2010), שם ציינתי כי נקודת המוצא של כל אחד מן המוסדות היא שונה, כאשר מב"ן מתרכז בהערכת הסיכון הכללי הנשקף מן האסיר, בעוד וג"ע מתמקדת במידת הסיכון המשתקפת ממנו כלפי משפחתו בכלל וקרבן העבירה בפרט. בהתאם – בהחלט אפשרי שכל אחד ממוסדות אלו יגיע למסקנה שונה בהמלצתו אודות שחרור אסיר מסויים לחופשות (עוד על שאלת היחס בין המלצות מב"ן להמלצות וג"ע ראו בהרחבה בפסק דינה של כב' השופטת פרוקצ'יה ברע"ב 5713/09 פלוני נ' שירות בתי הסוהר (לא פורסם, 9.12.09)) .

לעניין הפגמים שנפלו בהתנהלות וג"ע, הרי שאלו נפרשו במלואם בפני בית המשפט לעניינים מנהליים. עם כל אלה, סבר בית המשפט כי אין בליקויים האמורים כדי לפגוע באופן ממשי בהליך קבלת ההחלטות בעניינו של המבקש, באשר התקיימה התייעצות אמיתית בעניינו של המבקש. הוראתו של בית משפט קמא לכנס את הוועדה בשנית מעידה על כך שנתן להתנהלותה את תשומת הלב והמשקל הראויים לה. לאור האמור, איני רואה מקום להתערב בהחלטתו הסבירה.
אשר על כן, אני דוחה את הבקשה.
