המבקש הועמד לדין ב בית המשפט לתעבורה באשקלון (ת 5282/08) בגין עבירה אי ציות להוראות שוטר במדים, לפי תקנה 23(א) לתקנות התעבורה, התשכ"א-1961 (להלן:
תקנות התעבורה ).
ביום 12.6.2008 ניתנה למבקש הזמנה לדין וכתב אישום לפיו הוא נהג ברכב ולא שעה להוראות שוטר במדים לעצור את רכבו. בשולי ההזמנה לדין נכתב כי עליו להתייצב ביום 25.11.2008 למשפטו. נוסף על כך, באירוע לעיל קיבל המבקש הודעת תשלום קנס בגין עבירה של נסיעה מעל המהירות המירבית המותרת, לפי תקנה 54(א) לתקנות התעבורה, אותה שילם כנדרש.
ביום 25.11.2008 הרשיע בית המשפט לתעבורה
(כבוד השופטת ד' קליימן ) את המבקש בעבירה שיוחסה לו בכתב האישום, וזאת בהעדרו. במעמד זה גזר בית המשפט לתעבורה על המבקש פסילת רישיון של ארבעה חודשים; פסילת רישיון על תנאי של ארבעה חודשים לתקופה של שלוש שנים; וקנס בסך 1,500 ש"ח.
ביום 3.12.2008 הגיש המבקש בעצמו בקשה לביטול פסק הדין לבית המשפט לתעבורה בטענה כי לא הופיע לדיון בעניינו משום שסבר שהוא פטור מלהופיע בבית המשפט, לאחר ששילם את הקנס שניתן לו בגין עבירת הנסיעה מעל המהירות המירבית המותרת שקיבל באותו מעמד. עוד טען כי כלל לא הבחין בשוטר אשר סימן לו לעצור ועל כן אין להרשיעו בגין עבירה זו.
ביום 4.12.2008 דחה בית המשפט לתעבורה את הבקשה. ביום 10.12.2008 הגיש המבקש בקשה לעיון חוזר בהחלטה שלא לבטל את פסק דינו. לעת הזו טען באמצעות בא כוחו כי נהלי המשטרה מכתיבים כי יש לתת לנהג העובר מספר עבירות תנועה דו"ח בודד, ואילו במקרה זה נתן השוטר למבקש שתי דו"חות נפרדים, ומכאן הבלבול שנוצר אצלו ואשר בגינו לא התייצב למשפטו.
ביום 11.12.2008 דחה בית המשפט לתעבורה את הבקשה משקבע כי המבקש לא העלה כל נימוק אשר מצדיק ביטול פסק דינו אשר ניתן בהיעדרו, לאחר שבהתנהגותו ויתר על יומו בבית המשפט, והעונש אשר הוטל עליו הולם את נסיבות המקרה.
על החלטה זו ערער המבקש לבית המשפט המחוזי בבאר-שבע (ע"פ 5636/08). ביום 9.2.2009 דחה בית המשפט המחוזי (כבוד הנשיא י' פלפל ) את הערעור, לאחר שקבע כי אף אם השוטר שרשם את דו"חות התנועה למבקש טעה משלא הגיש לו דו"ח אחד בלבד, אין הדבר מהווה עילה לכך שלא התייצב לדיון בעניינו. לאחר מתן פסק דינו אפשר בית המשפט המחוזי למבקש לטעון לעניין העונש אשר נגזר עליו. במעמד זה טען המבקש כי העונש אשר נגזר עליו מכביד בצורה בלתי סבירה. לאחר שנשמעו טיעוני הצדדים לעניין העונש, דחה בית המשפט המחוזי את ערעור המבקש גם לעניין זה, והורה למבקש להפקיד את רישיונו בבית המשפט עד ליום 15.2.2009.
מכאן בקשת רשות הערעור שבפניי, בגדרה טוען המבקש כי נפלה שגגה בפסק דינו של בית המשפט המחוזי. בסעיף 5 לפסק דינו של בית המשפט המחוזי נכתב כדלקמן:
"המערער לא התייצב בבית המשפט לדיון ועל כן בית המשפט קמא שפט אותו בהעדרו ודן אותו לתשלום של 1,500 ש"ח ול-4 חודשי פסילה על תנאי ל-3 שנים."
לטענת המבקש, עולה מכך שבית המשפט המחוזי פסק את דינו מבלי שהיה מודע לכך שבנוסף לעונש האמור לעיל, נפסל רישיונו לארבעה חודשים בפועל. לדידו, לולא נקלע בית המשפט המחוזי לכלל שגגה בעניין זה, ודאי היה מוצא מקום להתערב בגזר דינו. על כן מבקש הוא כי בית משפט זה יקבל את בקשתו, ויורה על ביטול יתרת רכיב פסילת רישיונו או לחילופין יעכב את ביצוע עונשו ויחזיר את הדיון בעניינו בפני מותב אחר בבית המשפט המחוזי.
מנגד טוענת המשיבה, כי בקשת רשות הערעור איננה מצדיקה דיון בפני ערכאה שלישית שכן אינה מעלה שאלה בעלת חשיבות משפטית כללית, החורגת מדלת אמותיו של תיק זה. לעניין הטענות גופא, המשיבה טוענת כי מפרוטוקול הדיון שנערך בבית המשפט המחוזי, ובמיוחד מטענות באת כוח המבקש לעניין חומרת עונשו באותו מעמד, עולה כי לבית המשפט המחוזי היה ברור כי על המבקש נגזרו ארבעה חודשי פסילת רישיון בפועל, והטעות אשר נפלה בפסק דינו הינה טכנית בלבד, ואין להתחשב בה.
לאחר שעיינתי בבקשה, בתגובה לה, בפסקי הדין ובהחלטות של הערכאות שקדמו לי, הגעתי למסקנה כי דין הבקשה להדחות.
עניינו של המבקש כבר נדון בפני שתי ערכאות שונות. ככלל, הלכה היא, כי רשות ערעור לדיון בגלגול שלישי, ניתנת במשורה באותם מקרים חריגים אשר מעוררים שאלה בעלת חשיבות כללית וציבורית החורגת מעניינם הפרטי של בעלי הדין. במקרה שבפניי, חרף טענות המבקש, הבקשה אינה מעוררת כל שאלה משפטית עקרונית, אשר תצדיק דיון בגלגול שלישי (ראו ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו (3) 123 (1982)).
יתרה מכן, הלכה היא כי טענות בנוגע לחומרת העונש כשלעצמה אינן מקימות עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 1174/97 רפאלי נ' מדינת ישראל
(לא פורסם, 24.3.1997); רע"פ 7201/97 בשירי נ' היועץ המשפטי לממשלה
(לא פורסם, 11.12.1997)). בנסיבות המקרה, לא מצאתי כל סטייה שכזו מנורמת הענישה המקובלת בעבירה אותן ביצע המבקש. מסיבות אלו בלבד, דין הבקשה להידחות.
מעבר לדרוש יוער, כי אף לגופו של עניין, דין הבקשה להדחות. מעיון בפרוטוקול הדיון נראה כי באת כוח המבקש הדגישה בפני בית המשפט המחוזי כי עונשו כולל רכיב של פסילת רישיון בפועל של ארבעה חודשים. ואכן, בית המשפט המחוזי היה מודע לכך, שכן בסוף פסק דינו מיום 9.2.2009 צווה המבקש להפקיד את רישיונו בבית המשפט. מכאן שלבית המשפט המחוזי היה ברור כי דחיית ערעור המבקש, משמעה כי רישיונו ייפסל בפועל, שאם לא כן, מה טעם ההוראה שיפקיד את רישיונו ב בית המשפט ? מכאן שהאמור לעיל בפסק דינו של בית המשפט
המחוזי הינו טעות טכנית גרידא, אשר אין לייחס לה חשיבות משברור כי בית המשפט פסק את דינו של המבקש כאשר כל העובדות הרלוונטיות מצויות בפניו.
אשר על כן בקשת רשות הערעור נדחית.
