ד' מרשק מרום ) בע"ח 26585-08-13 מיום 6.11.2013, בגדרה נדחה ערר של המבקש על החלטת בית משפט השלום ברמלה (השופט ז' ימיני ) בה"ת 60845-07-13 מיום 7.8.2013 שאישרה את החזקת התפוסים, שנתפסו בביתו של המבקש, על ידי המשטרה.
רקע והליכים

ברקע הדברים תלונה שהוגשה נגד המבקש שעניינה שימוש נטען של המבקש בפרטי המתלוננת לשם רכישת מכשירי טלפון ניידים. בעקבות התלונה בוצע חיפוש על פי צו בכתובתו הרשומה של המבקש, ונתפסו בה, בין היתר, ארבעה מכשירי טלפון ניידים. מלבד המבקש, גם אשתו (או גרושתו לפי גרסתו) ובנו נכחו בחיפוש.

אשתו ובנו של המבקש ביקשו להחזיר להם את הרכוש שנתפס על ידי המשטרה במסגרת החיפוש ביום 14.7.2013, וטענו כי חיפוש זה היה בלתי חוקי, מפני שהם הבהירו שהמבקש אינו מתגורר בכתובת זו, אינו נשוי עוד לאשתו, והם לא הרשו את ביצועו. לטענתם הרכוש שנתפס לא יכול לשמש ראיה במשפט פלילי ולכן ביקשו להשיבו. בית משפט השלום קבע כי החיפוש בוצע בכתובת שהייתה רשומה בצו. עוד קבע כי המבקש אף היה נוכח בבית בעת החיפוש ואף העיד כי הרכוש שנתפס שייך לו. בנוסף קבע בית משפט השלום כי אשתו של המבקש העידה שהם נשואים ולא גרושים. לפיכך קבע שהוכח קשר ישיר בין המבקש לתפוסים, והצו חוקי והוצא כדין, ודחה את הבקשה.

המבקש ערר לבית המשפט המחוזי מרכז-לוד על החלטה זו. בערר חזר המבקש על הטענות בבקשה להחזרת התפוסים, והוסיף כי דו"ח החיפוש שנערך היה מגמתי ופיקטיבי, וכי התלונה הוגשה כחלק מסכסוך עסקי שלו עם המתלוננת. המשיבה טענה מנגד כי המבקש לא היה בין המבקשים להשיב את התפוסים בבית משפט השלום, ולכן אין מקום לשמוע את עררו. עוד ציינה כי המבקש, אשתו ובנו לא טענו שאינו מתגורר בבית או לגבי הגירושין בעת החיפוש. עוד פירטה המשיבה כי למבקש היו גרסאות שונות באשר ליחסיו עם המתלוננת, ואין לתת משקל לטענותיו בעניין זה. בית המשפט המחוזי דן בערר לגופו. באשר לטענות המבקש לפגם בחיפוש נקבע כי לא חל פגם בחיפוש. עוד נקבע שהחקירה בעיצומה, ולמבקש גרסאות סותרות, ולעיתים לא מגיע לחקירות, ואלה מחייבים המשך בדיקה באשר לכל התפוסים, ולכן נקבע כי המשטרה ראשית להחזיק בתפוסים כפי שנקבע במסגרת החוק.
הבקשה והתגובה

בבקשה שלפניי, שהוכתרה כ"בקשת רשות ערעור" והוגשה ביום 6.2.2014 (לאחר שהרשם ג' שני התיר את הגשת ההליך באיחור בהחלטה בבש"פ 548/14 מיום 6.2.2014) , חזר המבקש על טענותיו והוסיף טענות חמורות כלפי המשטרה והתנהלותה בתיק זה שלטענתו התגלתה בדיון בבית המשפט המחוזי. עוד טען שעם תום 180 הימים המוקצבים למשטרה להחזקת תפוסים בסעיף 35 לפקודת מעצר וחיפוש, יש להחזיר לו את התפוסים. המשיבה בתגובתה ביקשה לדחות את הבקשה, אשר הלכה נוהגת לגביה שנדרש שתעורר שאלה מיוחדת, משפטית או אחרת. לגופה, טענה המשיבה שאין כל אינדיקציה לטענות החמורות של המבקש. באשר להחזקה בתפוסים מעבר ל-180 ימים, טענה המשיבה כי טענה זו מועלית לראשונה, ולא בוררה בערכאות דלמטה, ודינה להידחות גם לגופה.
הכרעה

דין הבקשה להידחות. מטרת הבקשה להביא לדיון בערכאה שלישית את שאלת החזקת התפוסים. רשות לכך, בדומה לרשות לערעור בגלגול שני, ניתנת רק במקרים חריגים,
המעלים שאלה משפטית בעלת חשיבות עקרונית או ציבורית, החורגת מעניינם הפרטני של הצדדים (רע"פ 2171/10 סקוטר סנטר בע"מ נ' מדינת ישראל – משרד התחבורה , פסקה 7 (7.9.2010); בש"פ 6951/13 הלוי נ' משטרת ישראל, מפלג ההונאה ת"א , פסקה 6 (10.12.2013)).

כל טענות המבקש הנוגעות לחיפוש, קשורות לעניינו הפרטני בלבד, ואין להן כל סימוכין בפרוטוקול או החלטת בית המשפט המחוזי. באשר לטענתו על חלוף 180 הימים הקבועים בסעיף 35 לפקודת מעצר וחיפוש, מדובר בשאלה אשר הוכרעה בבית משפט זה (בש"פ 4971/08 וייסמן נ' מדינת ישראל (28.10.2008) והאסמכתאות שם (להלן: עניין וייסמן ) ). המשיבה צודקת בטענתה כי דין טענה זו להיות מבוררת בערכאה הדיונית, במסגרת בקשה חדשה, דבר שמהנתונים לפניי לא קרה. בנוסף, ממילא כבר נקבע, שאין בעצם ההחזקה מעבר ל-180 יום כדי להורות על השבה מיידית של התפוסים (עניין וייסמן ) .

סוף דבר, הבקשה נדחית.
