העותר 1 שיתף פעולה עם ישראל בעבר, ולימים קיבל מעמד של תושב קבע. העותרת 2 היא רעייתו, ושאר העותרים הם ילדיהם המשותפים, חלקם בגירים וחלקם קטינים. העותרים הגישו בעבר כמה בקשות להסדרת מעמדם בישראל, הן על דרך של איחוד משפחות והן מפאת מאויימות, אולם בקשות אלה נדחו. בעקבות זאת, עתרו העותרים בשנת 2007 לבית משפט זה (בג"ץ 5029/07), ובפסק דין מיום 2.11.2009 נקבע בהסכמה כי בתוך 30 יום יגישו בקשה חדשה לקבלת מעמד בישראל. בקשה כאמור לא הוגשה על-ידי העותרים, אלא רק בחלוף למעלה משנתיים, בחודש דצמבר 2011.

משבוששה תשובת משרד הפנים לבוא, עתרו העותרים בשנית, ביום 26.7.2012 (בג"ץ 5762/12). בהחלטה מיום 14.8.2012 ניתן צו על-תנאי האוסר על המשיבים לנקוט בכל הליך להרחקת מי מהעותרים 2-10 מישראל, עד למתן החלטה אחרת. מטעמה של הוועדה ההומניטארית ניתנה המלצה שלילית, וביום 27.9.2012 דחה שר הפנים את בקשת העותרים לאיחוד משפחות, בהעדר טעם הומניטארי מיוחד ובשל מעורבותם של חלק מן העותרים בפלילים. ב פסק דין מיום 15.10.2012 דחה בית המשפט את העתירה בציינוֹ כי על העותרים להגיש בקשה לוועדת המאויימים, אשר תקבע את התשתית העובדתית לעניין קיומה של מאויימות, קביעה אשר עשויה להיות רלוונטית "כאחד השיקולים בהקשר ההומניטארי, אם תהא פניה נוספת לוועדה ההומניטארית" . בית המשפט ציין כי אין בכך כדי לגרוע מסמכותה של הוועדה לשקול גם מעורבות בפלילים, "כשיקול שאינו לחיוב" . לגבי העותרת 2 וילדיה הקטינים נאמר כי הם רשאים להגיש בקשה לאיחוד משפחות על-ידי העותר 1 (ואף העותרת 3 יכולה לעשות כן על-ידי בעלה) ונושא המאויימות יוכל להישקל גם בהקשר זה. בית המשפט החליט להשאיר את צו הביניים (מיום 14.8.2012) בתוקף עד להחלטת ועדת המאויימים, וזאת בכפוף לכך שהבקשות יוגשו אליה תוך 30 יום מיום מתן פסק הדין.

בעתירתם טוענים העותרים כי בהתאם לפסק הדין האמור, "פנו מספר פעמים לועדת המאויימים ולא קיבלו כל מענה וזאת על אף שעצם קבלת הפניות אושר על-ידי נציגי ועדת המאויימים בשיחות טלפוניות" . מנגד טוענים המשיבים כי דין העתירה להידחות על הסף בהיותה מוקדמת. לטענת המשיבים, בירור שנערך עם מזכירות ועדת המאויימים מעלה כי פניות העותרים לוועדה כלל לא נתקבלו, וממילא טרם נדונו. אף-על-פי-כן, ועל מנת לייתר כל מחלוקת בעניין זה, הועברו פניות העותרים – אשר צורפו כנספחים לעתירה – אל הוועדה, והדיון בעניינם עתיד להתקיים במהלך חצי השנה הקרובה. בנסיבות אלה, בהן ועדת המאויימים טרם דנה בעניינם של העותרים, סבורים המשיבים כי העתירה מוקדמת, ומשכך דינה להידחות על הסף. המשיבים תמהים על העותרים ומצֵרים על התנהלותם, בכך שכלל לא פנו להגיש בקשה רגילה לאיחוד משפחות, בהתאם לחוק האזרחות והכניסה לישראל (הוראת שעה), התשס"ג-2003 (להלן: חוק הוראת השעה ). להשתהוּת שכזו נודעת השפעה על תחולת בקשה מסוג זה ביחס לילדיהם הקטינים של העותרים (סעיף 3א לחוק הוראת השעה).

אכן, דין העתירה להידחות על הסף. בקשתם של העותרים טרם נדונה על-ידי ועדת המאויימים, ולפיכך עדיין לא ניתנה החלטה. כאמור, כפי שמסרו המשיבים בתגובתם, עתידה הבקשה לעלות לדיון בתקופה הקרובה. הלכה ידועה היא כי בנסיבות בהן הגורם המנהלי המוסמך טרם דן בעניינו של העותר, הרי שעתירתו היא מוקדמת, ובית משפט זה לא יזקק לה ולא ידון בה קודם שתתקבל החלטה סופית על-ידי הגורמים המוסמכים (ראו ע"א 524/98 מדינת ישראל נ' ציון חברה לביטוח , פ"ד נב(2) 145, 152 (1998 ) והשוו: בג"ץ 6246/11 קטאווי נ' מדינת ישראל
(11.10.2011); בג"ץ 1118/12 פלוני נ' מדינת ישראל (20.06.2012)). זכויותיהם של העותרים שמורות להם, ככל שתהא להם עילה לתקוף את החלטת ועדת המאויימים, לכשתינתן. כמוסכם, אף אם לפנים משורת הדין, יוותר צו הביניים הנ"ל על כנו עד לחלוף 30 יום מיום מתן החלטת ועדת המאויימים בעניינם של העותרים. בכפוף לכך, העתירה נדחית.
