ערעור על החלטת הרשם ג' לובינסקי מיום 2.6.2015 בע"א 3801/15, במסגרתה דחה הרשם את בקשת המערער לפטור מתשלום האגרה ומהפקדת העירבון. הרשם קבע כי הערעור שהוגש אינו מגלה עילה להתערבות, ודי בכך על מנת לדחות את בקשת הפטור. למעלה מן הצורך הוסיף הרשם, כי בתצהיר שצורף לבקשה ציין המערער שיש בבעלותו נכס מקרקעין, וזאת מבלי לספק פירוט כלשהו לגביו. כמו כן ציין הרשם, כי המערער לא הרים את הנטל להוכיח יכולת להסתייע בסביבתו. עם זאת קבע הרשם, כי העירבון יועמד על סכום מתון יחסית בסך של 5,000 ש"ח.

מכאן הערעור שלפניי, במסגרתו מפרט המערער ארוכות על התפתחויות היסטוריות הנוגעות לסוגיה בתיק העיקרי, אשר נוגעת לפטנטים לכאורה שהוא המציא. בקצרה טוען המערער, כי הוצאותיו עולות על הכנסותיו, ולכן הוא לא יכול לקחת הלוואה. כן הוא טוען, כי משפחתו לא מעוניינת לסייע לו.

דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשם. כידוע, שיקול דעתו של הרשם רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012); בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013)) .

הלכה היא כי פטור מתשלום אגרה יינתן רק לאחר שבעל הדין המבקש את הפטור הוכיח כי הוא עומד בתנאים אשר הותוו בדין (ראו תקנה 14 לתקנות בתי המשפט (אגרות), התשס"ז-2007), והם חוסר יכולת כלכלית וכי נראה לבית המשפט שההליך מגלה עילה.
אשר לחיוב בעירבון, הלכה היא כי בבקשה לפטור מעירבון נדרש להוכיח כי סיכויי ההליך בעלי ממשות גדולה יותר מאשר בבקשה לפטור מאגרה (ראו: בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי (17.10.2007)). סבורני כי ההליך לא מגלה עילה במידה שתצדיק פטור מתשלום אגרה, וקל וחומר שלא התקיים התנאי הנדרש לצורך קבלת בקשה לפטור מעירבון.

במקרה שלפניי, המערער מיקד את ערעורו בסוגיה העיקרית והקדיש אך שורות קצרות למצבו הכלכלי, מבלי להציג תשתית עובדתית חדשה בעניין מצבו. המערער התעלם מהערתו של הרשם לעניין נכס המקרקעין שבבעלותו – ושאלה זו עדיין מעלה ספקות בדבר קשייו הכלכליים. כמו כן, המערער לא גיבה באסמכתא כלשהי את הטענה שמשפחתו אינה מעוניינת לסייע לו. יצוין, כי קושי זה הועלה לא מזמן עוד בבשג"ץ 4088/15 ליאור נ' היועץ המשפטי לממשלה (17.6.2015), וניכר כי המערער לא מפנים את הערותיו החוזרות של הרשם, אף כי יש בהן כדי להכווינו.

אשר על כן, הערעור נדחה. המערער ישלם את האגרה ויפקיד את העירבון בסכום שנקבע בהחלטתו של הרשם מיום 2.6.2015 בתוך 14 ימים מיום המצאת פסק דין זה לידיו. לא יעשה כן, יימחק ההליך או יירשם לדחייה, לפי העניין, ללא כל הודעה נוספת.
