בקשה להארכת מועד
החלטה
בהמשך להחלטתי מיום 10.12.2013 הגישו המבקשים בקשה נוספת למתן ארכה, וזאת עד ליום 1.4.2014, בהדגישם כי עד עתה לא ניתנה ההחלטה בעניין ההוצאות.
המשיבים 1, 4 ו-5, אליהם הצטרפו המשיבים 2, 3 ו-6, הודיעו כי אין מקום ליתן ארכה "לכלל התובעים" שכן מדובר בבקשה ערטילאית ויש להבהיר בשם מי היא מבוקשת. כן ציינו הם כי בכפוף לכך יסכימו למתן ארכה מטעמים קולגיאליים. בא-כוח הצדדים השלישים הודיע כי הם מתנגדים למתן הארכה, בין היתר מאותו הטעם.
הגם שניתן להבין את עמדת בא-כוח המבקשים לפיה חלק מן התובעים בהליך לא גיבשו עמדה בשאלה האם יוגש על ידם ערעור בשל העובדה שלהכרעה בשאלת ההוצאות תהא השלכה על החלטתם, אין בכך כדי להצדיק שלא יהא ברור בשם מי מוגשת בקשת הארכה - אשר תכליתה היא להאריך את המועד על מנת שכל אותם תובעים המעוניינים בכך יוכלו לשקול את עניינם לאחר שתינתן ההחלטה המשלימה בסוגית ההוצאות, ומובן כי אין בכך כל התחייבות להגשת ההליך בסופו של יום בפועל. עוד יצוין כי הטענה בדבר קשיי תקשורת וקשיי התארגנות נחלשה מעוצמתה נוכח הזמן הרב אשר חלף למן מועד מתן פסק הדין ודומה כי בשלב זה ראוי היה כי בא-כוח המבקשים יגבש רשימה מסודרת של תובעים המבקשים להימנות עם המבקשים בבקשת הארכה. מכל מקום הצדק עם המשיבים כי יש לציין באופן ברור בשם מי מוגשת הבקשה, אשר אשוב ואציין כי כל שנועדה היא לאפשר למי מהתובעים אשר יבקש זאת, להשיג על פסק הדין כולו לאחר שסוגיית ההוצאות תוכרע.
המבקשים יגישו אפוא השלמה לבקשתם, בו יובהר בשם מי הוגשה, וזאת בתוך שבעה ימים ממועד המצאת ההחלטה.
