בקשה להארכת מועד
החלטה
לפניי בקשה להארכת מועד להגשת בקשת רשות ערעור על פסק-דין של בית המשפט המחוזי בירושלים (מיום 14.10.2010), שבו נתקבל ערעור המשיבה על פסק-דין של בית משפט השלום בירושלים שדחה את ערעור המשיבה על החלטת ועדת הזכאות לפי חוק יישום תכנית ההתנתקות, התשס"ה-2005. הבקשה להארכת מועד נסמכת על טענות בדבר עומס עבודה ובדבר היקפו של התיק ומורכבותו, ועל העובדה שהבקשה מוגשת בתוך המועד להגשת בקשת רשות ערעור. הארכה המבוקשת היא עד לתאריך 26.12.2010. המשיבה מתנגדת לבקשה ומציינת בין היתר את הזמן הרב שחלף מאז שהחלה ההתדיינות בעניין זכותה לקבלת פיצוי בגין זכויות במקרקעין.
אין בידי להיעתר לבקשה במלואה.
אמת, הודעתו של בעל דין לצד שכנגד על כוונתו להגיש ערעור, או הגשת בקשה להארכת מועד בתוך פרק הזמן שנקצב בדין להגשת הערעור, עשויים להצדיק מתן הארכת מועד וזאת משום שיש בהם כדי לשלול התגבשות של ציפייה לסופיות ההליכים. אולם לא מדובר ב"נוסחת קסם" המובילה מניה וביה להארכת מועד, ובפרט כשמדובר בהארכת מועד לתקופה לא קצרה. אכן, הכלל הוא שיש להגיש את הערעור (או את בקשת רשות הערעור) בתוך המועד הקבוע בדין, ואם נוצר צורך אמיתי בהארכת מועד, ניתן לבקש זאת מבית המשפט כשלעניין זה פנייה בתוך המועד היא שיקול רלבנטי וחשוב.
בענייננו, הטענות שהועלו בדבר עומס עבודה ובדבר היקף החומר ומורכבות הסוגיות הן טענות כלליות, והתקשיתי למצוא בהן נימוק מספק מדוע נוצר אילוץ של ממש המונע הגשת הליך ערעורי בתוך המועד הקבוע בדין. כך במיוחד לאור העובדה שההליך בבית משפט זה הוא "גלגול רביעי" של ההתדיינות, ומשעל פני הדברים לא נראה כי מדובר במקרה המעורר שאלות יוצאות-דופן מבחינת מורכבותן העובדתית או המשפטית.
לאחר שבחנתי את טענות הצדדים לכאן ולכאן, ובהתחשב במועד הגשת הבקשה ובאיזון האינטרסים של הצדדים, החלטתי להאריך את המועד להגשת ההליך עד ליום 5.12.2010. המבקשת תצרף החלטתי-זו לבקשת רשות הערעור, והמזכירות תתייק את ההחלטה בתיק בית המשפט. למותר לציין כי המשיבה תהא רשאית להעלות טענותיה בעניין עצם האפשרות להשיג על החלטת בית המשפט המחוזי, בבוא העת לכך. בנסיבות, אין צו להוצאות.
