לפניי ערעור על החלטת הרשם ג' שני מיום 5.12.2013, במסגרתה דחה את בקשת המערערת לפריסת העירבון לשלושה תשלומים, במסגרת הליך רע"א 6548/13. בהחלטתו, ציין הרשם כי מדובר בבקשה רביעית מטעם המערערת לעניין העירבון, וכמו קודמותיה מטרתה למעשה להשיג ארכה ממושכת עד הפקדת העירבון. הרשם קבע כי אין בסיס ליתן ארכה ממושכת זו לאור נסיבות העניין.

בבקשתה הראשונה ביקשה המערערת פטור מהפקדת העירבון. בקשתה נדחתה מפני שלא הוכיחה היעדר מסוגלות כלכלית, אך הוחלט להפחית את סכום העירבון שנדרשה להפקיד, ולהעמידו על סך של 15,000 ש"ח (בהחלטה מיום 30.10.2013). על החלטה זו לא הוגש ערעור. עם זאת, המערערת פנתה בשנית בבקשה לחלופת עירבון. משנדחתה גם בקשתה זו (בהחלטה מיום 13.11.2013), פנתה בפעם השלישית, בבקשה לפרוס את העירבון לעשרה תשלומים. גם בקשה זו נדחתה (בהחלטה מיום 25.11.2013). בכל בקשותיה טענה המערערת כי יש לה קושי כלכלי להפקיד את העירבון. כידוע, במסגרת בקשה לפטור מהפקדת עירבון, על המבקש הנטל להוכיח שני תנאים מצטברים: היעדר מסוגלות כלכלית וסיכויי ההצלחה בערעור (ראו: בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי , פסקה 7 (17.10.2007)). כאמור, הרשם קבע בהחלטתו מיום 30.10.2013, כי המערערת לא הוכיחה היעדר מסוגלות כלכלית, אך לאור הנסיבות מצא להפחית מסכום העירבון שנקבע לה.

במסגרת הערעור שלפניי טוענת המערערת כי הרשם חסם את דרכה לערעור, והוא דוחה את בקשותיה באופן סדרתי ולא מבוקר. לטענתה, מצבה הכלכלי הקשה לא מאפשר לה את הפקדת סכום העירבון, ועל כן היא מבקשת את פריסתו, זאת לאחר שפנתה לקרוביה ומכריה. עוד טוענת המערערת כי סיכויי ההליך העיקרי טובים הם.

דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשם. כידוע, שיקול דעתו של הרשם רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013); בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012)) .

בענייננו, כאמור, לא מצא הרשם, לאור המסמכים שהוגשו לו, כי המערערת נעדרת מסוגלות כלכלית. לאחר עיון במסמכים שהגישה המערערת ובבקשת רשות הערעור, מצאתי כי החלטת הרשם שלא לאשר למערערת את פריסת התשלומים, נוכח הפחתת סכום העירבון בהחלטתו הקודמת, מאזנת נכונה בין השיקולים השונים.

סוף דבר, הערעור נדחה. ממילא מתייתרת ההכרעה בבקשה להארכת מועד תשלום האגרה והפקדת העירבון שהוגשה ביום 29.12.2013. המערערת תשלם את האגרה ותפקיד את העירבון, עד ליום 26.1.2014. לא תעשה כן, יירשם ההליך לדחייה ללא כל הודעה נוספת. אין צו להוצאות.
