בקשה להארכת מועד
החלטה
לפניי בקשה להארכת מועד להגשת בקשה לדיון נוסף בפסק-דין של בית המשפט העליון בבג"ץ 970/12. בפסק-הדין, שניתן ביום 8.7.2012, נדחתה עתירתו של המבקש להורות למשיבים לפתוח בהליך פלילי או חקירתי בעניינה של המשיבה 3, או להבהיר את הנורמות בנוגע להתנהלותו של עובד ציבור מול גוף שבו הוא מתעתד לעבוד.
המבקש, באמצעות בא-כוחו, טוען כי עוד ביום 15.7.2012 הגיש "בקשה למתן החלטה בעניין 'דיון נוסף'", שבה ביקש להבהיר כי ימי הפגרה אינם באים במניין הימים להגשת בקשה לדיון נוסף. לדברי המבקש, לא ניתנה החלטה בבקשה זו, הגם שנאמר לו על-ידי מאן דהוא במרכז המידע כי הבקשה ממתינה להחלטה, ורק ביום 4.9.2012 מסרה לו המזכירות כי הבקשה פגומה וכי עליו להגיש בקשה להארכת מועד בצירוף תגובת המשיבים. כך פעל המבקש. עוד טוען המבקש כי לפי היגיון הדברים, הבקשה מיום 15.7.2012 עצרה את מניין הימים. לדעת המבקש, בפסק-הדין נפלה שגגה המצדיקה קיום דיון נוסף.
אציין כי המשיבים 2-1 הותירו את הבקשה לשיקול דעת בית המשפט, ואילו המשיבה 3 מתנגדת למתן הארכה.
לאחר עיון בבקשה באתי לכלל מסקנה כי דינה להידחות.
לפי תקנה 4 ל תקנות סדר הדין בדיון נוסף , התשמ"ד-1984, המועד להגשת בקשה לדיון נוסף על פסק-דין של בית המשפט העליון הוא תוך 15 ימים מיום מתן פסק-הדין (ולא מיום המצאתו). "פרק הזמן הקצר" – כך נפסק – "כמו גם מנייתו החל מיום מתן פסק הדין, ולא מיום המצאתו, נובעים מייחודו של הליך הדיון הנוסף, אשר סוטה מהרעיון של סופיות הדיון עם מתן פסק הדין בערעור, ויוצר נדבך שיפוטי נוסף" (בש"א 7155/06 יונה נ' עו"ד יניב אינסל (לא פורסם, 3.10.2006)).
המבקש טוען, כאמור, כי פנה עוד ביום 15.7.2012 לבית המשפט בבקשה להבהיר כי ימי הפגרה אינם באים במניין הימים. אולם טיבה של בקשה זו אינו ברור. ככל שהמבקש התכוון לכך שבית המשפט יבהיר לו את הדין החל, הרי ברור כי בית המשפט אינו מספק לבעלי-דין ייעוץ משפטי. ודוק: הבקשה מיום 15.7.2012, כמו הבקשה הנוכחית, הוגשה על-ידי המבקש באמצעות עורך-דין .
מכל מקום, הכלל הוא כי ימי הפגרה באים במניין הימים לעניין המועד להגשת בקשה לדיון נוסף (ראו בש"א 6927/11 רוכמן נ' קיבוץ מענית (טרם פורסם, 24.1.2012)), וגם הגישה הדווקנית ביישום הדרישה לקיום "טעם מיוחד" בכגון דא, ידועה ומושרשת. על כן, הדרך הראויה הייתה להגיש את הבקשה לדיון נוסף בתוך המועד הקבוע בדין, או למצער – אם קיים טעם מיוחד וכבד משקל – להגיש בקשה להארכת מועד, מנומקת כדבעי וערוכה בהתאם לדין ולהנחיות. המבקש לא הגיש בקשה כזו, כאמור, וגם היום אין הסבר ממשי לאי-הגשת בקשה לדיון נוסף במועד (אדרבא, המבקש עצמו מציין כי יכול היה להגיש את ההליך בתוך התקופה הקצובה בדין).
יובהר, כי לא נעלמה מעיני טענתו של המבקש כי מדור המידע מסר לו שהבקשה מיום 15.7.2012 מצויה בטיפול. אולם, אין בכך בלבד כדי להסביר את אופן הפעולה שהמבקש בחר בו מלכתחילה, בפרט, כאמור, כשמדובר בבעל-דין מיוצג.
מצויים אנו היום למעלה מחודשיים לאחר מתן פסק-הדין. נתון זה יש לו משקל רב בהינתן שמדובר בבקשת ארכה להגשת בקשה לדיון נוסף, על כל המשתמע מכך מבחינת חשיבותו של עקרון סופיות הדיון. זאת ועוד, עיון בפסק-הדין של בית המשפט העליון, שניתן פה-אחד, מלמד כי על פני הדברים הסיכוי למתן דיון נוסף במקרה זה אינו גבוה, זאת בהינתן חריגותו ונדירותו של הליך זה, ובשים לב לתנאים הקבועים בדין לקיום הליך של דיון נוסף (סעיף 30(ב) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984).
אשר על כן, הבקשה נדחית. אין צו להוצאות.
