לפניי הליך בו עותר היועץ המשפטי לממשלה להורות על דיון נוסף בפסק דינו של בית המשפט העליון מיום 27.1.2014 בע"פ 1548/13 (להלן – פסק הדין ). העתירה דנא מחזיקה עמוד אחד בלבד (כמו כן צורף לה כנספח העתק של פסק הדין). כל שנטען על ידי היועץ המשפטי לממשלה, הוא שבפסק הדין נקבעו הלכות חדשות בעלות השלכות רוחב בנושאים שונים המוסדרים, בין היתר, בחוק לנשיאת עונש מאסר במדינת אזרחותו של האסיר, התשנ"ז-1996, הא ותו לא, ובלא כל נימוק נוסף. חובה לציין, כי בשולי העתירה נטען, כי "עקב סד הזמנים להגשת העתירה, היקף הסוגיות ומורכבותן, מוגשת עתירה זו כעת בלא נימוקים". היועץ המשפטי לממשלה עתר לאפשר לו להגיש את הנימוקים לעתירה תוך 30 ימים מעת הגשת העתירה.

העובדה שהעתירה אינה כוללת כל נימוק מהותי, לצד הבקשה למתן אורכה להגשת הנימוקים, מעוררת תמיהה מסוימת, בהתחשב בכך שההליך דנא הוכתר על ידי היועץ המשפטי לממשלה כ"עתירה לקיום דיון נוסף". תקנה 5 לתקנות סדר הדין בדיון נוסף, התשמ"ד-1984, מורה כי:
"המבקש יפרש בעתירה את הטענות בדבר היותה של ההלכה שנפסקה עומדת בסתירה להלכה קודמת או בדבר חשיבותה, קשיותה או חידושה של הלכה שנפסקה בענין, כל טענה לחוד, ויציין את האסמכתאות שעליהן הוא מבסס את טענותיו".
היועץ המשפטי לממשלה לא ניסה כלל למלא אחר הוראות תקנה 5 הנ"ל. משכך, ובהתחשב בבקשת האורכה שנכללה בעתירה, הרי אין לומר כי ההליך שלפניי הינו עתירה לדיון נוסף. מדובר, לכל היותר, בבקשה למתן אורכה להגשת עתירה לדיון נוסף.

לפיכך, המזכירות תשנה את סיווגו של ההליך דנא לבקשה למתן אורכה להגשת עתירה לדיון נוסף. בקשת האורכה תטופל על ידי אחד הרשמים של בית משפט זה. העותר רשאי להשלים את הבקשה ובלבד שייעשה כן עד ליום 23.3.2014. אין לראות בדבריי משום הבעת עמדה כלשהי בנוגע לסיכוייה של בקשת האורכה (הנתונה לשיקול דעת מלא של הרשם או הרשמת), או בעניין פסק הדין שלגביו הוגש ההליך.
