החלטה

העורר שימש כראש עיריית קלנסווה, ויוסף מרעי שימש כיועצו (להלן: יוסף). איאד מרעי (להלן: איאד) שימש כחבר מועצת העיר, ובינו לעורר התגלעו מחלוקות שונות. באותה עת התקיימה בין העורר לאחת – אימאן מחאמיד, מה שהוגדר כ"מערכת יחסים קרובה", ועל פי גרסת המשיבה החליט העורר להשתמש באימאן כדי לצלם את איאד במצבים אינטימיים, ובדרך זו לסחוט אותו בעתיד. ואכן, במפגש שהתקיים בזיכרון יעקב חיבקה אימאן את איאד, ואדם אותו שכר יוסף צילם זאת. תמונות אלו הציג יוסף לאיאד, ודרש ממנו להתחייב לתמוך בעמדת העורר בהצבעות במועצת העירייה. עוד נטען, כי העורר שהגיע למקום המפגש, צעק על איאד וסטר על פניו. במפגש נוסף שהתקיים ביום 15.5.11, שב העורר ואיים על איאד כי יפגע בו אם "ילכלך" עליו. באישום זה (האישום הראשון) יוחסו לעורר עבירות של קשירת קשר לבצע פשע, סחיטה באיומים ואיומים. באישום נוסף נטען, כי קבלן בניין ביצע עבודות עבור עיריית קלנסווה ואת תשלום שכרו בסך 750,000 ש"ח התנה העורר בכך שהקבלן ישלם לו 10,000 דולר, ולבסוף הוסכם על מחצית הסכום. באישום זה יוחסה לעורר עבירה של לקיחת שוחד. באישום שלישי נטען, כי המערער התקין בביתו מערכת מיגון בעלות של כ-67,000 ש"ח, ובהמשך פעל במרמה כדי לחייב את הרשות המקומית לשאת בהוצאה. באישום זה יוחסה לעורר עבירת מרמה והפרת אמונים.

עם הגשתו של כתב האישום עתרה המשיבה למעצרו של העורר עד תום ההליכים. היא טענה כי בידיה ראיות לכאורה להוכחת האישומים, וכי קמה עילת מעצר נוכח החשש כי העורר יסכן את בטחון הציבור, סכנה הנלמדת מהתנהלותו באישום הראשון. עוד נטען, כי שחרורו של העורר ממעצר בו הוא נתון, עלול להרתיע עדים ממסירת עדות בבית המשפט. בית המשפט המחוזי נעתר לבקשת המשיבה, וכנגד החלטה זו מופנה הערר שבפני. נטען, כי העורר, עו"ד במקצועו, נבחר לכהונתו כראש עיר בשנת 2008, וגם אם יוכח כי חטא, אין חשש כי ישבש מהלכי משפט או ישפיע על עדים, וככל שיעשה זאת יהיה ניתן להגיש את הודעות העדים מכח סעיף 10א' לפקודת הראיות. כן נטען, כי לפני ימים אחדים העביר העורר לממונה על המחוז במשרד הפנים בקשה לאצול את סמכויותיו לסגנו, כולל זכות החתימה בשם הרשות, ועל כן ניטלה ממנו יכולת ההשפעה על הנעשה בעירייה.
מנגד, הצביע בא-כוח המשיבה על כך שרבים מן העדים הם עובדי עירייה, ואלה חששו לשתף פעולה עם המשטרה, וככל שהעורר ישוחרר הם אף עלולים שלא להתייצב למסירת עדות בבית המשפט.

נקודת המוצא לדיון היא כי בידי המשיבה ראיות לכאורה להוכחתו של כתב-האישום. עניין זה לא היה שנוי במחלוקת בעת הדיון בפני בית המשפט המחוזי, ולפיכך מותר להוסיף ולקבוע שככל שבית המשפט יחליט בסופו של יום ליתן אמון באותן ראיות, כי אז תתחייב המסקנה כי עניין לנו עם עורר שבעת כהונתו בתפקידו הרם, ביצע מעשי שחיתות שעל חומרתן נדמה כי אין צורך להכביר מלים. אולם גם זאת ראוי להדגיש, כי אין בחומרתן של העבירות לבדה כדי לקבוע כי התרופה למסוכנותו של העורר היא במעצר בלבד, ועל בית המשפט להשתכנע כי לא ניתן להשיג את מטרת המעצר בדרך של שחרור בערובה ותנאי שחרור, שפגיעתם בחירותו של הנאשם, פחותה (סעיף 21(ב)(1) לחוק סדר הדין הפלילי [סמכויות אכיפה – מעצרים, התשנ"ו-1996]). אכן, נוכח אופיים של האישומים יש להבטיח כי העורר לא יוכל ליצור קשר עם עדים כדי לשבש את מהלכי המשפט. מכאן גם ברור ששחרורו כדי שישהה בקלנסווה או בסביבתה, תוך שהוא יכול לצאת ולבוא בשערי העירייה ולהשפיע על עדים, היא אפשרות שיש לפסול אותה על הסף. עם זאת, סבורני כי יש לאפשר לעורר להציע חלופה אחרת שתענה על אלה: תהיה מרוחקת לפחות 60 ק"מ מקלנסווה, והעורר ישהה בה במעצר בית מלא מלווה באיזוק אלקטרוני, ובהשגחתם של מפקחים שיימצאו ראויים. סבורני כי חלופה זו אליה יתלווה איסור על העורר להיכנס לעיר קלנסווה וליצור קשר ישיר או עקיף עם עדי תביעה, יהיה בה כדי לאיין במידה ניכרת את מסוכנותו, וממילא לייתר את הצורך להשתמש באקט הקיצוני של מעצר.
לפיכך, אני מקבל את הערר במובן זה שהעורר יוכל לשוב ולהציע חלופת מעצר אחרת, ברוח החלטתי. ככל שיעשה זאת, יבחן בית המשפט המחוזי אם מדובר בחלופה ראויה, ואם ישיב על כך בחיוב, יוסיף ויקבע את תנאי השחרור.
