החלטה
ערר על החלטת בית המשפט המחוזי מרכז (כב' השופטת מ' ברנט) במסגרת בקשה לעיון חוזר בתנאי מעצר הבית שהוטלו על העורר.

כנגד העורר, ראש עיריית קלנסווה במועד האירועים, הוגש כתב אישום המייחס לו, במסגרת שלושה אישומים, עבירות של קשירת קשר לפשע, סחיטה באיומים, איומים, תקיפת עובד ציבור, לקיחת שוחד ומרמה והפרת אמונים. על פי הנטען באישום הראשון, על רקע סכסוך של העורר עם חבר מועצת עיריית קלנסווה החליט העורר לצלם את חבר המועצה עם אישה המקורבת לעורר ולסחוט אותו באמצעות התמונות. אותה אישה טלפנה לחבר המועצה, הציגה עצמה כעיתונאית וקבעה להיפגש עימו. העורר פנה לנאשם השני בכתב האישום שידאג לצלם את השניים מתחבקים בפגישה. בשליחותו של העורר נפגש הנאשם הנוסף עם חבר המועצה, הציג לו את התמונות ואמר לו כי אם לא יצביע במועצת העיר לפי עמדתו של העורר ישלחו את התמונות לאשתו. חבר המועצה התחייב לכך ואף חזר על התחייבותו בפני העורר שהגיע אף הוא לפגישה ואף סטר על פניו של חבר המועצה. במפגש נוסף שב ואיים העורר על חבר המועצה. על פי הנטען באישום השני דרש העורר מקבלן בנייה, לו היתה חייבת העירייה כסף עבור עבודתו, כי ישלם לו סכום של 10,000$ בתמורה לאישורו הנדרש להעברת הכסף מהעירייה. הקבלן הסכים לשלם לעורר 5,000$. על פי הנטען באישום השלישי הזמין העורר התקנת מערכת מיגון בביתו. לאחר ההתקנה ביצע העורר הליך כוזב בעיריה לאישור מימון המערכת בביתו, במסגרתו הציג את הצעת המחיר של החברה שהתקינה כבר את המערכת בביתו והצעה נוספת מתחרה לכאורה.

המדינה הגישה בקשה למעצרו של העורר עד לתום ההליכים נגדו. בית המשפט המחוזי נעתר לבקשה. בהחלטה בערר שהוגש לבית משפט זה (כב' השופט לוי) צוין כי אין מחלוקת בדבר קיומן של ראיות לכאורה כנגד העורר. בית המשפט קבע כי יש לבחון אפשרות להשגת מטרת המעצר בדרך של שחרור בערובה ותנאי שחרור. צוין כי נוכח אופיים של האישומים יש להבטיח כי העורר לא יוכל ליצור קשר עם עדים כדי לשבש מהלכי משפט. לפיכך
ניתנה לעורר אפשרות להציע חלופת מעצר שתהיה מרוחקת לפחות 60 ק"מ מקלנסווה, במעצר בית מלא מלווה באיזוק אלקטרוני ובהשגחתם של מפקחים שיימצאו ראויים. חלופה כזו בנוסף על איסור על העורר להיכנס לקלנסווה וליצור קשר ישיר או עקיף עם עדי התביעה יהיה בה, כך נקבע, כדי לאיין במידה ניכרת את מסוכנותו של העורר.

בעקבות החלטת בית המשפט העליון הורה בית המשפט המחוזי ביום 18.8.11 על שחרורו של העורר לחלופה שהוצעה על ידו למעצר בית בעיר נצרת בפיקוחם של ארבעה ערבים. בית המשפט הורה אף על הפקדה, התחייבות עצמית וערבות צד ג' ועיכוב יציאה מן הארץ. כן הורה בית המשפט על איזוק אלקטרוני. העורר הגיש בקשה לעיון חוזר בתנאי שחרורו במסגרתה עתר לאפשר לו לחזור לעבוד כראש עיריית קלנסווה פעמיים בשבוע, ארבע שעות בכל פעם בליווי צמוד של אחד המפקחים. בית המשפט המחוזי (כב' השופטת מ' ברנט) קבע כי החלטת בית המשפט העליון בעניינו של העורר בעינה עומדת, וכי אין בית המשפט המחוזי משמש כערכאת ערעור על החלטה זו. עם זאת, קיבל בית המשפט את הסכמת הצדדים והתיר לעורר לעשות שימוש בטלפון קווי ובטלפון נייד וכן באינטרנט בנוכחותו של אחד המפקחים, ובלבד שלא ייווצר קשר ישיר או עקיף עם מי מעדי התביעה.

בא-כוח העורר טען כי יש לאפשר לעורר לחזור לפחות באופן חלקי לתפקד כראש עיריית קלנסווה. לטענתו, חלפו ארבעה חודשים מאז שחרורו למעצר בית ללא שביצע אף הפרה של תנאי השחרור. לו היה חפץ העורר לשבש מהלכי משפט היה יכול לעשות זאת במהלך חודשים אלו מאז שוחרר. אין כל ראיה כי העורר מתכוון לשבש מהלכי משפט. הסנגור ציין כי כיום עובדים בעיריית קלנסווה רק חלק מעדי התביעה, ולגביהם הסכים הסנגור כי יוגשו הודעותיהם ללא חקירה. כן הודגש כי העורר נעדר עבר פלילי. לטענת הסנגור, מניעה מהעורר לחזור לתפקידו מאלצת אותו לסיים באופן כפוי את כהונתו כראש עיר נבחר. הסנגור ציין כי העורר נבחר בתמיכה רחבה ובהפרש קולות ניכר מהמועמד השני. לטענתו כתב האישום נולד על רקע התנכלות פוליטית לאחר שפעל להגביר את פעולות הגבייה נגד חייבים שלא שילמו את חובותיהם לעירייה. הסנגור ציין כי עניינו של העורר מצוי בפני שר הפנים עקב נבצרותו של העורר למלא את תפקידו, והשר עלול למנות ועדה קרואה או למנות אדם אחר במקומו, וכך ייפגע מעמדו. הסנגור מוסיף וטוען כי האינטרס הציבורי נפגע ממצב זה בו ראש העיר הנבחר אינו מכהן בתפקידו, וכי פרוייקטים רבים שיזם אינם מקודמים. כן, לטענתו, העורר הפסיק לקבל שכר ומשפחתו מצויה ללא מקור פרנסה. צוין כי משפטו של העורר טרם החל ואף לא נקבעו מועדי הוכחות.

בא-כוח המדינה טען כי הבקשה לעיון חוזר הוגשה שלושה חודשים בלבד לאחר החלטתו הקודמת של בית משפט זה בעניינו של העורר. לטעמו זהו לא זמן מספיק לבחון את הדברים בשנית, ואף אין כל שינוי בנסיבות המצדיק עיון חוזר. לטענתו, אין הליך זה מהווה ערעור על ההחלטה הקודמת בעניינו של העורר.

לאחר שמיעת טענות הצדדים באתי לכלל מסקנה כי דין הערר להידחות. סעיף 52(א) לחוק סדר הדין הפלילי (סמכויות אכיפה –מעצרים), התשנ"ו-1996 קובע:
עצור, משוחרר בערובה או תובע רשאי לפנות לבית המשפט בבקשה לעיון חוזר, בענין הנוגע למעצר, לשחרור או להפרת תנאי השחרור בערובה, לרבות בהחלטה לפי סעיף זה, אם נתגלו עובדות חדשות, נשתנו נסיבות או עבר זמן ניכר מעת מתן ההחלטה.
על מנת לאפשר עיון חוזר במעצרו או בתנאי שחרורו של נאשם עליו להראות כי חלף זמן ניכר מעת מתן ההחלטה בעניינו, או כי נתגלו עובדות חדשות או נשתנו נסיבות. נראה כי אף אחת מעילות אלו אינה מתקיימת בעניינו של העורר. העורר אינו טוען כי התגלו עובדות חדשות או השתנו נסיבות. החלטתו הקודמת של בית משפט זה ניתנה ביום 16.8.11. אמנם, חלוף זמן ניכר הוא מושג עמום שפרשנותו רחבה ומשתנה בהתאם לנסיבות העניין, תוך יצירת איזון בין הפגיעה בנאשם לבין האינטרס הציבורי (בש"פ 6845/07 קוסטריקין נ' מדינת ישראל (לא פורסמה, 19.8.07)). בעניין דנן לא שוכנעתי כי התקיים התנאי של חלוף זמן ניכר המצדיק את בחינת תנאי השחרור מחדש. לא יכול להיות ספק שהפגיעה בעורר אינה קלה, שכן הוא אינו יכול למלא את התפקיד אליו הוא נבחר, אך גם החשש לפגיעה במהלכי משפט עומד בעינו. בית משפט זה (כב' השופט לוי) קבע כי "נוכח אופיים של האישומים יש להבטיח כי העורר לא יוכל ליצור קשר עם עדים כדי לשבש מהלכי משפט" (בש"פ 5853/11, פסקה 3). לפיכך הורה בית המשפט על חלופה שמרחקה מקלנסווה הוא של לפחות 60 ק"מ . העובדה שהעורר מואשם בעבירות של איומים וסחיטה באיומים מצביעה על חשש רב לשיבוש, שאין בסיס להניח כי חלף, במיוחד לאור העובדה שטרם החל המשפט. יוער כי לגבי עבירות מסוג זה נפסק לא אחת כי בדרך כלל הן אף לא מתאימות לחלופת מעצר בשל החשש המובנה לשיבוש מהלכי משפט (בש"פ 4120/11 דדוש נ' מדינת ישראל (לא פורסמה, 6.6.11)). יתרה מכך, העבירות בהן מואשם העורר קשורות ישירות לתפקודו כראש העירייה. במצב דברים זה שובו של העורר לעירייה עצמה ולעמדת הכוח הכרוכה בתפקידו יוצר חשש ממשי להשפעה על עדים, גם אם הם אינם עוד עובדי העירייה.
אשר על כן הערר נדחה.
