החלטה
לפני בקשה להארכת מעצר (שניה) לפי סעיף 62 לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996 (להלן: חוק המעצרים ) בתשעים ימים מיום 22.11.2012, או עד למתן פסק דין בעניינו בת"פ 45374-11-11 בבית המשפט המחוזי בירושלים (השופט א' כהן ), לפי המוקדם.
עובדות כתב האישום המתוקן

המשיב, תושב ישראל, מואשם כמי שהיה פעיל בארגון החמאס, שהינו ארגון טרור, במסגרת פעילותו ה"אזרחית" בתחומי הדת, החינוך והרווחה בקרב אוכלוסיה מוסלמית בעיר ירושלים. הפעילות האמורה מתבצעת ברחבי העיר ירושלים באמצעות ועדות מקומיות. היגוי הפעילות וניהולה מתבצעים על ידי מועצה מייעצת (מג'לס שורא) (להלן: המועצה ), המורכבת מפעילי חמאס מקומיים מרכזיים ובהם המשיב (הנאשם 1), הנאשם 2, הנאשם 4, פואד חמדייה ואחרים. במהלך חודש אוגוסט 2010, בעת שהתכנסה במסגד אלהג'רה שבירושלים, בחרה המועצה במשיב ובשלושת האחרים הנ"ל, לשמש כועדה ניהולית של המועצה (להלן: הועדה ). המשיב נבחר על ידי הועדה לכהן כיושב ראש וכמנהיג פעילות החמאס בירושלים.
במסגרת פעילות הועדה התכנסו חבריה למפגשים שנוהלו על ידי המשיב, מעת לעת, בתדירות משתנה, במקומות שונים ובאופן דיסקרטי. במהלך פגישותיהם הגו חברי הועדה רעיונות לפעילות, דנו בהצעות ויוזמות של פעילי המועצה וגיבשו החלטות שיאפשרו את הוצאת רעיונותיהם אל הפועל. במסגרת תפקידו בארגון ועל מנת לקדם את מטרותיו, פעל המשיב, יחד עם נאשמים 2 ו-4 ואחרים, לתמיכה במוסדות חינוך, העברת שיעורי קוראן והלכה, סעודות "איפטאר" ציבוריות במהלך חודש הרמאדן, הפעלת קייטנות ומחנאות קיץ ופעילויות חינוכיות מגוונות. כמו כן, פעלו המשיב, נאשמים 2 ו-4 ואחרים, להגשת סיוע למשפחות נזקקות בחגים ובכלל, להשתתפות של פעילי חמאס באירועים שונים, ולעריכת ביקורים במשפחות "שהידים", אסירים בטחוניים ואסירים משוחררים. את כל האמור לעיל ביצעו המשיב על מנת להעלות את קרנו של חמאס בקרב תושביה המוסלמים של ירושלים, לקרבם לארגון ולדרכו ובכך לחזק את אחיזתו באזור ירושלים רבתי.
במהלך חודש אוקטובר 2010 התכנסה המועצה בפארק "קנדה" שבאזור לטרון לישיבה שתכליתה דיון בדרכי הבעת תמיכה והזדהות עם נציגים של ארגון החמאס בפרלמנט הפלסטיני שתושבותם נשללה, אשר שהו בחצר "הצלב האדום" בירושלים, וזאת במחאה על הכוונה לעצרם בגין היותם שוהים בלתי חוקיים. הדיון ומקומו נקבעו ביוזמת הועדה ובהוראתה. בישיבה נכחו בין השאר המשיב, נאשמים 2 ו-4 ועוד כתריסר חברי מועצה שזומנו לישיבה באמצעות חברי הועדה. במסגרת הישיבה התקבלה החלטה להגביר את תדירות ביקורי ההזדהות אצל השוהים בחצר "הצלב האדום" ולתמרץ את תומכי החמאס מקרב האוכלוסיה המוסלמית בירושלים לפקוד את אותם נציגי חמאס. עם פיזור הישיבה פעלו המשיב והנאשמים 2 ו-4 יחד עם פואד חמדיה והמועצה להפיץ את החלטותיהם בקרב פעילי חמאס ודאגו למימושן. בהתאם להחלטה, הגבירו הנאשמים כולם את ביקורי ההזדהות שקיימו בחצר ה"צלב האדום" וכן הביאו להגברת כמות המבקרים הפוקדים את מאהל אנשי החמאס השוהים בחצר "הצלב האדום".
בחודש יולי 2011 לערך, נכח המשיב בכינוס של המועצה בואדי ערה שמטרתו לדון במספר נושאים רלבנטיים לפעילות החמאס בירושלים. במסגרת הישיבה התקבלו החלטות שעיקרן עידוד האוכלוסיה לבקר במסגדי העיר ירושלים בכלל ובמסגד אלאקצה בפרט, וכן החלטות שעניינן טיפול והגשת סיוע לתושבים הנזקקים לכך, הכל לשם האדרת שמו ומעמדו של החמאס בקרב האוכלוסיה המוסלמית בירושלים. במהלך הישיבה ערך המשיב פרוטוקול ולאחר מכן העביר אותו לידי הנאשם 2 לשם הדפסתו והפצת ההחלטות שהתקבלו במהלך הישיבה בקרב פעילי הועדות האזוריות בירושלים לשם ביצוען.
בגין מעשים אלו יוחסה למשיב עבירה של פעילות בארגון טרוריסטי, לפי סעיף 2 לפקודה למניעת טרור, התש"ח-1948.
הליכי המעצר

ביום 24.11.2011 הוגש לבית המשפט המחוזי בירושלים כתב אישום כנגד המשיב ושלושה נאשמים נוספים. בד בבד עם הגשת כתב האישום הגישה המבקשת בקשה למעצר המשיב עד תום ההליכים. בדיון מיום 26.12.2011 הסכים המשיב לקיומן של ראיות לכאורה ולמעצרו עד תום ההליכים, תוך שמירה על טענותיו בעניין ועל זכותו לפנות בעיון חוזר. לפיכך, הורה בית המשפט המחוזי (השופט ד"ר י' מרזל ) על מעצר המשיב עד תום ההליכים. ביום 13.8.2012 הורה בית משפט זה (השופט א' רובינשטיין ), לבקשת המבקשת ובהסכמת בא כוח המשיב, על הארכת מעצרו של המשיב בתשעים ימים, החל מיום 24.8.2012.
ההליכים בתיק העיקרי

בדיון מיום 11.12.2011 התקיימה הקראה של כתב האישום. המותב בתיק הוחלף מספר פעמים ובהחלטה מיום 24.1.2012 הועבר לשופט א' כהן . כעולה מן הבקשה, עד היום טרם ניתן מענה לכתב האישום מצד המשיב וקיימת מחלוקת בנוגע לייצוגו, הגם שבינתיים החלו להתנהל הליכי הוכחות בתיק. ביום 9.2.2012 ביקשו באי כוח המשיב ונאשמים נוספים דחיה במתן מענה לכתב האישום עד להחלטה בעתירתם לגילוי ראיה. בא כוח המשיב ביקש לנהל משפט זוטא. לאחר דחיות שונות, ביום 23.4.2012 קיבל בית המשפט באופן חלקי את העתירה. ביום 24.5.2012 הודיע המשיב כי הוא שוקל את המשך ייצוגו. למשיב ניתנה ארכה להגשת מענה לכתב האישום והתיק נקבע להוכחות. ביום 18.6.2012, בשל אי התייצבות לדיון של בא כוח המשיב, עו"ד סעדי, ניתנה לו ארכה נוספת למתן המענה. ביום 3.7.2012 החלה להישמע עדותו של עד התביעה פואד חמדייה. ביום 3.9.2012 נמשכה עדותו של עד התביעה פואד חמדיה. במועד זה ביקש בא כוח המשיב, להשתחרר מייצוג. בית המשפט לא קיבל את הבקשה, אך הורה לסנגוריה הציבורית לבחון אם תוכל לייצג את המשיב בדיוני ההוכחות הבאים. בדיון מיום 20.9.2012 לא שוחרר עו"ד סעדי (שלא נכח בדיון) מייצוגו של המשיב, אך מונה למשיב סנגור מטעם הסנגוריה הציבורית. ביום 27.9.2012 נוהל דיון נוסף בו נמשכה עדותו של העד פואד חמדייה. ביום 10.10.2012 נשמעה עדותו של פואד חמדייה ושל עד נוסף. בשל היעדרו של בא כוח המשיב מהדיון ולבקשת עו"ד גולדשטיין מהסנגוריה הציבורית, דחה בית המשפט את עדותו של העד בחלק המיוחס למשיב ובהמשך הפסיק את שמיעת העדות וקבע כי היא תישמע ביום 17.10.2012. בהמשך, בוטל הדיון למועד זה עקב בקשה דחופה מטעם בא כוח המשיב מטעם הסנגוריה הציבורית בה נטען כי על ההגנה לקבל וללמוד את חומר החקירה בתיק, ומשהתגובה שהגישה המבקשת לא הונחה לפני בית המשפט במועד. ביום 5.11.2012 נמשכה עדותו של העד הנוסף. באי כוח המשיב, עו"ד עותמן ועו"ד לסקי מהסנגוריה הציבורית, העלו טענות בנוגע לצילום חומר החקירה והעברתו לסנגוריה. לאור האמור, דחה בית המשפט את התיק להמשך הוכחות למועדים שונים בחודש דצמבר.
נימוקי הבקשה

לטענת המבקשת – באמצעות בא כוחה, עו"ד אייל כהן – מסוכנותו של המשיב נלמדת מאופי מעשיו שנועדו להעצים את כוחו של ארגון החמאס על ידי הרחבת מעגל התומכים בו ונוכח מקומו המרכזי של המשיב בארגון החמאס. המבקשת מדגישה כי המשיב עומד בראש דרג הארגון שכן כעולה מכתב האישום הוא נבחר על ידי הועדה לכהן כיושב ראש וכמנהיג פעילות החמאס בירושלים. בנוסף טוענת המבקשת כי מסוכנות של המשיב מתחזקת נוכח עברו הפלילי המכביד הכולל עבירות של החזקת משרה בהתאגדות לא חוקית, חברות בהתאגדות לא חוקית, הפרת הוראה חוקית, הפרות של הסדר הציבורי וסיוע למבוקשים. בגין חלק מעבירות אלה הושת על המשיב בעבר עונש מאסר. כמו כן נטען כי שמיעתו של התיק תתקדם בתקופת ההארכה המבוקשת, כשעד למחצית חודש דצמבר כבר קבועות ארבע ישיבות הוכחות נוספות. המבקשת מפנה להחלטותיו של בית משפט זה בדבר הארכת מעצרם של נאשמים נוספים בפרשה זו, בהן ערך בית המשפט הבחנה בין הנאשמים בהתאם לחומרת המעשים המיוחסים להם ועברם הפלילי [בש"פ 6029/12 מדינת ישראל נ' פלוני (טרם פורסם, 16.8.2012); בש"פ 6028/12 מדינת ישראל נ' הלסה (טרם פורסם, 22.8.2012); בש"פ 6034/12 מדינת ישראל נ' חמדיה (טרם פורסם, 27.8.2012); בש"פ 7090/12 מדינת ישראל נ' סרחאן (טרם פורסם, 10.10.2012)].
תגובת המשיב

המשיב – באמצעות באת כוחו, עו"ד גבי לסקי – עותר להורות על עריכת תסקיר מעצר בעניינו על מנת לבחון חלופת מעצר מחוץ לירושלים. המשיב מדגיש כי העבירה היחידה המיוחסת לו בכתב האישום הינה פעילות בארגון טרוריסטי, וכי לא מיוחסת לו עבירה של חברות בארגון טרוריסטי. לטענת המשיב, עובדה זו כשלעצמה מצדיקה להבחין בינו לבין יתר המעורבים בפרשה שמעצרם הוארך עד תום ההליכים. המשיב טוען כי אמנם מיוחס לו תפקיד בכיר בארגון החמאס, אולם בכירותו הארגונית אינה מלמדת בהכרח על מסוכנות רבה. לטענת המשיב, תפקיד בכיר יכול שיהיה תפקיד של כבוד או תפקיד "ממלכתי", כאשר דווקא הפעילות "בשטח" נעשית על ידי אחרים. עוד נטען כי למרות שנקבעו ארבע ישיבות הוכחות נוספות, נוכח קיומם של ארבעה נאשמים בתיק דנן המיוצגים על ידי באי כוח שונים (כאשר אחד הנאשמים מייצג את עצמו), צפויים ההליכים בתיק להתמשך מעבר לתקופת ההארכה הנדרשת.
דיון והכרעה

לאחר שעיינתי בבקשה והאזנתי לטענות הצדדים בדיון שנערך לפני הגעתי לכלל מסקנה כי דין הבקשה להתקבל.

כידוע, בבוא בית המשפט להורות על הארכת מעצר לפי סעיף 62 לחוק המעצרים, עליו לאזן בין הפגיעה בחירותו של הנאשם, שעודנו נהנה מחזקת החפות, לבין ההגנה על שלום הציבור וביטחונו. כבר נפסק כי ככל שמעצרו של הנאשם מתמשך, כך נעה נקודת האיזון לכיוון ההגנה על חירות הנאשם ומורה על שחרורו ממעצר [בש"פ 651/12 מדינת ישראל נ' פלוני (טרם פורסם, 25.1.2012), בפיסקה 15 להחלטתי (להלן: עניין פלוני ); בש"פ 2970/03
מדינת ישראל נ' נסראלדין (טרם פורסם, 2.4.2003), בפיסקה 4 (השופטת פרוקצ'יה )]. הלכה זו נשענת על הכלל הקבוע בסעיף 61 לחוק המעצרים, לפיו
נאשם אשר שוהה במעצר במשך תשעה חודשים ומשפטו בערכאה הדיונית טרם נסתיים ישוחרר ממעצר בערובה או בלעדיה. סעיף 62 לחוק המעצרים המאפשר לבית משפט זה להורות על הארכת מעצרו של נאשם שההליכים בעניינו נמשכים, נועד אם כן להוות את החריג לכלל, הגם שבפועל מכורח הנסיבות והימשכות ההליכים המשפטיים נדרש בית משפט זה לעשות בו שימוש לא אחת [ ראו למשל, עניין פלוני ; בש"פ 4897/10 מדינת ישראל נ' פלוני

במסגרת בחינת הארכת מעצרו של נאשם לפי סעיף 62 לחוק המעצרים, על בית המשפט לשקול את תכליתה של עילת המעצר, ובפרט את המסוכנות הנשקפת מן הנאשם, בשים לב לחומרת העבירות המיוחסות לו ולעברו הפלילי, וכן את קצב התנהלות הדיונים בתיק והצפי ביחס להימשכות ההליך המשפטי [ראו למשל, בש"פ 7960/12 מדינת ישראל נ' אבו ערפה (טרם פורסם, 6.11.2012), בפיסקה 20 (השופט שהם ) (להלן: עניין אבו ערפה );

במקרה שלפני עילת המעצר של המשיב נובעת מן המסוכנות הנשקפת ממנו. כעולה מכתב האישום, המשיב שימש כחבר במועצה המייעצת העוסקת בהיגוי וניהול פעילותו ה"אזרחית" של החמאס בירושלים וכן בועדה הניהולית של המועצה. המשיב אף נבחר לכהן כיושב ראש וכמנהיג של פעילות זו של ארגון החמאס בירושלים. בגדר כך, ניהל המשיב את פגישות הועדה הניהולית, בהן נדונו יוזמות פעילות בתחומי החינוך, ה רווחה והתרבות שנועדו להעלות את קרנו של החמאס, שהינו ארגון טרור, בקרב תושבי ירושלים המוסלמים ופעל לצורך קידום החלטותיה. כמו כן, השתתף המשיב בכינוס של המועצה בה הוחלט על נקיטת צעדים אופרטיביים לצורך תמיכה במחאה של נציגי ארגון החמאס על הכוונה לשלחם למעצר ופעל למימושם. בנוסף, נכח המשיב בכינוס של המועצה, בו התקבלה, בין היתר, החלטה לעודד את האוכלוסיה המוסלמית לבקר במסגדים בירושלים, ובפרט במסגד אל אקצא, במטרה לחזק את מעמדו של החמאס. מן האמור לעיל עולה כי המשיב השתייך לדרג הפעילות הראשון והבכיר של ארגון החמאס בירושלים, וכפועל יוצא היה מעורב בכל פעילותו של הארגון כמפורט לעיל, לפחות במישור הניהולי-ארגוני של פעילות זו.

העבירה המיוחסת למשיב, פעילות במסגרת ארגון טרוריסטי, הינה עבירת ביטחון לפי סעיף 35(ב)(3) לחוק המעצרים וככזו היא מקימה כנגד המשיב חזקת מסוכנות לפי סעיף 21(א)(1)(ג)(2) לחוק המעצרים. אכן, המעשים המיוחסים למשיב נוגעים למישור הפעילות האזרחית-חברתית של ארגון החמאס. אולם בפסיקתו של בית משפט זה הוטעם זה מכבר ביחס לפעילות מסוג זה וביחס לפעילות מושא הפרשה דנן בפרט כי:
"אמנם, הפעילות המיוחסת לעוררים אזרחית באופיה, ועל פני הדברים, ובמציאות אידיאלית, פעילות חברתית הנסבה על סיוע לאוכלוסיה אזרחית לא הייתה מהוה עבירה פלילית. אולם המציאות אינה אידיאלית, והמלחמה בארגוני הטרור, והחמאס ביניהם, נעשית בחזית הצבאית-בטחונית ובחזית האזרחית-חברתית כאחת, ומכאן שמעשיהם לכאורה של העוררים הם בגדר עבירה פלילית ."

בעניין אגברייה
הנזכרים שם:
"אמת הדבר, כי הפעילות המיוחסת לעוררים כעולה מחומר הראיות נושאת אופי אירגוני-אזרחי ולא צבאי... אולם בהקשר שלפנינו פעולות אלה קשורות בהנהגת גוף אשר, בצד פעילותו האזרחית, יש לו פן צבאי-טרוריסטי שנועד להשגת תכלית של לוחמת טרור המכוונת לפגוע פגיעות בנפש באזרחי מדינת ישראל. על פני הדברים, פעילותו האזרחית של הארגון נועדה לסייע לפעילות הצבאית ולשמש בסיס ותשתית לה. לא הוכח בפנינו אחרת. משכך, לא ניתן לבודד בין הפונקציה האזרחית לפונקציה הצבאית בפעילותו של הארגון, וכל אבחנה והפרדה ביניהם היא מלאכותית ושגויה. הפונקציה האזרחית מזינה את התכלית הצבאית, והתכלית הצבאית מספקת את העילה והתכלית לפעילות הכספית האזרחית ולהזרמת המימון הנדרש לפעילות הארגון, ובכלל זה גם למעשי עזרה לנזקקים, ולקיום פעילויות חברתיות בין צעירי הארגון כדי לעודד את מעורבותם והשתייכותם לארגון (בש"פ 6552/05 אגברייה נ' מדינת ישראל (טרם פורסם, 17.8.2005). ראו גם: עניין

המסוכנות הנשקפת מן המשיב עניינה, אם כן, בחשש שמא שחרורו ממעצר יוביל להמשך פעילותו במסגרת החמאס. בעניינו של המשיב מסוכנות זו מקבלת משנה תוקף נוכח עברו הפלילי המכביד, אשר כולל עבירות של החזקת משרה בהתאגדות לא חוקית, חברות בהתאגדות לא חוקית, הפרת הוראה חוקית, הפרות של הסדר הציבורי וסיוע למבוקשים. בהתאם לרישומו הפלילי, המשיב אף ריצה עונשי מאסר בגין חלק מעבירות אלה.

בנסיבות העניין, נוכח המסוכנות הנשקפת מן המשיב, ובשים לב לעברו הפלילי ולהחלטות שניתנו ביחס לנאשמים נוספים בפרשה דנן, וכן לאור ההתקדמות הצפויה במסגרת ההליך העיקרי, סבורני כי אין מקום להורות על שחרורו של המשיב ממעצר. לטעמי, אין בסיס להבחין בין המשיב לבין נאשמים נוספים שמעצרם הוארך על ידי בית משפט זה ואשר אף הם משתייכים לדרג הפעילות הבכיר בפרשה זו [ראו: בש"פ 7090/12 מדינת ישראל נ' סרחאן (טרם פורסם, 10.10.2012) ; בש"פ 7091/12 מדינת ישראל נ' חמדייה (טרם פורסם, 10.10.2012) . ראו גם: עניין אבו ערפה ]. זאת בין היתר משום שכעולה מכתב האישום המשיב מילא תפקיד של ממש כמנהיג פעילותו ה"אזרחית" של החמאס בירושלים, במסגרתו נטל חלק הן בקבלת ההחלטות והן בהוצאתן לפועל. כמו כן, העובדה כי למשיב יוחסה עבירה של פעילות בארגון טרוריסטי, שהעונש המקסימאלי בגינה עומד על עשרים שנות מאסר, ולא עבירה של חברות בארגון טרור, שהינה חמורה פחות והעונש המקסימאלי בגינה עומד על חמש שנות מאסר, אינה יכולה לשמש כבסיס להבחנה לקולא בינו לבין יתר הנאשמים בפרשה דנן.

בנסיבות העניין אף איני סבור כי יש טעם בהכנת תסקיר מעצר בעניינו של המשיב. תסקיר מעצר הינו כלי עזר ויש בו כדי לסייע לבית המשפט להכריע בשאלת קיומן של חלופות מעצר מתאימות. עם זאת, אין חובה להורות על עריכת תסקיר מעצר והדבר נתון לשיקול דעתו של בית המשפט היושב בדין [ראו: סעיף 21א לחוק המעצרים; בש"פ 8383/12 סעדי נ' מדינת ישראל
(טרם פורסם, 28.11.2012), בפיסקה 7 להחלטתי; בש"פ 1092/05 תראבין נ' מדינת ישראל (טרם פורסם, 27.2.2005) בפיסקה 8 (השופטת (כתוארה אז) ביניש )]. לפיכך, במקרים בהם ברור כי לא ניתן לאיין את מסוכנותו של הנאשם באמצעות חלופת מעצר, אין טעם ואין חובה להורות על עריכת תסקיר מעצר [ראו גם: בש"פ 7873/12 פלוני נ' מדינת ישראל

אשר על כן, הבקשה מתקבלת. הנני מורה על הארכת מעצרו של המשיב בתשעים ימים, החל מיום 22.11.2012 או עד למתן פסק דין בעניינו, לפי המוקדם.
