בקשה לפטור מאגרה
החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת ערבון בעתירה לדיון נוסף שהגיש המבקש. העתירה נסובה על החלטתו של בית משפט זה ברע"א 3619/07 (מפי כב' השופט י' אלון) במסגרתה נדחתה בקשת המבקש לרשות לערער ב"גלגול שלישי". לאחר עיון בבקשה ובחומר המצוי בתיק, באתי לכלל מסקנה כי יש לדחות את הבקשה לפטור מאגרה. לצורך מתן פטור מאגרה, אין די בהעדר יכולת לשלם אגרה. תנאי נוסף הינו כי ההליך מגלה עילה. במקרה שלפניי, ספק רב בעיני אם הבקשה לדיון נוסף מגלה עילה, שכן מבוקש בה לקיים דיון נוסף בהחלטה בה פסק בית המשפט העליון בדן יחיד. לא פעם נפסק כי "תנאי המינימום לאפשרות קיומו של דיון נוסף הוא כי העניין נפסק על ידי בית המשפט העליון בשלושה" (דנ"א 6707/95 לביא נ' בנק הפועלים , פ"ד מט(5) 155, 157; ראו גם בש"פ 3120/06 מדינת ישראל נ' בניאורשווילי (לא פורסם, 4.6.2006)). פסק דין של דן יחיד אינו עומד לדיון נוסף. במצב דברים זה, בו מ דובר על פניו בהליך חסר תוחלת, אין עילה לפטור את המבקש מתשלום אגרה, גם בהנחה שמצבו הכלכלי קשה, כנטען על ידו. האגרה תשולם תוך 10 ימים מעת המצאת החלטה זו, ולא – יימחק הליך ללא צורך במתן הודעה נוספת. המזכירות תביא את התיק לפניי לאחר תשלום האגרה, לצורך בחינת הבקשה לפטור מהפקדת ערבון.
