לפניי בקשה לפטור מהפקדת עירבון (שהועמד על סך של 30,000 ₪). הבקשה הוגשה במסגרת בקשה לדיון נוסף בפסק דינו של בית משפט זה בע"א 5578/08 אירידיום בע"מ נ' בנק דיסקונט לישראל בע"מ (טרם פורסם, 27.12.2011).
לאחר עיון בטענות הצדדים ובחומר שבתיק לא שוכנעתי בקיום הצדקה למתן הפטור המבוקש.
לפתחו של בעל-דין המבקש פטור מהפקדת עירבון רובץ הנטל להוכיח כי אין באפשרותו לגייס את הסכום הנדרש לצורך הפקדת העירבון, לרבות בעזרת סביבתו הקרובה. בענייננו, נטען בבקשה כי המבקשות 1 ו- 2 הן חברות לא פעילות, נטולות נכסים וכספים, וכי המבקש 3 נותר בעקבות ההליכים שהתנהלו כנגדו חסר-כל. עם זאת, גם אם אקבל שהמבקש נקלע לתסבוכת כלכלית, הרי שלא שוכנעתי כי אין באפשרות המבקשים לגייס סכום-כסף לצורך עירבון. המבקשים צירפו אסמכתאות מעטות ובלתי-מספקות לבקשתם, ואף הטענה בדבר חוסר אפשרות להסתייע בסביבה הקרובה לא זכתה לפירוט ולתיעוד הולמים (ראו

ונדר נ' בנק דיסקונט למשכנתאות בע"מ (טרם פורסם, 17.12.2009)). עוד אציין כי בגדרי הערעור הופקד עירבון בסך של 35,000 ₪ (לא הוסבר בבקשה כיצד).
עוד אציין, בלי לקבוע מסמרות, כי מעיון בפסק הדין שניתן בערעור ובטענות המבקש, ספק רב אם המקרה דנן בא בגדר המקרים החריגים ויוצאי הדופן שבהם יורה בית המשפט על קיום דיון נוסף.
לאור המקובץ, באתי לכלל מסקנה כי אם חפצים המבקשים לקיים הליך של בקשה לדיון נוסף לאחר שידם עד כה הייתה על התחתונה, עליהם להפקיד עירבון להבטחת הוצאותיו של המשיב. על יסוד הנתונים שלפניי, ובשים לב לכלל הנסיבות, אני מורה על הפחתת סכום העירבון והעמדתו על סך של 20,000 ₪. העירבון יופקד תוך 21 ימים מעת המצאת החלטה זו. בהיעדר הפקדה יירשם ההליך לדחייה.
