החלטה

לפניי עתירה לדיון נוסף בפסק דינו של בית המשפט העליון בע"פ 1548/13 מיום 27.1.2014 (להלן – פסק הדין ). בפסק הדין, שניתן על ידי השופט ח ' מלצר בהסכמת השופטים י ' עמית ו- צ '
זילברטל , נדונו סוגיות תקדימיות שונות הקשורות לפרשנות חוק לנשיאת עונש מאסר במדינת אזרחותו של האסיר, התשנ"ז-1996 (להלן – חוק נשיאת עונש מאסר ), ולפרשנותה של האמנה הבינלאומית בדבר העברת נידונים (להלן – האמנה ).

בית המשפט העליון דן באותן סוגיות פרשניות על רקע המקרה הפרטני של המשיב, שהוא אזרח ישראלי. בשנת 1999 הורשע המשיב על ידי בית משפט באנגליה בביצוע רצח באותה מדינה. בית המשפט האנגלי גזר על המשיב עונש של מאסר עולם. מכוח הוראות חוק נשיאת עונש מאסר, עתר המשיב לריצוי עונשו בישראל, היא כאמור מדינת אזרחותו. בשנת 2002 החליט בית המשפט המחוזי בירושלים ליתן צו מכוח חוק נשיאת עונש מאסר, הקובע כי העותר ירצה בישראל מאסר עולם בגין הרשעתו באנגליה. העונש יימנה, כך נקבע, מיום מעצרו באנגליה. עוד קודם להחלטה זו נקבע באנגליה מרכיב מסוים המשפיע על משך ריצויו של מאסר עולם באנגליה. מרכיב זה מכונה שם " Tariff ". למשיב נקבעה תקופת Tariff
של 13 שנים. לעומת זאת, סמוך לאחר שהמשיב החל לרצות את עונשו בישראל החליט נשיא המדינה לקצוב את עונשו ל-30 שנות מאסר (מאוחר יותר נקצב העונש ל-28 שנות מאסר).

רוב רובו של פסק הדין מושא העתירה שלפניי עוסק בשאלת פרשנותו של רכיב ה- Tariff , התאמתו לדין הישראלי, והשאלה מתי יש להביא את המשיב לפני ועדת שחרורים מיוחדת, הפועלת לפי חוק שחרור על-תנאי ממאסר, התשס"א-2001 (להלן – חוק שחרור על תנאי ). המדינה טענה כי המועד המוקדם ביותר בו ניתן לזמן את ועדת השחרורים המיוחדת הינו לאחר שהמשיב ירצה שני שלישים מתקופת המאסר כפי שזו נקצבה על ידי נשיא המדינה (28 שנים). המשיב, לעומת זאת, גרס כי על פי הוראות חוק נשיאת עונש מאסר והאמנה, חובה לבחון את שחרורו המוקדם בתום תקופת ה- Tariff
שנקבעה באנגליה, היינו בתום 13 שנים. איני רואה צורך להידרש בהרחבה להשתלשלות העניינים הדיונית המורכבת בהליך, המפורטת בפסק הדין מושא העתירה (ראו פיסקאות 10-3 לפסק הדין), כמו גם לכל הסוגיות הפרשניות התקדימיות שנדונו בפסק הדין. בסופו של דבר נקבע בפסק הדין, כי האופן הנכון להתאים לדין הישראלי את העונש שנגזר על המשיב בחו"ל, הינו להביא את המשיב בפני ועדת השחרורים המיוחדת בתום 13 שנים ממועד מעצרו. בית המשפט קבע הוראות שונות שעל פיהן יהיה על ועדת השחרורים המיוחדת לבחון את עניינו של המשיב, וקבע כיצד יהיה לפעול בעקבות החלטת ועדת השחרורים המיוחדת, לצורך סיום הטיפול בעניינו של המשיב לפי חוק נשיאת עונש מאסר (סעיפים 63-62 לפסק הדין).

היועץ המשפטי לממשלה עותר בהליך דנא לקיומו של דיון נוסף בפסק הדין. לאחר שעיינתי בטענותיהם המלומדות של באי כוחו של היועץ המשפטי לממשלה הגעתי לכלל מסקנה כי אין מקום להיעתר לעתירה ולהורות על עריכתו של דיון נוסף בפסק הדין. אין ספק, כי בפסק הדין נקבעה הלכה חדשה וחשובה בנוגע לפרשנות חוק נשיאת עונש מאסר. יחד עם זאת, כבר נקבע לא אחת כי העובדה שנפסקה במקרה מסוים הלכה חדשה, קשה או חשובה, אין בה די כדי להצדיק קיומו של דיון נוסף (ראו למשל, דנ"א 5136/12 פלוני נ '
היועץ המשפטי לממשלה , פיסקה 6 (4.9.2012)). על השופט שלפניו הונחה העתירה להשתכנע, כי ההלכה שנפסקה מבחינת מרכיביה, מאפייניה וטיבה, נמנית עם המקרים הנדירים המצדיקים קיומו של דיון נוסף. ואכן, "לא כל חידוש הילכתי די בו כדי להצדיק סטייה מן הכלל הרגיל שלפיו פוסק בית-המשפט העליון בשלושה ופסיקתו היא סוף פסוק. נדרשת הלכה מיוחדת וחריגה שיש בה כדי לשנות באורח מהותי נורמות ששררו עובר להלכות שנדונו והוכרעו בפסק הדין" (דנ"א 3455/05 עטיה נ '
שחר , פיסקה 6 (11.10.2005)).

בהמשך לדברים האמורים יצוין, כי אין זה מדויק לומר, כפי שטען היועץ המשפטי לממשלה, כי פסק הדין קבע הלכה כללית וחדשה בנוגע לאופן בו יש לפרש את כלל ההוראות בדין הישראלי המיועדות לקלוט הוראות של אמנות בינלאומיות (ראו, סעיפים 25-22 לעתירה). פסק הדין עוסק בהוראות האמנה ובחוק נשיאת עונש מאסר, ובהם בלבד. פסק הדין לא התיימר לקבוע הלכה כללית וגורפת העומדת בסתירה להלכות קודמות של בית משפט זה הנוגעות לאימוץ המשפט הבינלאומי "בהעדר לקונה ובמקום בו קיימת התנגשות עם החוק הפנימי", כפי שטוען היועץ המשפטי לממשלה (סעיף 22 לעתירה). זאת ועוד, פסק הדין עוסק אך ורק באופן בו יש לקלוט עונש מאסר עולם שנגזר במדינה בה נהוגה שיטה דומה לזו שהייתה נהוגה באנגליה, בדרך של קביעת רכיב של Tariff
או רכיב דומה לו. פסק הדין לא קבע הלכה ביחס למקרים אחרים. כמו כן, מרבית טענותיו של היועץ המשפטי לממשלה מופנות נגד פרשנותו של בית המשפט העליון לחלק מהוראות חוק נשיאת עונש מאסר. כך למשל טוען היועץ המשפטי לממשלה, כי פרשנותו של בית המשפט העליון עומדת בניגוד למושכלות יסוד הנוגעות להיקף סמכויותיה ושיקוליה של וועדת השחרורים המיוחדת, ואינה עולה בקנה אחד עם סמכות קציבת העונש, הנתונה לנשיא המדינה. אפילו קיימים בהקשרים אלה קשיים בפסק הדין, ואיני מביע עמדה בקשר לכך, הרי בידי היועץ המשפטי לממשלה עומדת האפשרות לנסות ולקדם תיקוני חקיקה, בעקבות פסק הדין. מ דובר
בטעם המלמד אף הוא כי אין זה הכרחי לערוך דיון נוסף במקרה דנא (ראו והשוו, דנ"פ 1537/12 מדינת ישראל נ ' גנני , פיסקה 8 וההפניות שם (20.5.2012)). שיקול נוסף המצדיק את דחיית העתירה הינו שפסק הדין ניתן פה אחד (ראו, דנ"א 2939/12 מדינת ישראל נ '
מולהי , פיסקה 9 (22.4.2012)).

מן הטעמים האמורים אני דוחה את העתירה לדיון נוסף. לפיכך, בטל בזאת הסעד הארעי שניתן על ידי ביום 20.3.2014, אשר מכוחו נמנעה מוועדת השחרורים המיוחדת האפשרות לקבל החלטה מהותית בעניינו של המשיב. יצוין, כי בטרם חתמתי על החלטתי הובאה לעיוני הודעת המדינה מיום 31.3.2014 והנספחים שצורפו אליה. מובן, כי אין בכוונתי להביע כל עמדה בעניין הדיון בוועדת השחרורים המיוחדת.
