בקשה לפטור מאגרה
החלטה
לפניי בקשה לפטור מתשלום אגרה בהליך שבכותרת, שעניינו ערעור על פסק דין של בית המשפט של פשיטת רגל בגדרו נדחתה בקשת המערערים להכריז עליהם כפושטי רגל ובוטל צו הכינוס על נכסיהם. אגב הכרעה בסוגית האגרה, אקבע אף את סכום העירבון הראוי בגדרו של הליך זה. המשיבים הביעו את התנגדותם לבקשה.
אמנם, בשים לב למהות ההליך, נקודת המוצא הינה כי מצבם הכלכלי של המערערים אינו מן המשופרים. עם זאת, גם בהליכים כגון דא נדרש בעל דין העותר לפטור מאגרה, לפרוש תשתית עובדתית וראייתית מלאה ועדכנית ביחס למצבו הכלכלי. כזאת לא עשו המערערים. הבקשה אינה כוללת פירוט כלשהו באשר למקורות הכנסתם של המערערים, וזאת אף שמן הבקשה עולה במפורש כי לכל אחד מן המערערים קיימת הכנסה. אף לא ניתן כל פירוט באשר להוצאותיהם של המערערים, ולא צורפו אסמכתאות כלשהן הנוגעות למצבם הכלכלי. זאת ועוד, לא ניתן הסבר לעניין האופן שבו מממנים המערערים את ייצוגם המשפטי, כמו גם לעניין מקור המימון של הסדר הנושים אשר הוצע על ידם אך לאחרונה (ואשר נדחה על ידי הנושים). די באמור עד כה כדי לדחות את בקשת הפטור.
אף אין בידי לקבל את בקשת המערערים להורות כי האגרה תשולם מתוך קופת הכינוס. תוצאתו של צעד כזה תהא השתת חלק מעלות ההליך דנן (אשר ניזום על ידי המערערים ולטובתם) על כתפיהם של הנושים. ממילא, ככל שהמערערים סבורים כי יש מקום למתן הוראה כאמור - ואיני מביע עמדה כלשהי בעניין זה - הרי שעליהם לפנות בבקשה מתאימה לבית המשפט של פשיטת רגל.
בשים לב לאמור לעיל, ומשאיזנתי בין כלל השיקולים הצריכים לעניין, רואה אני להפחית את האגרה לכדי סך של 1,500 ₪ ולהעמיד את העירבון על סכום מתון של 9,000 ₪. האגרה תשולם תוך 20 ימים מיום המצאת החלטה זו, והעירבון יופקד תוך אותו מועד, שאם לא כן יימחק ההליך או יירשם לדחייה, לפי העניין, ללא צורך בהודעה נוספת.
בשולי הדברים אציין, כי בתגובתו של המשיב 1 - הוא המנהל המיוחד - הועלתה טענה לפיה היה על המערערים לצרף את הנושים גיגי אלה ויואל (להלן: הנושים ) כמשיבים בערעור דנן. עיון בפסק הדין נשוא הערעור מעלה כי הנושים נטלו חלק בהליך בבית משפט קמא והתנגדו להכרזה על המערערים כפושטי רגל. בנסיבות אלו מאפשר אני לנושים להגיש, ככל שהם חפצים בכך, בקשה להצטרף כצד להליך דנן, אשר בגדרה יפרטו הם את היקף מעורבותם בהליך אשר התנהל בערכאה דלמטה. המנהל המיוחד ימציא החלטה זו לבא כוח הנושים תוך 3 ימים מיום המצאת החלטה זו לידיו, ויגיש אסמכתא על דבר ביצוע ההמצאה. הנושים יהיו רשאים להגיש בקשת הצטרפות תוך 5 ימים מיום המצאת החלטה זו לידיהם. ככל שתוגש בקשה כאמור, אכריע בה לגופה.
