לפניי בקשת המערער מיום 14.6.2010 לצירוף כונס הנכסים הרשמי (להלן גם: הכנ"ר ) כמשיב לערעור. בקשה זו הוגשה בעקבות החלטותיי מיום 13.6.2010 וכן 14.6.2010 לאחר שהתברר כי בשל שגגה לא צורף הכנ"ר כמשיב לערעור מלכתחילה, ולאחר שהמערער ביקש לזמן את נציג הכנ"ר לדיון בערעור הקבוע ליום 23.6.2010.

בבקשתו טוען המערער כי הכנ"ר הגיש סיכומים בכתב במסגרת ההליך שהתקיים בבית-המשפט המחוזי, "על אף שלא היה באופן פורמאלי צד להליך". עוד נטען כי מחמת שגגה, לא צורף הכנ"ר כמשיב לערעור בעת הגשתו. הכנ"ר מסכים לבקשה לצירופו כמשיב לערעור, ואף מסכים להתייצב לדיון לשם הצגת טענותיו. המשיב מתנגד לבקשה בנימוק כי אין לאפשר למערער לבצע בשלב כה מתקדם של ההליך "מקצה שיפורים" על-מנת לתקן פגם שעשוי היה לפי הטענה להוביל למחיקת ההליך. נטען כי אין מקום להורות על הצירוף המבוקש בהתחשב בכך שהבקשה הוגשה כשבוע לפני המועד הקבוע לדיון, ובלא שהוגשו עד כה סיכומים בכתב מטעם הכנ"ר.

לאחר ששקלתי את טענות הצדדים, באתי למסקנה כי יש מקום להורות על צירוף הכנ"ר כמשיב לערעור. עיון בחומר שבתיק מגלה כי הכנ"ר הגיש סיכומים בכתב בהליך שהתקיים בבית-המשפט המחוזי והוא אף צוין כמשיב בפסק-הדין המחוזי נשוא הערעור שבכותרת. בנסיבות אלה, ובהתאם להסדר הקבוע בתקנה 424 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: התקנות ), היה על המערער לצרף את הכנ"ר מלכתחילה כמשיב לערעור. נראה כי המערער אינו חולק על כך, שהרי המערער מאשר בטיעוניו כי העדר הצירוף נבע משגגה.
אי צירופו של הכנ"ר כמשיב לערעור מהווה פגם בהליך, שכן משמעות הדבר היא כי בית-משפט זה לא קיבל תמונה מלאה לגבי בעלי-הדין הנוגעים לערעור. תקנה 524 לתקנות שכותרתה "סמכות כללית לתקן פגם בהליך" מותירה בידי בית המשפט שיקול-דעת רחב לתקן "...כל פגם או טעות בכל הליך". ההסדר האמור מוש תת על הנחה לפיה בעלי-דין עשויים לשגות בניהול ההליכים, וכי טעויות אלה אינן אמורות בהכרח להביא לכישלון ההליכים שננקטו כאשר ניתן להורות על תיקון הטעות (ראו: ע"א 6423/98 מכבסת זהר ארטל בע"מ נ' משרד הבריאות , פס' 6 (לא פורסם, 15.5.2000)). יוער כי תקנה 524 הנ"ל קובעת כי חובה להורות על תיקון כאמור "כדי לברר
מה הן באמת השאלות השנויות במחלוקת בין בעלי הדין". הסדר זה מבוסס על התפיסה לפיה כללי הפרוצדורה אינם תכלית לעצמם אלא נועדו לשרת את מטרתו של ההליך השיפוטי - לברר את הפלוגתאות בין הצדדים ולהכריע בהן (ראו והשוו: רע"א 2919/01 אושרוביץ נ' ליפה , פ"ד נה(5) 592 (2001)).

בנסיבות העניין, ובהתאם לסמכותי לפי תקנה 524 לתקנות, אני רואה להורות על תיקון הפגם שנפל בהליך על דרך צירופו של הכנ"ר כמשיב לערעור. זאת, על-מנת שכל בעלי-הדין בהליך דלמטה יהיו צדדים לערעור כנדרש לפי תקנה 424 לתקנות, ועל-מנת שניתן יהיה לפרוש את מלוא התמונה בפני ערכאת הערעור ולברר את השאלות השנויות במחלוקת בין הצדדים. כך במיוחד, בהתחשב בעובדה שפסק-הדין המחוזי מלמד מתוכו כי התעוררו במסגרתו שאלות שיתכן שעשויה להיות להן השלכה מעבר לעניינם הפרטני של המערער והמשיב, ומשום כך קיימת חשיבות יתרה בהבאת מלוא הטיעונים בפני ערכאת הערעור – לרבות טיעוניו של כונס הנכסים הרשמי.
אמת, צירופו של הכנ"ר כעת – כשבוע לפני המועד הקבוע לדיון, כאשר יתר הצדדים כבר הגישו את סיכומיהם בכתב וכאשר הכנ"ר לא הגיש את סיכומיו – אינו נטול קשיים, ואין ספק כי מוטב היה אילו המערער היה פונה לבית-משפט זה לתיקון טעותו מוקדם הרבה יותר. עם זאת, תקנה 524 קובעת כי בית-המשפט רשאי להורות על תיקון פגם בהליך "בכל עת", לאמור – גם בשלב דיוני מתקדם. דומה בעיניי כי הפיתרון הראוי והמידתי בנסיבות העניין הוא לצרף את הכנ"ר כמשיב לערעור, תוך חיוב המערער בהוצאות מתאימות בגין הטורח וההכבדה שנגרמו כתוצאה משגגתו ומהשיהוי הניכר בהגשת הבקשה שלפניי. נוכח סמיכות הזמנים למועד הקבוע לדיון בערעור, ועל-מנת להימנע מביטול מועד הדיון כעת - בסמוך לקיומו - באופן שעלול
לגרום לבזבוז זמן שיפוטי יקר, אני רואה לנכון להורות כי הכנ"ר יגיש עמדה כתובה קצרה שיתר הצדדים לתיק יוכלו להגיב לה – אף זאת בקצרה - על-מנת שעמדותיהם הכתובות של הצדדים יובאו לעיון הרכב השופטים בטרם הדיון, באופן שעשוי לתרום לייעולו. הצדדים יוכלו להשלים טיעוניהם בעל-פה ביום הדיון, ככל שהרכב השופטים שידון בתיק ימצא זאת לנכון.

סיכומם של דברים; אני מחליטה כדלקמן:
א.
הכנ"ר יצורף כמשיב לערעור. המזכירות תדאג לעדכון מתאים בתוכנת ניהול התיקים ולהוצאת הזמנה לכנ"ר לדיון הקבוע ליום 23.6.2010.
ב.
הכנ"ר יגיש תגובה קצרה לערעור עד ליום א' 20.6.2010 בשעה 12:00. הכנ"ר ידאג להמציא תגובתו ליתר הצדדים בתיק, תוך הודעה במקביל על ביצוע ההמצאה לבית המשפט.
ג.
יתר הצדדים לתיק יוכלו להגיש תגובה קצרה לעמדת הכנ"ר, ככל שיחפצו בכך, עד ליום' ג 22.6.2010 בשעה 12:00.
ד.
המערער ישלם למשיב ולכנ"ר שכר-טירחת עורכי-דין בגין ההליך שלפניי בסך 3,000 ₪ בתוספת מע"מ, כל אחד .
המזכירות תמציא החלטה זו למערער, למשיב ולכנ"ר, ללא דיחוי, באמצעות הפקסימיליה.
החלטתי זו תתוייק בתיקי השופטים היושבים בדין.
