בקשה לפטור מערבון
החלטה
גם לאחר שאפשרתי למערער, בהחלטתי מיום 19.5.2011, להשלים את בקשת הפטור, באופן שזו תכלול "פירוט מלא ומדויק של הכנסותיו, הוצאותיו ונכסיו וכן פירוט של ניסיונות לגייס את העירבון מצדדים שלישיים כגון מוסד פיננסי, קרובים וידידים" – תוך הצגת מסמכים התומכים בטענות המערער – בחר המערער להגיש בקשת פטור ללא פירוט מלא וללא תיעוד מספק. יצוין כי המערער לדבריו שילם את האגרה כך שהבקשה מתמקדת עתה בעניין העירבון (שנקבע לסך של 20,000 ₪). אלא שמן הבקשה לא ניתן כלל וכלל ללמוד כי המערער אינו מסוגל לגייס את סכום העירבון.
כך, למשל, המערער טוען להכנסה חודשית (ככל הנראה יחד עם זוגתו) בסכום של 20,000 ₪. המערער לא הציג תלושי משכורת, ומכל מקום אין זו הכנסה מבוטלת. למערער, לדבריו, "בית פרטי, קופות גמל, קרנות השתלמות...". המערער אינו מציג פירוט מלא, בצירוף מסמכים לגבי שווי נכסיו, היקף הוצאותיו ורמת חייו, ומכל מקום, על פני הדברים, לא מדובר באדם דל באמצעים. יצוין כי מן הבקשה עולה שהמערער אינו טוען כי
אין ביכולתו להפקיד עירבון, אך לדבריו יש בכך כדי להכביד עליו ולהסב לו נזקים. טענה זו, כפי שכבר נפסק, אין בה די כדי להצדיק פטור מעירבון (ראו בש"א 4070/11 פלוני נ' מדינת ישראל (טרם פורסם, 30.5.2011)).
עוד אציין כי אליבא דהמערער אין זה מידתי לצפות שייפנה לצדדים שלישיים לצורך גיוס העירבון. אלא שטענתו בעניין זה נתקלת בכלל מושרש שלפיו בעל-דין המבקש פטור מהפקדת עירבון, תוך חשיפת הצד שכנגד לסיכון שיתקשה לגבות הוצאות שייפסקו לו (אם ייפסקו), נדרש-גם-נדרש להוכיח כדבעי כי אופציה זו אינה פתוחה לפניו (ראו למשל בש"א 9998/09 ונדר נ' בנק דיסקונט למשכנתאות בע"מ
(טרם פורסם, 17.12.2009)).
אם כן, לא הוצגה לפניי תשתית עובדתית וראייתית המצדיקה פטור מהפקדת עירבון בהליך זה, ולפיכך הבקשה נדחית. מיותר לציין כי ככל שהמערער יזכה בהליך, או שבית המשפט יימנע מחיובו בהוצאות, יוחזר לו העירבון (בכפוף להיעדר מניעה בדין).
העירבון יופקד אפוא תוך 14 ימים מעת המצאת החלטה זו, שאם לא כן יירשם ההליך לדחייה ללא הודעה נוספת.
