בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת עירבון או להפחתת סכום העירבון.
התנאים למתן פטור (מלא או חלקי) מהפקדת עירבון ידועים ומושרשים, שהרי נקבעו פעמים אין-ספור בפסיקה ומוכרים וודאי לכל עורך-דין. בעל דין המבקש פטור כזה, שמשמעותו חשיפת הצד שכנגד לסיכון כי יתקשה לגבות הוצאות שתפסקנה לזכותו, נדרש להוכיח שני תנאים מצטברים : חוסר יכולת כלכלית וסיכויים טובים להצלחת ההליך. כדי להוכיח את התנאי הראשון, שהוא תנאי-בלעדיו-אין, יש להניח לפני בית המשפט תשתית עובדתית מלאה הנתמכת באסמכתאות מלאות ועדכניות. כדברי כבוד השופט ג'ובראן:
חשוב להדגיש כי מי אשר מבקש שהציבור יממן באופן מלא את ההליך המשפטי בו הוא רוצה לנקוט או מי אשר רוצה לחשוף את בעל הדין שכנגד לסיכון כי יתקשה לגבות הוצאות, עליו נטל ההוכחה לקיומן של התנאים הקבועים בתקנות למתן פטור. המבקש שהקופה הציבורית תישא לבדה בהליכי משפטו צריך לפרוש בפני בית המשפט תשתית עובדתית מלאה ביותר ועדכנית בדבר מצבו הכלכלי בהתאם לדרישת התקנות... בדומה מי אשר רוצה לחשוף את בעל הדין שמנגד לסיכונים עליו לפרט באופן מלא את אפשרויותיו הכלכליות באמצעות תיעוד ומסמכים (בש"א 3675/11 צבעוני נ' עו"ד שמעוני (טרם פורסם, 16.5.2011)).
אכן, "המבקש פטור מהפקדת עירבון צריך לפרוש בפני בית המשפט תשתית עובדתית מלאה ביותר ועדכנית בדבר מצבו הכלכלי ויכולתו לגייס את סכום העירבון" (בש"א 4807/11 מזרחי נ' פקיד שומה פתח-תקוה (טרם פורסם, 29.6.2011)). זאת ועוד, הלכה מושרשת היא כי בבקשה לפטור מעירבון מוטלת על יוזם ההליך החובה להוכיח כי אין באפשרותו לגייס את הסכום הדרוש מקרובים ומידידים. עמד על כך לאחרונה כבוד השופט ג'ובראן, בציינו כי מבקש הפטור:
[נדרש] להוכיח כי לא רק הוא עצמו, לרבות בת זוגו והוריו אם הוא סמוך על שולחנם (ראו תקנה 14 (א) לתקנות האגרות), נעדר יכולת כלכלית, אלא שאף לא עלה בידו להסתייע בסביבתו הקרובה על מנת לגייס את הסכום להפקדה. תכלית המבחן היא להרחיב את הנטל המוטל על יוזם ההליך להבטחת האינטרס של הצד שכנגד, אשר שלא מיוזמתו, נאלץ לשאת בהוצאות של הליך משפטי נוסף. אין מדובר במבחן נוקשה, אלא בכלי נוסף העומד לרשות הרשם בבואו לאזן בין השיקולים המתחרים במסגרת בקשה למתן פטור מהפקדת עירבון: זכותו של מבקש הפטור שלא תיחסם דרכו רק משום שהוא דל באמצעים אל מול ההפסד שעלול להיגרם לצד השני, אם לא יהיה לו ממה לגבות את הוצאותיו (בש"א 6411/11 שני נ' עו"ד חבר, נאמן לנכסי החייב (טרם פורסם, 3.10.2011)).
עיון בבקשה שלפניי מלמד כי יש בה התייחסות כללית לזכות הגישה לערכאות; יש בה גם התייחסות לסיכויי הערעור. דא עקא, שבכל הנוגע לתנאי-הסף שעניינו הוכחת חוסר יכולת כלכלית – אין בבקשה ולו תשתית מינימאלית. כל שנטען בבקשה הוא כי מצבו הכלכלי של המערער קשה, וכי משכורתו אינה מאפשרת לו לעמוד בדרישת העירבון. אלא שהבקשה אינה כוללת פירוט בעניין הנתונים הרלוונטיים בכגון דא, ובהם הוצאות המחייה ורמת החיים של המערער, נכסיו, מצב חשבון הבנק שלו, מצבם המשפחתי של בני המשפחה הקרובים, אופן מימון שכר טרחת עורך-הדין, האפשרות להסתייע בסביבה הקרובה, וכד'. הבקשה אינה נתמכת בתצהיר, וצורפו לה אך ורק תלושי משכורת אחדים (המעלים כשלעצמם תמיהה: על-פי כותרת כתב הערעור שמו של המערער הוא שמלאשווילי אברהם, ומספר תעודת הזהות שלו הוא 029607868; בתלושי המשכורת השם הוא שמלה אבי ומספר תעודת הזהות שונה – 029730504).
אציין בשולי הדברים ולמעלה מן הצריך כי עניינו של הערעור עצמו אינו מצביע לכאורה על בעל-דין נטול משאבים.
ברי אפוא כי אין בבקשה שלפניי כדי לבסס עילה למתן הפטור המבוקש, וזאת אף בלי להביע דעה בעניין סיכויי הערעור. העירבון יופקד תוך 14 ימים מעת המצאת החלטה זו (ימי הפגרה יבואו במניין). בהיעדר הפקדה יירשם ההליך לדחייה. משלא נתבקשה תגובה, אמנע מפסיקת הוצאות בבקשה שלפניי.
