הערעור שבכותרת נסב על ארבע החלטות של בית המשפט המחוזי בתל-אביב במסגרת ת"א 2177/05. ההחלטה הראשונה (מיום 13.12.2010) היא פסק-הדין שדחה את תביעתה של המערערת אשר התבססה על הטענה כי נעליים שייבא המשיב מפרות זכויות קניין רוחני הקנויות לה. ההחלטות האחרות ניתנו לאחר פסק-הדין: שתיים ביום 21.12.2010 ואחת נוספת ביום 28.10.2010. ההחלטות המאוחרות נוגעות בהליכי עיכוב הביצוע שבהם נקטה המערערת לאחר פסק-הדין, וכן בכך שהמערערת נטלה מתיק בית המשפט קמא מוצגים לצורך הגשת הליך בבית המשפט העליון.
השאלה המונחה לפניי היא האם עומדת למערערת זכות ערעור על ההחלטות המאוחרות. לדידי, אין כל ספק כי ההחלטות המאוחרות טפלות לפסק-הדין ומהוות לפיכך "החלטה אחרת" שהערעור עליה טעון רשות. גם המערערת הכירה באפשרות כי לא עומדת לה זכות ערעור על ההחלטות המאוחרות, ולכן ביקשה כי אם בית המשפט יסבור שהערעור לגביהן טעון רשות, תינתן לה הרשות והערעורים יידונו יחדיו. אלא שבהחלטתי מיום 1.3.2011 הבהרתי כי "קיצור דרך" זה אינו יכול לעמוד, וכי ככל שלא קיימת זכות ערעור על ההחלטות המאוחרות, היה על המערערת להגיש בעניינן הליך נפרד מתאים. אפשרתי למערערת להבהיר ולנמק את עמדתה בעניין הדרך הנכונה להשיג על ההחלטות המאוחרות. המערערת בהודעתה מיום 3.3.2011 טענה כי כל אחת מן ההחלטות המאוחרות היא בבחינת "פסק-דין" נוסף הנתון לערעור בזכות. כאמור, טענה זו אינה מקובלת עליי. מדובר בהחלטות טפלות במהותן, ועל כן כל אחת מהן היא "החלטה אחרת" (ראו

אשר על כן, על המערערת להגיש תוך 7 ימים כתב ערעור מתוקן הנסב רק על פסק-הדין מיום 13.12.2010. המזכירות תשיב למערערת את כתב הערעור שהוגש ביום 20.1.2011. המערערת תישא בשכר טרחת עורך-הדין של המשיב 1 בסך של 2,500 ₪.
