בקשה לעיין בתיק בית המשפט
החלטה
לפניי בקשה להתיר עיון בתיק בית המשפט בהליך שבכותרת. נתבקשה התייחסות הצדדים לבקשה זו, אך ההתייחסות היחידה באה מפי המשיבים 1 ו-8, שלא התנגדו לעיון המבוקש. המערער עצמו לא הגיש עמדה ולא עלה בידי המזכירות להמציא לו את הבקשה שכן הלה העתיק את מקום מגוריו. יצוין, כי מדובר בערעור הנוגע בענייני פשיטת רגל, והשאלה שנדונה בפסק הדין היא האם ההפטר שקיבל המערער חל אף לגבי חוב מזונות שצבר.
לאחר שבחנתי את נימוקי הבקשה לעיון בתיק ואת המסמכים שבתיק, הערכתי היא כי מבקש העיון יכול למצוא תשובה לשאלותיו בהחלטות של בית המשפט המחוזי מיום 7.7.2005 (היא ההחלטה נשוא הערעור) ומיום 22.2.2001. שתי החלטות אלה מצויות בתיק. בנסיבות אלה, ובהתחשב בעובדה שבתיק יש גם מסמכים בעלי אופי פרטי, נראה כי מן הראוי לאפשר עיון בשתי ההחלטות האמורות, ובכך, כאמור, נראה כי יבוא המבקש על סיפוקו. מועד העיון במסמכים האמורים יתואם עם המזכירה הראשית של בית המשפט העליון.
