בקשה לעניין הוצאות המשפט
החלטה
עיינתי בתגובת המשיב 1 בהמשך להחלטתי מיום 17.12.2013, וסבורני כי בטענותיו לא עלה בידו ליתן מענה לעובדה שבפסק הדין שניתן בבית משפט זה נקבע מפורשות כי פסק הדין שניתן בבית המשפט קמא בטל, וזאת ללא כל סייג, דהיינו - על כרעיו ועל קרבו.
כך טענותיו של המשיב 1 כי יש ליתן משקל גם ל"גלגוליו" הקודמים של ההליך או כי היה על בית משפט זה ליתן משקל לכך שהבקשה לסילוק הליך על הסף שהגישה המערערת בבית המשפט קמא נדחתה תוך שנקבע כי ההוצאות יילקחו בחשבון בהליך העיקרי, כמו גם טענתו כי יש ליתן משקל למצבו הכספי הקשה, אין בהן כדי לשנות מן הקביעה המפורשת בפסק דינו של בית משפט זה בדבר ביטול פסק הדין קמא.
אשר על כן ובהמשך להחלטתי מיום 17.12.2013 ניתנת פסיקתה כדלקמן:
פסיקתה
בפסק הדין מיום 28.6.2012 נקבע כי פסק הדין של בית המשפט המחוזי בטל, ובכלל זאת בוטל חיובה של המערערת בהוצאות בסעיף 11 לפסק-דינו של בית המשפט המחוזי, והמשיב 1 חויב בהוצאות המערערת בגין שני ההליכים בסך של 35,000 ש"ח.
ניתנה היום, יח' בשבט תשע"ד (19.1.2014).
