בקשה להצטרף להליך
החלטה
ההליך שבכותרת הינו בקשת רשות ערעור מטעם המבקשת – חברה בהליכי פירוק – על פסק-דינו של בית-המשפט המחוזי, אשר דחה ערעור וערעור שכנגד על פסק-דינו של בית-משפט השלום. בפסק-הדין האמור, הוכרעה תביעה כספית שהגישה החברה-המבקשת כנגד החברה-המשיבה בגין עבודות אינסטלציה שבוצעו על-ידה.
לפניי בקשתו של בעל-מניות ובעלים לשעבר של החברה-המבקשת, מר גול ן, להצטרף כצד להליך שבכותרת. מהבקשה עולה כי מר גול ן מבקש להעלות בעצמו טיעונים כנגד פסק-דינו של בית-המשפט המחוזי. בשים לב לכך, נראה לכאורה כי בקשתו של מר גול ן היא להצטרף להליך כמבקש רשות ערעור, בנוסף לחברה-המבקשת.
דין הבקשה להידחות. בתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: תקנות סדר הדין האזרחי ) אין הוראה המאפשרת צירוף מערערים או מבקשים (ראו: רע"א 5727/04 בן עמי נ' ברסלב (לא פורסם, 14.10.2004)). אמת, בית-משפט זה הרחיב במידת-מה את הגדרתו של "בעל-דין", ואיפשר הגשת ערעור בזכות על-ידי מי שזכותו נפגעה בהיותו צד בפועל להליך שהתקיים בערכאה הדיונית. ואולם בכך אין כדי לסייע למר גול ן, שהרי אין המדובר בהליך נפרד מטעמו של מר גול ן, ואף אין מדובר בערעור בזכות כי אם בבקשת רשות לערער. זאת ועוד; מפסק-דינו של בית-משפט השלום עולה כי מר גול ן היה מעורב בהליך שהתקיים שם, ואף העיד מטעם החברה-המבקשת. אין בבקשה שלפניי כל הסבר מדוע לא ביקש מר גול ן להצטרף כצד להליך בערכאה הדיונית (זאת, בלא להביע כל עמדה לעניין בקשה כאמור, לוּ היתה מוגשת, בהתחשב בכך שמדובר בחברה המצויה בהליכי פירוק). אף אין בבקשה שלפניי כל הסבר מדוע האינטרסים של מר גול ן כבעלים לשעבר של החברה-המבקשת המצויה בהליכי פירוק, אינם יכולים להיות מיוצגים על-ידי בא-כוח החברה; ומדוע צירופו של מר גול ן כצד עצמאי להליך שבכותרת מתבקש בשלב כה מאוחר, לאחר שעניינה של התביעה הכספית מטעם החברה-המבקשת כבר נדון בשתי ערכאות. לשם השלמת התמונה אציין כי נוכח הטעמים האמורים, אף אינני רואה מקום להורות על צירופו של מר גול ן כמשיב לבקשת רשות הערעור בהתאם לתקנה 425 לתקנות סדר הדין האזרחי.
אשר על כן, ונוכח מכלול הטעמים האמורים, בקשתו של מר גולן להצטרף כצד לבקשת רשות הערעור נדחית. משלא התבקשה תגובה, אין צו להוצאות.
המזכירות תתייק החלטה זו בתיק השופט שיישב בדין. הטיפול בהליך יימשך כסדרו.
