בקשה לפטור מאגרה וערבון
החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת עירבון.
המשיבה – עיריית פתח-תקווה – הגישה תביעה לסילוק ידו של המבקש ממבנה מסוים (לא מדובר במבנה מגורים). המבקש עתר לסילוק התביעה על-הסף מן הטעם העיקרי שאין לה, למשיבה, כל זכות במקרקעין שעליהם מצוי המבנה. בית משפט השלום דחה את הבקשה לסילוק על-הסף. המבקש הגיש בקשת רשות ערעור אך זו נדחתה על-ידי בית המשפט המחוזי שציין כי תביעתה של המשיבה נסמכת על סעיף 249(29) לפקודת העיריות באופן המקים, על פניו, יריבות בין הצדדים; כי אין למחוק תביעה על-הסף בהתקיים ולו סיכוי קלוש להצלחתה; כי למבקש שמורות כל טענותיו; וכי ערכאת הערעור אינה נוטה להתערב בהחלטות הנוגעות לניהול ההליך, בפרט כשמדובר בהחלטה שמשמעותה בירור ההליך לגופו. כנגד החלטה זו של בית המשפט המחוזי מופנית בקשת רשות הערעור שבכותרת, ובמסגרתה הוגשה הבקשה שלפניי, לפטור מתשלום אגרה ומהפקדת עירבון, כאמור.
אין בידי להיעתר לבקשה.
ראשית, לא הוכח כדבעי – באופן מפורט, מלא ומבוסס – מצבו הכלכלי של המבקש. אמנם, לאור הנתונים החלקיים שלפניי מוכן אני להניח כי מצבו הכלכלי אינו מן המשופרים. עם זאת, אין בידי לקבוע כי הוצגה תשתית עובדתית וראייתית מספקת למתן הפטור המבוקש (ראו בש"א 4807/11 מזרחי נ' פקיד שומה פתח-תקוה (טרם פורסם, 29.6.2011)). לדברי המבקש הוא כעת מובטל ומתקיים מקצבת נכות, אך אין בבקשה תמונה מלאה לגבי עיסוקיו של המבקש בעבר, לגבי נכסים שצבר (נכס מקרקעין, כלי רכב, נכסים כספיים), לגבי מצבם הכלכלי של בני המשפחה הקרובים, לגבי מצב חשבון הבנק, וכד'. המבקש גם אינו מתייחס לאפשרות להסתייע בסביבתו הקרובה, וממילא אינו מצרף מסמכים לעניין זה, כנדרש (ראו בש"א 6411/11 שני נ' עו"ד חבר, נאמן לנכסי החייב
(טרם פורסם, 3.10.2011); בש"א 9998/09 ונדר נ' בנק דיסקונט למשכנתאות בע"מ (טרם פורסם, 17.12.2009)).
מעבר לכך, אציין כי על פני הדברים הסיכוי להתערבותו של בית משפט זה בשאלה המקדמית של סילוק על-הסף – בגדרי הליך ב"גלגול שלישי" – אינו נראה מרשים. אם המבקש חפץ להביא את הסוגיה לבירור נוסף בבית משפט זה, מן הראוי שישלם אגרה ויפקיד עירבון להבטחת הוצאות המשיבה (לעניין אחרון זה אציין כי המבקש – לדברי המשיבה – טרם שילם את ההוצאות שנפסקו לחובתו בבית משפט השלום).
לאור האמור, אך בשים לב לטענות שבבקשה, להיקפו של ההליך ולמעמדם של הצדדים, ראיתי לנכון לילך לקראת המבקש במובן זה שהאגרה תעמוד על סך של 500 ₪, והעירבון על סך של 5,000 ₪. האגרה תשולם והעירבון יופקד תוך 21 ימים מעת המצאת החלטה זו, שאם לא כן יימחק ההליך או יירשם לדחייה, לפי העניין, ללא הודעה נוספת.
