בקשה לפטור מעירבון
החלטה
לאחר שעיינתי בבקשה לפטור מהפקדת עירבון מצאתי כי אין מקום להיעתר לה במלואה.
תחילה אציין כי הבקשה החלופית להפקדת ערבות של צד שלישי (בנם של המבקשים 1-2) חלף עירבון כמוה כבקשה לפטור מהפקדתו, שכן ערבות צד שלישי אינה שוות ערך לעירבון מבחינת וודאותה ונזילותה.
לגופם של דברים המבקשים לא פרשו בבקשתם (הנתמכת בתצהיר של המבקש 1 בלבד) תשתית עובדתית מלאה להוכחת מצבם הכספי. כך לא פירטו הם אילו נכסים בבעלותם ומה סך הוצאותיהם החודשיות (בצירוף אסמכתאות). כן לא הבהירו המבקשים כיצד נושאים הם בעלויות ייצוגם המשפטי; טענתם לפיה בנם הבכור אינו יכול לסייע בידיהם לא הוכחה; וכך גם לא הוכח כי אין באפשרות המבקשים לגייס את העירבון בעזרת בני משפחה אחרים (כגון בנם הצעיר אשר לפי הטענה מסייע להם באופן שוטף) או מכרים.
יחד עם זאת נוכח המצב הכלכלי הנטען, אשר נראה כי אכן אינו מן המשופרים, ובשים לב להיקף ההליך, לכך שלא נפסקו הוצאות בערכאה קמא ולפערי הכוחות בין הצדדים יופחת סכום העירבון ויועמד על סך של 6,000 ש"ח.
