החלטה

הליך זה עניינו בהשגה על החלטת בית המשפט המחוזי (כב' השופט ע' עילבוני, רשם, מיום 3.8.08) שלא להאריך את המועד להגשת ערעור על פסק-דין של בית משפט השלום. במסגרת הליכים מקדמיים לפני, עלתה השאלה אם דינו של ההליך להימחק שכן המ דובר
בערעור על החלטת רשם.

לאחר עיון בחומר שלפני ובטענות בעלי הדין, מסקנתי היא כי אכן יש למחוק את ההליך. ההחלטה נשוא ההליך נחתמה במפורש בכובעו של השופט כרשם. המ דובר אמנם בהחלטה שסיימה את ההליך בשל אי הארכת המועד להגשת ערעור על פסק-דינו של בית משפט השלום, אולם כבר נפסק כי דינה של החלטה מעיין זו כדין "החלטה אחרת" (ראו עע"מ 193/05 אטדגי נ' עמידר בע"מ (לא פורסם, 16.7.05) והאסמכתאות שם; וכן רע"א 10640/04 גיא המוביל באשדוד בע"מ נ' סהר חב' לביטוח בע"מ , פ"ד נט(3) 189). ערעור על החלטה זו היה צריך להיות מוגש אפוא לבית המשפט המחוזי. הטעם לכך שההליך הוגש לבית משפט זה על-ידי המבקש מקורו כעולה מעמדתו בטעות, ואולם בנתון זה אין כדי ליצור סמכות עניינית לדון בהליך זה.

במצב דברים זה, דין ההליך להימחק. ודוק: ער אני לבקשתו החלופית של המבקש, והיא להעביר ההליך לבית המשפט המחוזי על מנת שידון שם. המשיבה התנגדה להעברה זו שכן יהא בכך מתן ארכה להגשת הערעור בבית המשפט המחוזי, בלא הצדקה לכך. הכרעתי בנדון היא כי אין בנסיבות המקרה מקום להעביר ההליך לבירור בבית המשפט המחוזי לפי סעיף 79(א) לחוק בתי המשפט [נוסח משולב], תשמ"ד-1984. משעה שהמ דובר בערעור בזכות על החלטת רשם, יכול וההליך אפילו לבית משפט זה הוגש באיחור, לא כל שכן לבית המשפט המחוזי. בנסיבות אלו, אין מקום להעביר את הבקשה לרשות ערעור לבית המשפט המחוזי (ראו עוד, רע"א 10640/04 הנזכר).

התוצאה היא, כי דין הבקשה לרשות ערעור, להימחק. אשר לעניין ההוצאות, הרי שנראה כי למרות פגמים מסוימים בהמצאת כתבי בי דין, אין מקום לפסיקת הוצאות בשל עניין זה בלבד. אולם בשל קבלת הבקשה למחיקת ההליך, והטורח שנגרם למשיב בשל השגגה בהגשתו לבית משפט זה, ישאו המבקשים בשכר טרחת עורך-דין של המשיב בסך של 1,500 ₪. סכום זה ישא הפרשי ריבית והצמדה כדין מיום ההחלטה ועד התשלום בפועל. הערבון שהופקד יחולט בגובה שכר הטרחה והיתרה תושב למבקשים בכפוף לבדיקת המזכירות כי אין לכך מניעה בדין.
