החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת ערבון בהליך שבכותרת.

ההליך נסוב על החלטתו של בית המשפט המחוזי בחיפה בתיק פשיטת רגל של המבקש. ההחלטה ניתנה במסגרת בקשה שהגישה המבקשת בתיק פשיטת הרגל, בה התבקש בית המשפט להורות למשיבה 3 להימנע מביצוע הוראה בגזר דין שניתן לחובת המבקש בהליך אחר, ובו הוטל עליו קנס כספי בסך 1.6 מליון ₪ או שנת מאסר תמורתו. המבקש ביקש כי משיבה 3 לא תפעיל את עונש המאסר כנגד אי תשלום הקנס, כל עוד צו כינוס הנכסים של המבקש בתוקף. בית המשפט קמא קבע כי הקנס הוטל לאחר שניתן צו לכינוס נכסי המבקש, ולכן הקנס אינו חוב בר תביעה בהליך פשיטת הרגל. בית המשפט לא ראה מקום להורות למשיבה 3 שלא לבצע את המאסר בגין אי תשלום הקנס, ובד בבד לאפשר למבקש שלא להפקיד את סכום הקנס בקופת פשיטת הרגל. על כן, נקבע כי אם המבקש יפקיד בקופת בית המשפט את סכום הקנס (עד ליום 2.5.08) תימנע משיבה 3 מלאוסרו בגין אי תשלום הקנס. בית המשפט הוסיף וקבע כי ככל שיופקד הסכום, הוא יידרש לשאלה אם הסכום יועבר לתיק פשיטת הרגל או לאוצר המדינה.

בבקשה שלפניי טוען המבקש כי הינו יושב במאסר החל מיום 15.1.04 וכי משנת 2000 הינו פושט רגל. לטענת המבקש אין בידו אמצעים כספיים לשלם האגרה הדרושה או להפקיד ערבון, וגם קרוביו אינם יכולים לסייע בכך. לדבריו, גם אין לו כל רכוש, חסכונות או הכנסות. משיבה 3 הודיעה כי נוכח מצבו הכלכלי של המבקש,
העולה מתצהירו, אין היא עומדת על תשלום אגרה או הפקדת ערבון. משיב 2 סבור כי הבקשה במתכונתה הנוכחית אינה בשלה לדיון שכן היא אינה מניחה תשתית עובדתית בדבר מצבו הכלכלי של המבקש. משיב 2 מוסיף וטוען, כי רק לאחר השלמת הפרטים הנחוצים, יוכל לגבש עמדתו לבקשה. משיב 1 מצטרף לעמדה זו.

לאחר שעיינתי בעמדות בעלי הדין ובחומר המצוי בתיק, נחה דעתי כי יש להיעתר לבקשה באופן חלקי. לעניין האגרה, משהסכימה המדינה לפטור את המבקש מאגרה, ובשים לב לנטען בבקשה, ניתן בזה פטור מתשלום אגרה, כמבוקש. מכאן לעניין הערבון. מבחינת פורמאלית נשלט ההליך שבכותרת על-ידי סדרי הדין האזרחיים. על פי סדרי דין אלה, הגשת בקשה לרשות ערעור טעונה הפקדת ערבון (תקנה 404 לתקנות סדר הדין האזרחי, התשמ"ד-1984). יחד עם זאת, ההליך נושא בחובו סממנים פליליים ניכרים. אמנם, בניגוד להליכים אחרים בעלי אופי "מעורב" אין המדובר בהליך הנשלט על-ידי הדין הפלילי, אך לצורך הערעור נקבע כי הדרך לערער עליו היא בדרך שמערערים על החלטה בעניין אזרחי, כדוגמת ערעור על חילוט אזרחי במסגרת חוק איסור הלבנת הון או ערעור על חיוב בתשלום פיצויים לקורבן בעבירה במסגרת חוק העונשין, התשל"ז-1977. הליך זה נשלט כולו, כך נראה, על-ידי סדרי הדין האזרחיים הנהוגים בהליכי פשיטת רגל. יחד עם זאת, לא ניתן להתעלם מכך שמבחינה מהותית יש להליך היבטים פליליים כבדי משקל, שהרי הוא עוסק בהפעלת עונש מאסר שנגזר על המבקש בעקבות אישום פלילי.

המדיניות המקובלת לגבי מקרים בהם מעורב יסוד פלילי בהליך האזרחי היא לייתן למהותו המיוחדת של ההליך משקל לא מבוטל בכל הנוגע לקביעת הערבון (ראו, ע"א 6702/04 בומעה מאזן נ' מדינת ישראל (לא פורסם, 9.4.04); רע"א 4096/04
שלמה בוטח נ' מדינת ישראל פרקליטות מיסוי וכלכלה ת"א , פ"ד נט(1) 913; ע"א 5942/06 שלמה בוטח נ' מדינת ישראל (טרם פורסם, 5.12.06)). חשיבות אופייו המיוחד של ההליך נעוצה בכך שלעיתים מאופי ההליך ניתן להסיק כי בית המשפט ימנע מלהטיל הוצאות על יוזמו, אף אם ההליך ייכשל (ראו, ע"א 10319/06 נורדן נפטר (1998) בע"מ נ' מדינת ישראל (לא פורסם, 1.4.07)). במקרים אלה, בשים לב לכך שתכלית הערבון היא להבטיח כי אם ייפסקו הוצאות תהייה למשיב אפשרות לגבותן באופן זמין וודאי, אין הצדקה לחייב את יוזם ההליך בהפקדת ערבון. למצער ניתן להסתפק בערבון נמוך.

נמצא כי בהליכי "כלאיים" הנושאים אופי מעורב אזרחי ופלילי, אליהם משתייך גם ההליך שלפניי, ראוי להפחית את סכום הערבון יחסית למקובל בערעורים אזרחיים (טהורים), בשל עצם טיבו של ההליך. לכך מתווספות, במקרה דנן, גם טענותיו הפרטניות של המבקש בעניין מצבו הכלכלי. אכן, פרט לדיון העקרוני בשאלה כיצד משליכה מהות ההליך על החובה להפקיד ערבון, יש לבחון גם את טענות יוזם ההליך כי אין באפשרותו להפקיד ערבון מפאת עוניו. עיון בבקשה אכן מעלה תמונה של קושי כלכלי. זאת במיוחד בשים לב לכך שהמבקש נתון בהליכי פשיטת רגל ובמאסר מזה תקופה מ מוש כת. יחד עם זאת, לא ניתן להתעלם מכך שהבקשה חסרה אסמכתאות כלשהן לעניין מצבו הכלכלי של המבקש. בשים לב לכלל נסיבות העניין, ובכלל זה לאופיו הייחודי של ההליך, לעמדות המשיבים ולמצבו הכלכלי הנטען של המבקש, יועמד הערבון על סך של 2,000 ש"ח אשר נוכח תגובת המשיבה 3, יבטיחו את הוצאותיהם של משיבים 1 ו-2 בלבד. הערבון יופקד תוך 21 יום מעת המצאת החלטה זו, ולא – יירשם ההליך לדחייה ללא צורך במתן הודעה נוספת.
