ערעור על החלטת הרשמת ל' בנמלך (ע"א 512/14 – א') מיום 9.2.2014, במסגרתו דחתה את בקשת המערערת לפטור מהפקדת עירבון.

המערערת הגישה לבית משפט זה ערעור על החלטת בית המשפט השלום בתל אביב-יפו (השופטת ר' גרינברג ) שלא לפסול עצמו מלדון בערר שהגישה על פי חוק נכי רדיפות הנאצים, התשי"ז-1957 (להלן: חוק נכי רדיפות הנאצים ). יחד עם הערעור הגישה "הודעה" (שהיא למעשה בקשה) שיש לפטור אותה מהפקדת עירבון בהליך זה, כיוון שערעור פסלות דומה להליך פלילי וכן משום שהליך על פי חוק נכי רדיפות הנאצים פטור מתשלום אגרה.

הרשמת דחתה את הבקשה, בציינה כי אין הוראת דין המקנה פטור מהפקדת עירבון בערעור פסלות, ואף לא בערעור פסלות המוגש על החלטה שנתקבלה במסגרת הליך המתנהל על פי חוק נכי רדיפות הנאצים. עוד הוסיפה הרשמת כי גם הליך ערעורי רגיל לפי חוק נכי רדיפות הנאצים אינו פטור מהפקדת עירבון, שתכליותיו שונות מתכלית תשלום האגרה. בנסיבות המקרה עמדה הרשמת על כך שהעירבון הועמד על סכום מתון (3,000 ש"ח), המערערת לא טענה לחוסר יכולת כלכלית וכי על פני הדברים סיכויי הערעור נמוכים ביותר.

מכאן הערעור שלפניי, במסגרתו המערערת, באמצעות באת כוחה, שבה וטוענת כי אין מקום להפקדת עירבון בערעור פסלות בשל דמיונו להליך פלילי והיותו "מאושיות ההליך המשפטי", ומוסיפה כי כיוון שהמדינה היא המשיבה גם כן "אין לדרוש הפקדת ערבון!". עוד טוענת באת כוח המערערת כי המערערת חסרת יכולת כלכלית, וסובלת מבעיות רפואיות רבות, וכן כי הפטור מהאגרה בצירוף חשיבות ההליך המשפטי, מחייבים את מתן הפטור מהפקדת עירבון. באשר לסיכויי ההליך טוענת באת כוח המערערת כי "ההליך אינו חסר סיכוי כלל וכלל ב"כ המערערת גרה בשכנות לשופטת גרינברג, ולמדה בבתי-הספר עם בתה, גם בתנועת הצופים וגם בחוג באלט השתתפה איתה. אין בדבר כל פגיעה בצד כלשהו, או מסקנות נוספות מלבד האמור. אבקש לציין, כי במקרה דומה נפסק כי היה עליה לפסול את עצמה" (פסקה 8 לערעור). יצוין כי הערעור הוגש לא במועדו, ולמרות שלא ניתנה כל אסמכתה לטענות באת כוח המערערת לעניין זה, אישר הרשם ג' שני , לפנים משורת הדין, את הגשת הערעור (בש"א 4163/14 – א', מיום 19.6.2014).

דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשמת. כידוע, שיקול דעתה של הרשמת רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012); בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013)) .

הטענות הכלליות מפי באת כוחה של המערערת, לפיהן אין לבקש הפקדת עירבון בערעור פסלות או כאשר המדינה היא המשיבה, דינן להידחות. באת כוח המערערת לא הצביעה על כל מקור בדין לטענות אלה. אעיר שאף אם באופן כללי, בערעורים לפי חוק נכי רדיפות הנאצים הנטייה תהיה לקבוע עירבון מופחת ואף לפטור מהפקדתו, אין אנו עוסקים בערעור על החלטה לפי חוק זה, אלא בערעור על החלטה של בית המשפט שלא לפסול עצמו בעת שהוא דן בערר לפי חוק זה. אני סבור שבאופן כללי ראוי בעניין זה, בעיקר בשל סיכויי ההליך הנמוכים עד מאוד, להורות על הפקדת עירבון, גם אם בסכום מתון לנוכח אופי ההליך העיקרי (ראו והשוו: ע"א 1021/08 אבירם נ' הרשות המוסמכת לפי חוק נכי רדיפות הנאצים , פסקאות 4-3 להחלטת הרשמת (כתארה אז) ג' לוין
(24.2.2008)).

בנסיבות המקרה אני סבור כי אכן נקבע עירבון מתון ביותר. להכרעה כי אין מקום להפחית ממנו הגעתי אך ורק על בסיס סיכויי ההליך, תוך שהנחתי לטובת המערערת כי היא נעדרת מסוגלות כלכלית (אף שהדבר לא הוכח, ועל כך בהמשך). לעניין זה אציין כי לאחר שהתקיים הדיון בעניינה של המערערת בבית משפט השלום, ולאחר שניתנה החלטה בעניינה שעיקרה הפנייתה לסיוע המשפטי שליד משרד המשפטים, על אף שהייתה מיוצגת, ביקשה באת כוחה לטעון טענת פסלות. ייתכן, ואומר זאת במלוא הזהירות, כי ההחלטה גופה לא נשאה חן בעיני באת כוחה אך מטרתה, כפי שהבהיר בית המשפט, הייתה לסייע למערערת. לגופו של עניין טענה באת כוח המערערת כי "אני חושבת שאני מכירה את ביתה של השופטת ששמה גלית" (עמ' 2, שורה 13 לפרוטוקול הדיון מיום 13.1.2014). השופטת קבעה בהחלטתה מושא ההליך העיקרי כי "אין כל היכרות מוקדמת ביני לבין עורכת הדין ואין לי בת בשם שהיא הזכירה" (שם, בשורה 18) ודחתה את הבקשה. עתה, בערעור הפסלות וגם בערעור שלפניי הרחיבה באת כוחה של המערערת וטענה שלמדה עם בתה של השופטת בבית הספר היסודי, בבית הספר התיכון, במסגרת תנועת "הצופים" ואף בחוג באלט. אין אלא לתמוה שהיכרות ענפה כזו לא עלתה מפי באת כוח המערערת בתחילת הדיון. אין ספק גם שהכרות כה אינטנסיבית הייתה צריכה להיות זכורה לשופטת. תמהני אם כן באשר לתזמון טענת באת כוח המערערת, שבאה לעולם רק עם קבלת החלטה של בית המשפט. לטעמי די בציטוטים האמורים ובתמיהות שעולות מהם, יחד עם אמת המידה הנהוגה בשיטתנו לעניין בקשות לפסלות שופט לגופן, שהיא "חשש ממשי אובייקטיבי למשוא פנים", כדי לעמוד על סיכוייו הנמוכים מאוד של ההליך העיקרי (ראו והשוו: בש"א
2989/13 זמירי נ' לבלזון (22.5.2013)). אעיר כי אף לערעור פסלות שעניינו ההחלטה הדיונית גופה סיכויים נמוכים מאוד (ראו: יגאל מרזל דיני פסלות שופט 175 (2006)).

טרם סיום אציין כי ספק בעיני אם היה מקום לקבל לרישום את הערעור, שהוגש כזכור על ידי עורכת דין, כפי שהתקבל. מדובר בכתב בית דין (והדבר נכון גם לגבי כתבי בית דין אחרים שהגישה בתיק העיקרי ובערעור זה) נטול תאריך, כתוב בכתב יד וללא אסמכתות. אופן זה של הגשת כתבי בית דין מעכב ואף מונע לעיתים את הטיפול היעיל בעניינה של המערערת. ויודגש, באת כוחה של המערערת פועלת שלא על פי תקנות סדר הדין האזרחי, התשמ"ד-1984 והנחיות נשיאת בית המשפט העליון שמפורסמות באתר הרשות השופטת, וכאשר הדברים מוסברים לה על ידי מזכירות בית המשפט והרשמים, בוחרת היא להתנצח בעניינים אלה עימם.
עניין זה אינו פורמאלי וטכני בלבד. באת כוח המערערת טענה טענות כלליות בדבר מעמדה של טענת הפסלות, כללים לפטור מהפקדת עירבון ושאלות של פסלות שופט, לכל אלה לא הביאה ולו אסמכתה אחת (ויוער כי לא בכדי, כיוון שלטענות אין בסיס). גם לעניין מצבה הכלכלי והרפואי של המבקשת, עוגן חשוב במסגרת הבקשה לפטור בעירבון, לא הוצגו בבקשה או בערעור מסמכים או אסמכתות רלוונטיים, כפי שנדרש.
באת כוח המערערת תודיע עד ליום 13.7.2014 מדוע אין מקום לחייב אותה בהוצאות לטובת אוצר המדינה לנוכח האמור לעיל.

סוף דבר, הערעור נדחה. המערערת תפקיד את העירבון שנקבע עד ליום 13.7.2014. לא תעשה כן, יירשם ההליך לדחייה ללא הודעה נוספת.
