לפניי בקשה להארכת המועד להגשת בקשת רשות ערעור על פסק-דין של בית המשפט המחוזי בבאר שבע, שניתן במעמד הצדדים ביום 27.6.2012, ואשר בו נדחתה עתירתו של המבקש כנגד החלטת ועדת השחרורים.
מעיון בבקשתו של המבקש – בקשה שאינה נתמכת בתצהיר ואשר הוגשה 18 ימים לאחר שחלף המועד להגשת ההליך – עולה כי הטעם לכך שלא הוגשה בקשת רשות הערעור במועד הקבוע לכך בדין הוא "טעות ותוך סברה כי המועד להגשת בקשת רשות ערעור זו הינו 30 ימים".
המשיב הגיש תגובה שבה הוא מתנגד למתן הארכה המבוקשת.
לאחר עיון בבקשה ובתגובה באתי לכלל מסקנה כי דין הבקשה להידחות. הכלל הוא שגם בהליכים מסוג זה יש להקפיד על קיום המועדים הקבועים בדין (גם אם אמת המידה למתן ארכה דווקנית פחות). אין ללמוד מן הבקשה, כלל וכלל, מהם המאמצים שנעשו כדי למנוע את האיחור בהגשת ההליך, ויובהר כי אין המדובר בדין חדש או בלתי-מוכר. אדגיש כי מדובר בבעל-דין מיוצג, וכי הטענה בעניין הטעות הועלתה בכלליות רבה. די באמור לעיל כדי לדחות את הבקשה אף בלי להידרש לסיכויי ההליך, אך למעלה מן הצורך אציין כי המשוכה הניצבת לפני המבקש גבוהה, וכי לא מדובר בפעם הראשונה שעניין שחרורו של המבקש נדון בערכאות השונות, לרבות
בבית-משפט זה (ראו רע"ב 6083/07 וכן רע"ב 6041/08).
סוף דבר: הבקשה נדחית.
