בפניי בקשה להארכת מועד להגשת בקשת רשות ערעור על פסק-דין של בית המשפט לעניינים מנהליים בנצרת, מיום 16.9.2012, בה דחה את עתירתו של המבקש כנגד החלטת ועדת השחרורים שלא לדון בבקשתו לשחרור מוקדם בשל העובדה שבשלב זה הוא מרצה עונש מאסר חלף קנס.
פסק-הדין של בית המשפט לעניינים מינהליים ניתן כאמור ביום 16.9.2012, בהיעדר הצדדים. בבקשה מיום 31.10.2012 ציין בא-כוחו של המבקש כי ההחלטה מעולם לא הומצאה לידיו, וכי המבקש הודיע לו עליה רק ביום 10.10.2012. עוד טוען המבקש כי מצבו הכלכלי אינו טוב והוא התקשה בהשגת מימון לשכירת ייצוג משפטי, וכן הוא מדגיש את חשיבות הסוגיה שבמוקד ההליך, ומטעמים אלו הוא עותר לארכה של שבוע נוסף להגשת בקשת רשות הערעור.

המשיבה מתנגדת לבקשה. לטענתה הבקשה אינה מבססת קיומו של "טעם מיוחד" למתן ארכה להגשת בקשת רשות הערעור, אותה היה על המבקש להגיש לטענתה בתוך 30 ימים. המשיבה מוסיפה כי למרות שהמבקש מודה כי ידע אודות פסק הדין כבר ביום 10.10.2012 הגיש את הבקשה למתן ארכה רק למעלה משבועיים לאחר מכן, ועוד היא מוסיפה כי סיכויי ההליך קלושים.

לאחר שעיינתי בטענות הצדדים ובחומר שבפניי החלטתי להיעתר לבקשה למתן ארכה.
בקשת רשות לערער על פסק דין של בית המשפט לעניינים מנהליים בעתירה המוגשת נגד החלטת ועדת השחרורים יש להגיש בתוך 15 ימים (ראו: תקנות 21יא-21יב לתקנות בתי משפט לעניינים מינהליים (סדרי דין), תשס"א-2000); בשג"ץ 1560/10 אל קאדר נ' ועדת השחרורים כלא איילון , לא פורסם (21.3.2010)). עיון באתר "נט המשפט" מלמד כי אכן אין כל אישור מסירה של פסק הדין נשוא ההליך לידי המבקש או בא-כוחו, ועל כן יש לצאת מנקודת הנחה כי נודע למבקש אודותיו רק ביום 10.10.2012. ואולם, גם על פי הנחה זו הבקשה, שהוגשה כאמור רק ביום 31.10.2012, הוגשה באיחור של מספר ימים.
המשיבה ציינה כאמור כי המבקש לא העלה בבקשתו כל "טעם מיוחד" המצדיק איחור זה. ואולם, דומה כי אמת המידה לבחינת הבקשה שבפניי אינה קיומו של "טעם מיוחד", אלא קיומו של טעם סביר המניח את הדעת לאיחור בהגשת ההליך
(השוו בשג"ץ 8931/11 צאפאנא נ' מדינת ישראל (טרם פורסם, 11.1.2012)). מכל מקום, במקרה דנן ראוי ליתן משקל לעובדה שפסק הדין לא הומצא לידי בא-כוח המבקש. כן יש ליתן משקל למהות ההליך, לעובדה שלטענת המבקש העיכוב בהגשת הבקשה נבע מקשיים כספיים בהם הוא נתון וכן לעובדה שהמבקש שוהה בבית האסורים (השוו בשג"ץ 3923/12 אסלם נ' שירות בתי הסוהר (לא פורסם, 10.6.2012)). לכך יש להוסיף כי לאחר שעיינתי בחומר שבפניי סבורני - מבלי שאביע כל עמדה לגבי סיכויי ההליך לגופו - כי על פני הדברים אין לחסום את דרכו של המבקש לבירור טענותיו בבית משפט זה.
אשר על כן, הבקשה מתקבלת. ממילא נתייתרה בקשתו של המבקש להגשת תשובה לתגובת המשיבה.
המבקש רשאי להגיש בקשה למתן רשות ערעור בתוך שבעה ימים ממועד המצאת החלטה זו, וככל שיגיש בקשה מתאימה יציין את דבר הארכה בפתח ההליך ויצרף החלטתי כנספח.
המזכירות תעביר את ההחלטה לידי הצדדים, ללא דיחוי , באמצעות הפקסימילה, ולאחר שייפתח הליך מתאים תתייק את ההחלטה בתיק השופט.
