ביום 17.6.2013 הגיש העורר ערר על החלטת בית המשפט המחוזי בבאר-שבע מיום 9.5.2013 בה הורה על מעצרו ועל מעצרם של חמישה נאשמים נוספים עד לתום ההליכים בהמשך להגשתו של כתב אישום בו מיוחסות להם (ולשניים נוספים) עבירות על רקע חברותם הנטענת בארגון פשיעה.
הערר נקבע לדיון ליום 20.6.2013 בפני כב' השופט ג'ובראן, אך ביום 18.6.2013 הגישה המשיבה בקשה למחיקתו על הסף בשל איחור בהגשתו, ובתגובה לבקשה זו הגיש העורר בקשה להארכת מועד. נוכח האמור בוטל מועד הדיון, והבקשות הועברו לעיוני (החלטת כב' השופט ג'ובראן מיום 19.6.2013).

עיון בתיק מלמד כי הערר, אשר הוגש כאמור ביום 17.6.2013, אכן הוגש באיחור שכן תמצית ההחלטה ניתנה ביום 9.5.2013 במעמד הצדדים ובא-כוח העורר ציין כי עותק מלא של ההחלטה הומצא לו ביום 11.5.2013 (ומכאן כי המועד האחרון להגשת הערר חלף ביום 10.6.2013 - סעיף 53(ג) לחוק סדר הדין הפלילי (סמכויות אכיפה - מעצרים), תשנ"ו-1996)). למעשה בבקשה להארכת מועד שהגיש העורר אין הוא חולק על כך והוא טוען כי האיחור בהגשת ההליך נגרם מחמת עומס עבודה בו הוא נתון והוסיף כי בשל "תקלה חמורה" לא הגיש יחד עם הערר בקשה להארכת מועד להגשתו.
המשיבה השאירה את הבקשה להארכת מועד לשיקול דעת בית המשפט, ובנסיבות העניין מצאתי להיעתר לה. בהקשר זה לקחתי בחשבון, בין היתר, את מהות ההליך (ערר בזכות על החלטה לעצור את העורר, אשר בשלב זה עומדת לו חזקת החפות, עד לתום ההליכים); את העובדה שאף שמשך האיחור אינו זניח אין הוא ארוך מאוד; ונוכח הקושי לבחון בשלב מקדמי זה את סיכוייו של הערר בו משיג העורר על הקביעה בדבר קיומן של ראיות לכאורה נגדו (השוו בש"פ 2000/10 מזרחי נ' מדינת ישראל , פסקה 5 (25.3.2010)).
נוכח משקלם המצטבר של שיקולים אלו ובשים לב לעמדת המשיבה ניתנת לעורר, בדיעבד, ארכה להגשת הערר, והטיפול בו יימשך כסדרו.
המזכירות תעביר את התיק ללשכת כב' השופט ג'ובראן.
