החלטה
בפניי ערר על החלטת בית המשפט המחוזי בבאר-שבע (כבוד השופטת ר' ברקאי ) בתיק ב"ש 20981/08 מיום 15.7.2008, לפיה הוארך מעצרו של העורר עד תום ההליכים המשפטיים המתנהלים נגדו; וכן בתיק ב"ש 21668/08 מיום 26.8.2008 (כבוד השופט א' ואגו ), לפיה נדחתה בקשתו של העורר לעיון חוזר.
כנגד העורר הוגשו לבית המשפט המחוזי בבאר-שבע שני כתבי אישום, המייחסים לו שתי עבירות של אינוס, לפי סעיף 345(א)(1) לחוק העונשין, התשל"ז-1997 (להלן: חוק העונשין ); מספר עבירות של תקיפה הגורמת חבלה ממשית בנסיבות מחמירות, לפי סעיפים 380 ו-382(ג) לחוק העונשין; עבירה של חבלה חמורה, לפי סעיפים 333 ו-335(א)(1) לחוק העונשין; עבירה של מעשים מגונים, לפי סעיף 348(ג) לחוק העונשין; ומספר עבירות של פגיעה בפרטיות, לפי סעיפים 2(4) ו-5 לחוק הגנת הפרטיות, התשמ"א-1981.
לפי הנטען באישום הראשון, במהלך קיום יחסי מין בין העורר למתלוננת 2 שהחלו בהסכמה, עמה היה לו קשר רומנטי מורכב ומסובך, ביקשה זו האחרונה מהעורר להפסיק את קיום יחסי המין, אך הלה לא הפסיק את מעשיו עד אשר הגיע לסיפוקו המיני. בהזדמנות אחרת העורר הפשיט את המתלוננת 2 כאשר ישנה והחדיר את אביר מינו לאיבר מינה, וזאת ללא הסכמתה. המתלוננת 2 התעוררה והתנגדה אך העורר לא הפסיק את מעשיו עד אשר סופק מינית. כמו כן, במהלך הקשר בין השניים, פירסם העורר צילומים של שניהם מקיימים יחסי מין ברבים, בנסיבות אשר ביזו את המתלוננת 2.
לפי הנטען באישום השני, העורר תקף את שתי המתלוננות והיכה אותן בכל חלקי גופן וגרם להן חבלות של ממש. בהזדמנות אחרת, נגע העורר בישבנה ובחזה של המתלוננת 1, אחותה של המתלוננת 2, בעת שישנה, וזאת ללא הסכמתה. המתלוננת התעוררה והדפה את העורר בחוזקה עד שהשתחררה ממנו.
בד בבד עם הגשת כתבי האישום, הוגשה לבית המשפט בקשה למעצרו של העורר עד תום ההליכים המשפטיים המתנהלים נגדו. ביום 2.6.2008 קבע בית המשפט (כבוד השופטת ר' ברקאי ) כי כנגד העורר קיימות ראיות לכאורה והעבירות המיוחסות לו מעידות על המסוכנות הרבה הנשקפת ממנו, וכי קיימת עילת מעצר עד תום ההליכים כנגדו. עם זאת, הוסיף בית המשפט שלאור הכרסום הראייתי ביחס לעבירות האינוס, יש לבחון חלופה למעצרו של העורר בסיוע שירות המבחן. ביום 15.7.2008 החליט בית המשפט להורות על מעצרו עד תום ההליכים של העורר, לאחר שדחה מספר חלופות מעצר אשר הוצעו על ידי בא כוחו. על החלטה זו הוגשה בקשה נוספת לעיון חוזר על ידי העורר אשר נדחתה על ידי בית המשפט. ביום 24.8.2008 הוגשה בקשה לעיון חוזר לבית המשפט לאפשר את יציאת העורר לחלופת מעצר בישיבת "מוסדות נחלת צבי" בירושלים. ביום 26.8.2008 בית המשפט (כבוד השופט א' ואגו ) דחה את הבקשה לאור העובדה
שלמוסד המ דובר אין מנגנון פיקוח מסודר המבטיח את הישארות העורר במוסד במשך כל שעות היממה. בית המשפט קבע שבהיעדר חלופת מעצר מתאימה, יישאר העורר במעצר עד תום ההליכים.
מכאן הערר שבפניי.
לטענת בא כוח העורר, מאז ההחלטה שניתנה על ידי בית המשפט המחוזי ביום 2.6.2008, נוספה ראיה חדשה לתיק, עדותה של דודתן של המתלוננות, אשר יש בה כדי לכרסם משמעותית, אם לא לאיין בכלל, בחומר הראיות כנגד העורר. לעניין חלופת מעצר, טוען העורר כי שגה בית המשפט המחוזי משקבע, כי חלופת המעצר שהוצעה אינה ראויה, שכן יש בהסדרי הפיקוח בישיבת "מוסדות נחלת צבי" בכדי לאיין את המסוכנות הנשקפת מן העורר.
מנגד, סומכת באת כוח המשיבה את ידיה על החלטת בית המשפט המחוזי ועל נימוקיו. לטענתה, מדובר במקרה בו ישנן ראיות מוצקות כנגד העורר. לדעת המשיבה אין בחלופות המעצר שהוצעו על ידי העורר כדי לאיין את המסוכנות הנשקפת ממנו.
לאחר ששמעתי את טיעוני הצדדים ולאחר שעיינתי בהודעת הערר ובהחלטתו של בית המשפט המחוזי ובתיק החקירה, הגעתי לכלל מסקנה, כי דין הערר להדחות.
העורר טוען שיש בעדותה של דודתן של המתלוננות במשטרה, אשר לא זכתה להתייחסות בבית המשפט דלמטה, לפיה רקמו המתלוננת 2 ובן דודה מזימה להפלילו ולהתנקם בו, בכדי לכרסם במשקל הראיות העומדות בבסיס האישום בעבירות האינוס. אך כידוע, בית המשפט הבוחן את קיומן של ראיות לכאורה לשם גיבושה של עילת מעצר, אינו נדרש, אלא לבחון האם די בראיות אשר הובאו בפניו, באם תוכחנה במהלך המשפט, כדי להוכיח את אשמת העורר מעבר לכל ספק סביר (ראו בש"פ 8087/95 זאדה נ' מדינת ישראל , פ"ד נ(2) 133, 148 (1996)). בית המשפט אינו נדרש, בשלב זה, לבחינת מהימנותן של האמרות המובאות בפניו, או לבחינת משקלן האפשרי של הראיות שבפניו ואת דיותן לביסוס ההרשעה (ראו בש"פ 1572/05 זוארץ נ' מדינת ישראל (לא פורסם, 10.4.2005). כנגד עדות הדודה עומדת עדותה של המתלוננת 2 ובחינת מהימנותן של העדויות השונות היא עניין לבחינת בית המשפט לפניו יתנהל המשפט.
לעניין חלופת המעצר, במקום אחר עמדתי על כך שאחד השיקולים המנחים להורות על חלופת מעצר הוא, היעדר עוצמה מספקת של הראיות הלכאוריות כדי להצדיק מעצר בפועל, שאז ניתן להסתפק בחלופת מעצר. (ראו בש"פ 6955/05 לולחי נ' מדינת ישראל (לא פורסם, 25.7.2005)). עם זאת, בכל הנוגע לאפשרות שחרורו של העורר לחלופת מעצר איני מוצא מקום לסטות מהחלטתו של בית המשפט המחוזי. אף אם נחלשה עוצמת הראיות הנוגעות לכתב האישום הראשון כנגד העורר, לאור פסיפס הראיות לכאורה העומדות כנגדו בכתב האישום השני, החמור לכשעצמו, ישנה עדיין סכנה גבוהה הנשקפת מן המשיב להישנות התנהגותו האלימה כלפי המתלוננות, והמתלוננת 2 בפרט. תסקיר שירות המבחן, אשר עמד לפני בית המשפט המחוזי, הדגיש כי העורר נוטה לפעול באופן אימפולסיבי וללא שיקול דעת וכי מערכת היחסים שלו עם המתלוננת 2 לוותה בקנאה ואובססיביות, המגבירות את הסכנה להתנהגות אלימה מצדו. לאור כל זאת, בית המשפט המחוזי בחן כראוי את טיב חלופת המעצר בישיבת "מוסדות נחלת צבי", ומצא שהפיקוח במוסד זה לא יוכל למנוע מהעורר לאתר או ליצור קשר עם המתלוננת 2 בדרגה סבירה של ודאות.
יתרה מזו, כבר בהחלטתו מיום 2.6.2008 מצא בית המשפט המחוזי שישנו כרסום בראיות בנוגע לאישום באונס. אך יחד עם זאת, בית המשפט המחוזי בהחלטתו מיום 15.7.2008 קבע, תוך שאיזן כראוי בין אינטרס הציבור לעניינו של הפרט במקרה שלפניי, שאין בחלופות המעצר המוצעות בכדי לאיין את המסוכנות הנשקפת מן העורר.
סוף דבר, לא מצאתי מקום להתערב בהחלטתו של בית המשפט המחוזי.
אשר על כן, הערר נדחה.
