החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת ערבון בהליך שבכותרת ולאיחוד הדיון בו עם ערעורים אחרים התלויים ועומדים בבית משפט זה.

ההליך נסב על פסק דין של בית המשפט המחוזי בתל אביב-יפו (מיום 18.2.2009) אשר הכריז על המערערת פושטת רגל, בהתאם להחלטה שהתקבלה באסיפת הנושים וחרף התנגדותה של המערערת להכרזה זו. בבקשה שלפניי נטען כי מצבה הכלכלי של המערערת בכי רע. לטענתה, היא מתקיימת מקצבאות ביטוח לאומי העומדות על כ-2,200 ₪, היא אלמנה החיה בצניעות, אינה עובדת ואין לה חסכונות והשקעות. על פי האמור בבקשה, למערערת זכות חכירה בדירה בבאר שבע, אולם זו משועבדת לחברת ביטוח. מאחר שהמערערת אינה עומדת בתשלומי המשכנתא, מונה כונס נכסים לדירה. דמי השכירות מן הדירה, בסך 1,100 ₪
מועברים, לדבריה, ישירות לידי בעלת המשכנתא. המערערת מוסיפה וטוענת כי אין באפשרותה להיעזר בבנה לגיוס הכספים הנדרשים מפני שיש לו חובות גדולים בגינם מתנהל כנגדו תיק איחוד בלשכה להוצאה לפועל. בנוסף מתבקש איחוד דיון בערעור זה יחד עם הדיון בע"א 2340/08 ובע"א 1146/08, בטענה כי מ דובר במערכת עובדות זהה בעיקרה בשלושת התיקים. המשיבים 3-1 מתנגדים לבקשת הפטור מאגרה וערבון, הן בטענה כי סיכויי ההליך קלושים והן בטענה כי המערערת לא פרשה תשתית עובדתית מלאה ועדכנית בנוגע למצבה הכלכלי. המשיבים מפנים להחלטות אחרות שניתנו בעניינה של המערערת, בהן לא הופטרה מתשלום אגרה.

בניגוד למצב ששרר בעת הדיון בבקשות קודמות של המערערת לפטור מאגרה וערבון, המערערת מוכרזת כיום פושטת רגל. הדבר הוא בבחינת ראיה לכאורה לחוסר יכולת כלכלית (ראו: תקנה 14(ד)(3) לתקנות בתי המשפט (אגרות), התשס"ז-2007). גם אם יש ממש בטענת המשיבים כי המערערת לא פרשה תשתית עובדתית מלאה בדבר מצבה הכלכלי, לא שוכנעתי כי יש בכך כדי לסתור את הראייה הלכאורית. על כן, משלא נסתרה טענת המערערת לחוסר יכולת כלכלית, ניתן בזה פטור מתשלום אגרה, כמבוקש. אשר לבקשה לפטור מערבון, לעניין זה נדרש מבקש הפטור להראות, בנוסף לחוסר יכולת כלכלית, כי לא עלה בידו לגייס את כספי הערבון מ"הסביבה הקרובה". במקרה דנן, המערערת לא הבהירה בצורה מספקת מדוע לא תוכל להסתייע בבנה לצורך גיוס כספי הערבון. כמו כן, היא לא הסבירה מדוע אין באפשרותה להסתייע בקרובים אחרים, ובאחותה בפרט. בנוסף, לעניין הפטור מערבון, מתחייבת גם בדיקה של סיכויי ההליך. בשונה מעניין האגרה, הרי שנוכח תכלית הערבון, סיכויי ההליך מהווים שיקול כבד משקל בהחלטה האם להיעתר לבקשה לפטור מהפקדת ערבון, תוך חשיפת בעל הדין שכנגד לסיכון כי יתקשה בגביית הוצאותיו, ככל שתפסקנה ( ראו בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי (לא פורסם, 17.10.2007)). מעיון בפסק הדין, בהודעת הערעור ובטיעוני הצדדים, לא שוכנעתי כי סיכויי ההליך טובים במידה המצדיקה פטור מלא מערבון.

יחד עם זאת, מעיון בחומר באתי לכלל מסקנה כי בין ערעור זה לבין ע"א 1146/08 וע"א 2340/08 קיימת זיקה הדוקה. אמנם כל אחד מהערעורים עוסק בשלב שונה של הליך פשיטת הרגל, אך עולות בהם שאלות משותפות של עובדה ומשפט, כגון קיומו של "מעשה פשיטת רגל" מצד המערערת. נוכח החפיפה בין שלושת הערעורים, שיקולים של יעילות הדיון מצדיקים קיום דיון מאוחד. איחוד הדיון מאפשר להסתפק בערבון בסכום נמוך בהליך שבכותרת, שכן נראה כי תוספת ההתדיינות בגין ערעור זה אינה גדולה. בשים לב לכך שבע"א 1146/08 ובע"א 2340/08 הופקד ערבון בסך כולל של 20,000 ₪ וכן בהתחשב באמור ובמצבה הכלכלי של המערערת, יועמד הערבון בתיק זה על סך של 3,000 ₪. הערבון יופקד תוך 14 יום מעת המצאת החלטה זו, ולא- יידחה ההליך, ללא צורך במתן הודעה נוספת.
