בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת עירבון. המבקש טוען כי הוא עובד כשכיר בהכנסה חודשית ממוצעת של 4,000 ₪, כי רעייתו אינה עובדת, וכי אין ברשותו חסכונות ורכוש למעט הנכס נשוא הערעור. דא עקא, שבצדק טוענת המשיבה 1 כי הבקשה שלפניי אינה פורשֹת תשתית עובדתית מלאה באשר למצבו הכלכלי של המערער, כנדרש בבקשה מסוג זה. כך, למשל, לא פורטו בבקשה הוצאותיו של המערער, ולא צורפו מסמכים רלבנטיים כגון חשבונות שוטפים; לא בוססה כראוי הטענה הכללית כי לא ניתן להסתייע בסביבתו הקרובה (שנחלצה לעזרתו בגיוס כספי האגרה); ולא הוסבר כיצד מממן המערער את ייצוגו המשפטי. כמו-כן, בדפי חשבון הבנק מתועדות הפקדות של סכומים שמקורם לא הוסבר, וכן הפקדה חודשית של 300 ₪ לפיקדון. במצב דברים זה ובאין פירוט ותיעוד מספקים לא אוכן להיעתר לבקשה לפטור מעירבון. עם זאת, לאור הנתונים החלקיים שלפניי מצאתי לנכון להעמיד את סכום העירבון על שיעור מתון יחסית להליך מסוג זה – 15,000 ₪. סכום זה יופקד תוך 21 ימים מעת המצאת החלטה זו, שאם לא כן יירשם ההליך לדחייה ללא הודעה נוספת.
