המשיב, יליד 21.3.1987, נפגע ביום 13.11.2007 בתאונת עבודה, עת עבד אצל המערערת 1, שהמערערת 2 היא מבטחתה. הדיון פוצל בין שלב האחריות לנזק, ובית משפט קמא העמיד רשלנותו התורמת של המשיב על 10%.
אשר לחישוב הנזק – המשיב נפגע בכף ידו הימנית ממשור. המל"ל העמיד נכותו הצמיתה של המשיב על 27% (ללא הפעלת תקנה 15) לפי תקנות הביטוח הלאומי (קביעת דרגות נכות לנפגעי עבודה), התשט"ז-1956 (להלן: ה תקנות ). המומחה מטעם המשיב אף הוא העמיד נכותו הצמיתה של המשיב על 27% לפי התקנות ואילו
המומחה מטעם המערערות העמיד נכותו הצמיתה של המשיב על 12.5%. פרופ' יואב אנגל, שהתמנה כמומחה מטעם בית המשפט , העמיד את נכותו הכוללת של המשיב על 15% כלהלן: בשתי אצבעות - חסר של קצה עם עיוות של הציפורן והגבלה בכיפוף האצבעות; ואצבע ללא תנועה, כרית האצבע מחודדת עם עיוות של הציפורן
– 5% לכל פגיעה בשלוש האצבעות של כף יד ימין, לפי תקנות 43(2) ו-(4) ו-44(4) לתקנות.

בית המשפט
המחוזי עמד על כך שהמשיב סיים 12 שנות לימוד ללא תעודת בגרות, וכי על פי התרשמותו יכולותיו של המשיב מוגבלות. לאור זאת קבע בית המשפט כי:
"בהתחשב בפגיעה, בטיבה ובמיקומה (כף היד הימנית), נראה לי כי הנכות התפקודית שנגרמה לתובע עולה משמעותית על הנכות הרפואית, עד כדי גריעה של 30% מכושר השתכרותו. הפגיעה מביאה עימה, כמו כן, מיגבלה של ממש בתחרותיות המערער בהשגת מקום עבודה בעתיד".
בהתאם לכך חישב בית משפט קמא את נזקיו של המשיב על בסיס שכר של 6,250 ₪ ברוטו, כפי שהשתכר עובר לתאונה, כלהלן: הפסד שכר לעבר – 160,000 ₪; הפסד שכר לעתיד – 450,000 ₪; כאב וסבל – 200,000 ₪; עזרת צד ג' עבר ועתיד – 250,000 ₪. סך הכל – 1,060,000 ₪ בניכוי רשלנות תורמת 10% ובניכוי סך של 590,000 ₪ תגמולי המל"ל. סך הכל חוייבו המערערות בתשלום בסך של 364,000 ₪.
על כך נסב הערעור שבפנינו.

המערערת הלינה על כך ש בית המשפט העמיד את אובדן כושר ההשתכרות על 30%, בהתחשב בכך שבחלוף כשנה לאחר התאונה המשיב חזר לעבוד במפעל, והפעם כנהג, מבלי ששכרו נפגע. כן הלינה המערערת על גובה הסכום שנפסק בראש הנזק הלא ממוני, והסכום שנפסק בגין עזרת צד ג' לעבר ולעתיד.

בית המשפט
המחוזי, העמיד את נכותו התפקודית של המשיב על 30% למרות שנכותו הרפואית הועמדה על ידי מומחה בית המשפט
על 15%. קביעת הנכות התפקודית ובהתאם לכך קביעת הפסדי ההשתכרות, הם מסוג הנושאים הנמצאים בליבת שיקול הדעת של הערכאה הדיונית שהתרשמה ישירות מהנפגע ומהראיות שהובאו בפניה (ראו, לדוגמה, ע"א 9380/11 הפול המאגר הישראלי לביטוח רכב נ' חליפה אפתאח (לא פורסם, 15.3.2012)). התערבות ערכאת הערעור בנושאים אלה תיעשה במשורה ובמקרים של טעות בולטת או סטיה מההלכות המקובלות. לא זה המקרה שבפנינו, ועל כן איני רואה להתערב בקביעת ערכאה קמא, גם אם לכאורה היא על הצד הגבוה.

בית המשפט
המחוזי לא נקט בשיטת החישוב האריתמטי לצורך חישוב הפסדי ההשתכרות לעבר ולעתיד, אך במעין "הנדסה לאחור" ( reverse engineering ), ניתן להיווכח כי חישב את הפסד שכרו של המשיב לעבר על פי אובדן כושר השתכרות מלא של כשנה, ואובדן כושר השתכרות חלקי של 30% למשך כשלוש שנים עד למתן פסק הדין. ואילו הפסד ההשתכרות לעתיד נעשה על בסיס הפסד השתכרות של כ-25%. מכל מקום, גם אם אובדן כושר ההשתכרות נעשה על הצד הגבוה, הרי שהדבר "מתקזז" בכך שבית המשפט לא לקח בחשבון אפשרות לעליית שכרו של המשיב במהלך השנים, כך שאין מקום להתערבות ערכאת הערעור.

בדומה, איני רואה להתערב בראשי הנזק של כאב וסבל ועזרת צד ג', גם אם אלו נפסקו על הצד הגבוה, וזאת לאור מדיניות ערכאת הערעור שלא להתערב בגובה הפיצוי אלא במקרים חריגים של סטייה בולטת מעקרונות החישוב המקובלים.
אשר על כן, דין הערעור להדחות. המערערות ישאו בשכר טרחת המשיב בסך 18,000 ₪.
