בקשה להארכת מועד להגשת סיכומים
החלטה

בנסיבות העניין, יוגשו סיכומי המשיבים עד יום 3.4.2012, כמבוקש. סיכומי התשובה יוגשו, ככל שהמערער חפץ בהגשתם, עד יום 17.4.2012.

בירור במזכירות העלה כי המערער הגיש כתב סיכומים מתוקן בלבד, ללא תיק מוצגים מתוקן. התנהלות זו תמוהה בהתחשב בכך שתיק המוצגים המקורי הוחזר על-ידי המזכירות לידי המערער בהתאם להחלטת כב' הרשם שני מיום 14.3.2012; ובשים לב לכך שכתב הסיכומים המתוקן מפנה למוצגים שאינם בנמצא, על-אף שחלף המועד שנקבע בהחלטת כב' הרשם שני להגשת תיק מוצגים מתוקן. בהעדר תיק מוצגים מתוקן, אין באפשרותי להיזקק לבקשת המשיבים 1-2 להוצאת מוצגים מתיק המוצגים המתוקן, ואף אינני רואה בשלב זה להיזקק לבקשת המערער להוספת ראיות חדשות. עם זאת, בעניין האחרון אני רואה להעיר כי עצם ההפניה במסגרת הבקשה להוספת ראיות חדשות לנספחים בתיק מוצגים תמוהה אף היא, שהרי פשיטא כי ראיות חדשות אינן יכולות להיכלל בתיק מוצגים. תמיהה נוספת מתעוררת בהתחשב בכך שכתב הסיכומים המתוקן שהוגש מטעם המערער בשלושה עותקים ביום 15.3.2012 כולל 25 עמודים (לא כולל עמודי הפתיחה), בעוד שבהחלטת כב' הרשם שני מיום 26.2.2012 נקבע כי היקף הסיכומים לא יעלה על 24 עמודים.
המערער יגיש הבהרה להתנהלותו הדיונית האמורה עד יום א' 25.3.2012 בשעה 12:00. עוד יבהיר המערער האם בכתב סיכומיו המתוקן קיימת הפנייה או התייחסות כלשהיא לנספחים נשוא הבקשה להגשת ראיות נוספות לערעור (שאז לא יהיה מנוס מתיקון בשנית של כתב הסיכומים).

בקשתו של מר שטנצלר לתיקון טעות סופר תועבר על-ידי המזכירות לטיפולו של כב' הרשם שני לאחר המצאת החלטה זו לצדדים.
