החלטה
ביום 10.3.2009 דחיתי את בקשת רשות הערעור שהגישה המבקשת על החלטתו של בית המשפט המחוזי בתל-אביב-יפו בבש"א 12191/08 (תיק עיקרי בר"ע 2533/05).
כעת מבקשת המבקשת כי אבטל את החלטתי זו בשל העובדה כי לא ניתנה לה האפשרות להגיב לתגובת המשיב שהוגשה ביום 3.3.2009.
בשונה מהנטען על ידי המבקשת, לא קיימת בדין זכות מוקנית למבקש בבקשת רשות ערעור להגיב לתגובת המשיב ככל שזו התבקשה על ידי בית המשפט (ראו, תקנה 406(ג) לתקנות סדר הדין האזרחי, התשמ"ד-1984). משכך, ולאור העובדה כי איני רואה ממילא, אף כעת, כי היה מקום לאפשר למבקשת להגיב לתגובת המשיב, אין מקום להיעתר לבקשה.
אשר על כן, הבקשה נדחית.
