החלטה
א.
בקשה לעיון חוזר בהחלטתי מיום 24.2.09, בה נדחתה בקשת רשות ערעור בגלגול שלישי שהגישה המבקשת. עניינו של ההליך, קביעת בית משפט השלום כי המבקשת, שירשה מסבתה זכות דיירות מוגנת בנכס של המשיב, פלשה לשטח החצר שבמחלוקת, וכי בכל מקרה נטשה את המושכר. קביעה זו אושרה ב בית המשפט
המחוזי. בבקשה, שבניגוד לקודמתה נוסחה בבהירות על ידי עורכת דין, נטען בין היתר , כי מלכתחילה התייחסו טענות המשיב רק לפלישה לחצר וכי הוא הביע נכונות להגיע להסדר לגבי הדירה; כי שגה בית המשפט
המחוזי כשלא איפשר להגיש ראיות לסתור את טענת הנטישה; כי לא הוכחו מגורים בדירה בה נקבע שהמבקשת מתגוררת (טענה שצורפו ראיות להוכחתה). במישור העקרוני נטען, כי יש לקבוע כלליים ראייתים ודיוניים מיוחדים במקרים של פינוי דיירים מוגנים, הן בשל טיב הזכות והן בשל פערי הכוחות בין הצדדים.
ב.
לאחר העיון אין בידי לשנות מההחלטה מיום 24.2.09. ראשית , בית משפט זה סיים מלאכתו בהחלטה הקודמת, ועיון חוזר ניתן בנסיבות חריגות בלבד, שלא התקיימו כאן (ראו ע"א 3604/02 אוקו נ' שמי , פ"ד נו(4) 505, 508 (השופט גרוניס ); רע"א 5234/04 ר.י.ו. מהנדסים נ' בנק לאומי (לא פורסם); רע"א 9369/04 דדון נ' ןייסברג (לא פורסם)). אין בענייננו שינוי נסיבות המצדיקות עיון מחדש, או נסיבות מיוחדות לעיון חוזר. שנית , חרף האצטלה העקרונית שהבקשה עותרת להתכסות בה - מ דובר בסופו של יום בשאלות שבעובדה, ואלה הוכרעו על סמך קביעות מהימנות של הערכאה הדיונית. בפסקי הדין הקודמים אין קביעה משפטית העשויה לעורר שאלה מהסוג שבגינן נשקלת רשות ערעור בגלגול שלישי (ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123). בודאי כך לגבי הטענה, המוצגת כעקרונית, ביחס לצורך בקביעת מועדי פינוי סבירים - שאינה יכולה להישמע במקרה שתשתיתו העובדתית היא זניחת המושכר.

נדרשתי, על אף כל אלה, לטענות לגופן. בידוע, אין דרכה של ערכאת ערעור להתערב בממצאי עובדה שנקבעו בערכאה הדיונית (ע"א 4126/05 חג'אזי נ' עמותת ועד עדת הספרדים (טרם פורסם) פסקה י'), ודאי כך כשהם מיוסדים על שמיעת עדים - וקל וחומר בגלגול ערעורי שלישי (בע"מ 946/08 פלוני נ' פלוני (לא פורסם); רע"א 3189/06 וולפינגר נ' ראובני (לא פורסם)). אך דומה, כי טענות המבקשת וראיותיה - אפילו אלה המובאות בבקשה הנוכחית - אינן יכולות להטות את הכף.

בין היתר מתייחסת המבקשת לעובדה שהדירה בה נקבע שהיא גרה מושכרת - אך חוזה השכירות (עליו אין חולק שחתומה גם המבקשת) מתייחס אך ורק ל"חלק מהמבנה... הנמצאים בקומת הקרקע" (יתכן שיש גם הסברים, אך ברי כי לא ניתן להתייחס לכך כאל ראיה ניצחת שיכולה להטות כף בגלגול שלישי). גם הטענה המתייחסת לנכונות המשיב להסדיר את המשך השכרת הדירה אינה יכולה לפעול לטובת המבקשת. מבחינה היסטורית, כך מסתבר מעיון בתיק, התעניין המשיב בעיקר בפלישה לחצר - אך אגב התנגדות המבקשת לסלק ידה מהשטח אליו אין (ולא יכול להיות חולק) שפלשה, התעוררה סוגיית הנטישה. סופו של יום, דומה כי המבקשת פלשה לשטח שמעולם לא היתה לה כל טענה ביחס אליו, ואגב כך נפתחה נגדה חזית המבוססת בחומר ראיות, לרבות דוחות ממספר שנים עוקבות ביחס לנטישת המושכר. ולבסוף, אשר לטענת פערי הכוחות, לא למותר להזכיר, כי מ דובר באשה שיירשה מסבתה את זכויות המגורים, ולה דירה משלה באותו הישוב.

אין בידי איפוא להיעתר למבוקש.
