החלטה
המבקש הועמד לדין, יחד עם נאשם נוסף, בבית משפט השלום בראשון לציון (פ 2076/05) בגין עבירה של סחר בסמים, לפי סעיף 13 לפקודת הסמים המסוכנים, התשל"ג-1973.
לפי הנטען בכתב האישום, ביום 25.3.2005 מכרו המבקש והנאשם הנוסף לשוטר סמוי סם מסוכן מסוג קנבוס במשקל 777.87 גרם נטו, תמורת 150 ש"ח.
ביום 9.2.2006 הרשיע בית משפט השלום (כבוד השופטת ע' וינברג-נוטוביץ ) את המבקש בעבירה שיוחסה לו בכתב האישום, והורה על עריכת תסקיר מטעם שירות המבחן בעניינו. במסגרת התסקיר המליץ שירות המבחן להימנע מהרשעתו של המבקש ולהטיל עליו עונש של עבודות לתועלת הציבור.
ביום 10.7.2006
גזר בית המשפט על המבקש עונש של ארבעה חודשי מאסר בפועל שירוצו בעבודות שירות; שבעה חודשי מאסר על תנאי למשך שלוש שנים; וקנס בסך 1,500 ש"ח או 15 ימי מאסר תמורתו.
על פסק הדין הנ"ל ערער המבקש לבית המשפט המחוזי מרכז (ע"פ 2828-11-07), בטענו כי שגה בית המשפט משבחר להרשיעו, חרף המלצת שירות המבחן שלא לעשות כן.
בית המשפט המחוזי (כבוד סגן הנשיא א' טל והשופטים מ' פינקלשטיין ו- א' דודקביץ ) דחה את הערעור בקובעו כי גם אם הרשעתו של המבקש תפגע בעתידו, הרי שהאינטרס הציבורי מחייב את הרשעתו, וכי לא התקיימו לגביו אותן נסיבות חריגות המצדיקות ביטול ההרשעה.
מכאן בקשת רשות הערעור שבפניי, אשר במסגרתה שב המבקש וטוען כי שגה בית המשפט משהרשיעו, חרף המלצת שירות המבחן ולנוכח ההשלכה הקשה שתהיה להרשעה על עתידו. עוד טוען המבקש כי עניינו מעלה סוגיה עקרונית בדבר אופן החלתה של ההלכה שנקבעה בע"פ 2083/96 כתב נ' מדינת ישראל , פ"ד נב(3) 337 (1997) (להלן: עניין כתב ), בנוגע להימנעות מהרשעה.
מנגד טוענת המשיבה כי הבקשה אינה עומדת בקריטריונים הדרושים למתן רשות ערעור, שכן אינה חורגת מעניינו הפרטי של המבקש, וכי גם לגופו של עניין ההחלטה להרשיע את המבקש הייתה מוצדקת.
לאחר שעיינתי בבקשה על נספחיה, בתגובה לה ובהחלטותיהן של הערכאות שקדמו לי, שוכנעתי כי דין הבקשה להידחות.
עניינו של המבקש כבר נדון בפני שתי ערכאות. כידוע, הכלל הנוהג הינו, כי הרשות לערעור שני, אינה ניתנת כדבר שבשגרה, אלא מוגבלת למקרים המעוררים שאלה בעלת חשיבות משפטית או ציבורית, החורגת מעניינם הפרטני של הצדדים, בהתאם להלכת בר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982). בענייננו, חרף טענות המבקש, אין בבקשתו כל עילה שתצדיק מתן רשות ערעור, ואין ביישומה של הלכת
כתב על נסיבות המקרה כדי להוות עילה לקיומו של ערעור נוסף.
יתרה מכן, הלכה היא כי טענות הנוגעות לחומרת העונש כשלעצמה – ובהן גם טענה שהיה על בית המשפט להימנע מהרשעה, אינן מקימות עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 5504/08 פלוני נ' מדינת ישראל
(לא פורסם, 27.7.2008). בנסיבות המקרה, לא מצאתי כל סטייה שכזו מנורמת הענישה המקובלת בעבירה אותה ביצע המבקש, אף לאור נסיבותיו האישיות. מסיבות אלו בלבד, דין הבקשה להידחות.
מעבר לדרוש יוער, כי גם לגופו של עניין דין הבקשה להידחות. כידוע, משנקבעה אחריותו של אדם בפלילים, יש להרשיעו. חריג שבחריגים לכלל זה מותיר בידי בית המשפט סמכות להימנע מהרשעה, במקרים יוצאי דופן (ראו רע"פ 1189/06 בר-לב נ' מדינת ישראל (לא פורסם, 12.9.2006)). אמנם ייתכן ולהרשעתו בפלילים תהיה השפעה קשה על עתידו של המבקש, אולם על אפשרות זו היה לעמוד לנגד עיניו בשעה שבחר לבצע את העבירה בה הורשע, ולא מצאתי כי יש בנסיבותיו האישיות כדי להצדיק הימנעות מהרשעתו.
אשר על כן, הבקשה למתן רשות ערעור נדחית.
החלטתי מיום 23.6.2008, בעניין עיכוב ביצוע העונש, מבוטלת.
המבקש יתייצב ביום 26.11.08 בשעה 8:00 במפקדת מחוז דרום של שירות בתי הסוהר בבאר-שבע לשם תחילת ריצוי עונשו, לאחר תיאום עם הממונה על עבודות השירות.
