בקשה להארכת מעצרו של המשיב לפי סעיף 62 לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996, החל מיום 17.3.09 בתשעים ימים או עד למתן פסק דין בת"פ 40186/07 ב בית המשפט המחוזי בתל אביב-יפו, לפי המוקדם.

נטען, כי המשיב ואחרים חברו במסגרת ארגון פשיעה, בראשותו של אסי אבוטבול, למטרות פליליות שכללו פעולות סחיטה ואיומים על אנשי עסקים בעלי אזרחות צרפתית ועולים חדשים. נטען, כי המשיב נטל חלק בפעולות עברייניות אלה, בכך שאיתר אנשי עסקים שיועדו לסחיטה על ידי הארגון, וכן השתתף באופן פעיל בחלק מהאירועים שתוארו בכתב האישום. עם הגשת כתב האישום הוגשה בקשה למעצרו של המשיב עד תום ההליכים. עוד נטען, כי חומרת העבירות המיוחסות למשיב והעובדה כי הוא בעל אמצעים ונושא אזרחות צרפתית, מגבירה את מסוכנתו ואפשרות הימלטותו. חרף עמדת המדינה, שיחרר בית המשפט המחוזי (החלטה מיום 2.7.07, השופט נויטל ) את המשיב למעצר בית בתנאים מגבילים. בין נימוקי ההחלטה נקבע, כי חרף מעשיו החמורים, אין להפלות בינו לנאשם אחר - לו מיוחסים אישומים דומים, ואשר שוחרר למעצר בית – ואף אין לו עבר פלילי בישראל; כן צוין, כי שרות המבחן שערך תסקיר בעניינו, המליץ על שחרורו לחלופת מעצר. ביום 16.4.08 הקל בית המשפט את תנאי מעצר הבית של המשיב, והתיר לו לצאת לעבודה ולביקור קצר מחוץ לביתו. ואולם, המשיב הפר את התנאים. ביום 26.8.08 קיבל בית המשפט
המחוזי (ב"ש 91785/08, סגנית הנשיא רוטלוי ) את בקשת המדינה לעיון חוזר בהחלטת שחרור המשיב למעצר בית, וקבע כי קיימת עילה למעצרו אשר לא ניתן להפיגה בחלופה. צוין, כי המשיב התעלם מתנאי שחרורו, חיבל במכשיר הפיקוח, יצא מביתו ללא אישור עשרות פעמים, וכן נסע לאילת ללא היתר. ביום 15.9.08 דחה בית משפט זה (בש"פ 7606/08, השופט ג'ובראן ) את ערר המשיב, וקבע כי מעל באמון שניתן בו על ידי בית המשפט , וכל חלופת מעצר לא תאיין את מסוכנותו. עתה הוגשה בקשה לעיון חוזר ב בית המשפט המחוזי, שנקבעה לדיון אתמול, אך כיון שהמשיב הובא לבית משפט זה – לא נשמעה.
ג.
עתה עותרת המדינה להורות על הארכת מעצרו של המשיב בתשעים יום, בנימוק של מסוכנותו והפרת תנאי המעצר על ידיו באופן תדיר. המדינה הסתמכה על החלטתו הנזכרת של השופט ג'ובראן. לבסוף נטען, כי משפטו של המשיב התקיים באופן סדיר ורצוף, ולעת הזאת הוא קבוע להכרעת דין ליום 30.4.09.
ד.
בדיון הביעה עו"ד פטל צערה על שהבקשה הוגשה באיחור, בשל טעויות חישוב עקב השחרור והמעצר המחודש, וכן ציינה כי בירור העלה שהמועד הנכון להארכה היה מיום 17.3.09, ולא כפי שהוגש – 18.3.09. נגרמה אפוא תקלה חמורה ומצערת של מעצר שלא כדין למשך יום אחד. עם זאת, נטען כי על פי הפסיקה אין בכך כשלעצמו כדי להביא לשחרורו של המשיב, ובמקרה דנא עילות המעצר בעינן ועמן המסוכנות והחשש להימלטות, וזאת לאחר שסר האמון במשיב עקב עשרות הפרות.
ה.
באת כוח המשיב, טענה שיש מקום לשחרור – לאו דווקא או רק בשל המעצר הלא חוקי, הראוי לשיטתה כשלעצמו לפיצוי - אלא לגופם של דברים, וכאמור בקשה לעיון חוזר לא נשמעה ב בית המשפט המחוזי בשל הדיון כאן. לענין המעצר הלא חוקי, קבלה באת כוח המשיב על כך שאיש ברשויות הן בשירות בתי הסוהר והן בפרקליטות לא התרגש מפניותיה באשר למועד המעצר. לגופם של דברים נטען, כי ההפרות היו לא ראויות, אך המשיב למד את הלקח, מה גם שחולט סכום כסף גדול ממשפחתו; ועוד הוא מצוי - כנטען - בסכנה בשל עדויות שמסר נגד אחרים, והסכנה היא גם למשפחתו. גם אם ההליך השיפוטי נמשך כסדרו, המשיב סובל בהיותו בהפרדה בחדר ללא חלון, המופרד מן השירותים בוילון, ואף תפילה ספק אם ניתן לקיים שם, והוגשה עתירת אסיר מטעמו.
ו.
אפתח בתקלה הכפולה שנפלה כאן: העיקרית - המעצר הבלתי חוקי, ולוּא גם ליום אחד; במקום אחר (בש"פ 10803/05 מדינת ישראל נ' עילווי (לא פורסם)), נזדמן לי לומר:
"כבר אירעו תקלות כאלה בעבר, כפי שהציגה באת כוח המדינה. במקרה בו עוכב אדם שלא כדין (בש"פ 3979/98 מדינת ישראל נ' ג'נח ) כתב השופט מצא, כי
"גם מקום שבו בית המשפט סבור, שהעיכוב היה שלא כדין, אין בית המשפט
פטור מלדון בבקשת המעצר המובאת בפניו לגופה ולהחליט אם קיימת בפניו עילה להורות על מעצר. בוודאי שאין בית המשפט
רשאי להתעלם מבקשת המעצר שבפניו, כביטוי למורת-רוח מכך שהמשטרה עיכבה את החשוד מעבר לזמן המותר". כך גם דברי השופט ריבלין בבש"פ 8971/00 חזות נ' מדינת ישראל
בעקבות מעצר לא חוקי של מספר ימים: "אכן, אין להתייחס למעצר בלתי חוקי כאל תקלה טכנית הניתנת לתיקון על-ידי מעצרו מחדש של הנאשם ללא בדיקה מחודשת של עניינו תוך התחשבות במעצר הבלתי חוקי (דברי השופטת ד' דורנר בב"ש 7721/95 כהן נ' מדינת ישראל , פ"ד מט(4) 167, 171). מאידך גיסא, העובדה שנפל פגם בהליכים שנתקיימו ב בית המשפט קמא, בעטיה של התרשלות התביעה, אינו מהווה שיקול מכריע ויחיד בשאלה אם יש מקום להיעתר לבקשה להורות מחדש על מעצר. בית המשפט אינו רשאי להתעלם מן השיקולים האחרים העומדים ביסוד הבקשה אך ורק בשל מורת הרוח נוכח מחדלי התביעה". וכה כתב השופט (כתארו אז) חשין בבש"פ 8252/03 מדינת ישראל נ' אלסאנע , שם היה המשיב עצור כחודשיים ועשרים ימים שלא כדין: "לא אוכל לסיים את דברי בלא שאעיר על החומרה היתרה שיש לראות בה את השגגה שרשויות המדינה נתפסו לה, ואשר הביאה למעצרו של המשיב לתקופה כה ארוכה בלא אסמכתא לדבר. ראוי שהממונים יחקרו את הצורך חקירה ויפיקו לקחים... ההפיקו הממונים לקחים כהצעתו של השופט מצא (במקרה דומה קודם – א"ר)? אם לאו – מדוע כך, ואם כן – כיצד אירע האירוע שלפנינו ". ואנו מה נענה אבתרייהו, מה נאמר אחרי מה שאמרו שופטים אלה, ואף אם תקלות כאלה אינן מרובות, והעומס על הפרקליטות רב, ליחיד אשר לו אירעו הריהן משמעותיות, וגם לשלטון החוק כמובן, במדינת חוק האמונה על כבוד האדם וחרותו".
אני מקוה כי אף בענייננו הופקו לקחים, ובעידן של מחשב במיוחד לא בשמים היא שהמחשב יתריע על הנחוץ. אודה אם תוצאות בדיקת הפרקליטות יועברו לעיוני תוך 30 יום (ראו גם החלטתי בבש"פ 2482/09 מדינת ישראל נ' סלאח (מאתמול)). גם באשר להגשת הבקשה לפי סעיף 62 נפלה תקלה; ראוי כי בקשות לא יוגשו במועד מאוחר כמו הפעם, אף כי אכן היה כאן צורך בחישוב מיוחד, בשל השחרור והמעצר המחודש.
ז.
לגופם של דברים, סבורני בנסיבות כי יש לקבל את הבקשה. אכן חלפו תשעה חודשים ועת היא, על פי צו המחוקק, לבדיקת התנהלותו של ההליך – אך בנדון זה אין טענה, וההליך התנהל כסדרו; התיק קבוע להכרעת דין. מבחינת התנהגות המשיב בהקשר למעצר, איני צריך להכביר מלים, נוכח ההחלטות השיפוטיות שקדמו. מכל מקום, הטענות שהועלו (מלבד אלה שעניינן תנאי המעצר, הבאות כעתירת אסיר), עניינן ביסודן לעיון חוזר, הקבוע ב בית המשפט המחוזי, ולא אביע דעה לגביו.
