החלטה

בקשה לעיון חוזר בהחלטתי מיום 7.3.2010 בה הוריתי על שחרורו של המשיב בכפוף לחלופת מעצר מתאימה שתיקבע על ידי בית המשפט המחוזי. עד ובכפוף לאותה החלטה, הוריתי על הארכת מעצרו של המשיב.

החלטתי הנ"ל התבססה על מספר פרמטרים, בין היתר, על כך שכתב האישום כנגד המשיב הוגש מספר שנים לאחר ביצוע המעשה המיוחס לו וכי עד לאותו מועד המשיב הסתובב חופשי. מהבקשה עולה, כי נעלם מעיני שבמהלך השנים שקדמו להגשת כתב האישום, המשיב היה נתון במאסר בגין תיק אחר.
יש להצר על כך שעובדה זו לא הוצגה בפני "ברחל בתך הקטנה" ועל כך שהמבקשת לא צרפה לחומר הראיות שהוגש ל בית המשפט את הרישום הפלילי של המשיב. אכן, מהחומר שהוצג בפני ומטיעוני הצדדים עלה כי חלק מתקופת מעצרו של המשיב נזקפת לחובת תיק אחר וכי המשיב ריצה בעבר תקופת מאסר ארוכה, אך לא ניתן היה להסיק מכך שהמשיב החל לרצות עונש מאסר ארוך סמוך לאחר מעשי השוד והרצח המיוחסים לו בכתב האישום.

ב"כ המשיב התנגדו לבקשה, והאריכו בתגובתם במישור מהימנות המדובב. אין לי אלא לחזור ולהפנות לסעיף 7 להחלטתי הנ"ל, שם נאמר כי המסגרת של בקשה להארכת מעצר לפי סעיף 62 לחוק המעצרים, אינה האכסניה הנאותה לטענות כגון דא.

ב"כ המשיב טענו כי בית המשפט אינו מוסמך לשנות את החלטתו נוכח עקרון סופיות הדיון. איני סבור כך. אכן, ברגיל בית המשפט אינו יושב כערכאת ערעור על החלטותיו שלו, אך במקרים חריגים, רשאי בית המשפט
לחזור ולבחון החלטתו, אם מצא כי הושתתה על אדנים עובדתיים שגויים. עקרון זה פועל כמובן לשני הכיוונים. כך, לדוגמה, מקום בו הורה בית המשפט על מעצרו של פלוני מתוך הנחה כי לפלוני עבר פלילי מכביד, ונתברר כי לפלוני אין עבר פלילי, רשאי בית המשפט לחזור ולשקול החלטתו מחדש.

ולגופה של בקשה.
לא אכחד כי בהתלבטות בין הארכת מעצרו של המשיב לבין בחינת אפשרות שחרורו לחלופת מעצר, ייחסתי משקל של ממש לכך שהמשיב היה משוחרר תקופה ארוכה עד למעצרו בגין העבירות המיוחסות לו בכתב האישום, עובדה שנתבררה כלא נכונה. הדבר בא לידי ביטוי בהחלטה הנ"ל בה נאמר כי " משקל נכבד אני נותן לכך שהמעשים המיוחסים למשיב אירעו במהלך שנת 2002 אך כתב האישום כנגדו הוגש רק ביום 14.11.07, היינו, כחמש שנים הסתובב המשיב חופשי. יש בכך כדי להקהות את הטענה למסוכנות הנובעת מהמשיב" (הדגשה שלי – י.ע.). כעת, משנתברר כי הנחה זו בטעות יסודה, נשמט פרמטר בעל משקל במערכת השיקולים, פרמטר הנוגע למסוכנותו הפוטנציאלית של המשיב, ואני מוצא כי הכף חוזרת ונוטה לכיוון הארכת מעצרו של המשיב.
אשר על כן, אני נעתר לבקשה לעיון חוזר, ומשנה את החלטתי הנ"ל, באופן שאני נעתר לבקשת המדינה ומורה – הפעם ללא סייג של בחינת חלופת מעצר - על הארכת מעצרו של המשיב ב-90 יום החל מיום 4.2.10, או עד מתן פסק דין בעניינו בתפ"ח 1171/07 בבית המשפט המחוזי בבאר שבע, לפי המוקדם ביניהם.
