סעיף 30(ב) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984, מקנה סמכות להורות על דיון נוסף בעניין שפסק בו בית המשפט העליון בשלושה. זאת, אם ההלכה שנפסקה עומדת בסתירה להלכה קודמת של בית המשפט העליון, או שמפאת חשיבותה, קשיותה או חידושה של ההלכה יש מקום לדיון נוסף. דיון נוסף יכול להיערך, לפיכך, רק בהלכה שנפסקה. קראתי וחזרתי וקראתי את פסק הדין מושא העתירה (בג"ץ 6474/10, מיום 3.2.2014) ולא גיליתי בו כל הלכה שנפסקה, לא כל שכן הלכה העומדת בסתירה להלכה קודמת. דומה, כי כלל טענותיה של העותרת הן ערעוריות באופיין, המופנות כלפי האופן בו יישם בית המשפט העליון את הדין הקיים על המערכת העובדתית שעמדה בפניו. העותרת טוענת חזור ושוב כי פסק הדין מתעלם מהלכות כאלה ואחרות שנפסקו על ידי בית משפט זה בעבר. אפילו נכונה הטענה, ואיני קובע זאת, הרי אין בכך כדי להוות עילה להורות על דיון נוסף.

לפיכך אני דוחה את העתירה בלא שהוגשה תשובה. מטעם זה לא ייעשה צו להוצאות.
