בקשה למתן פסיקתא
החלטה
כידוע, על הפסיקתא לשקף את החלק האופרטיבי של פסק-הדין. אין היא חי הנושא את עצמו ואין היא בגדר אמצעי לשינוי או להוספה על התוצאה האופרטיבית כפי שנפסקה בשעתו - אף לא בהסכמת הצדדים. הפסיקתא בנוסחה כפי שהוגשה חורגת מהאמור בחלק האופרטיבי של פסק-הדין הנדון, ולפיכך אין בידיי לאשרה. בהתחשב בכך, תודיע המערערת 1 האם היא מבקשת לקבל פסיקתא שנוסחה כדלקמן:
בהתאם לפסק-הדין מיום 28.12.2009, ניתן בזאת צו לרישום 1/4 (רבע) מחלקה 83 בגוש 561 וחלקה 27 בגוש 557, על שם דינה שמחוני ת.ז. 053480398 בלשכת רישום המקרקעין, כאשר זכויותיה נקיות משעבוד למשיב 1.
הודעת המערערים, בצירוף עמדת המשיבים, תוגש תוך 5 ימים מעת המצאת החלטה זו.
